CLOSING THAT PORTION OF SWTNER DRIVE, SOME -
TIMES KNOWN AS SWANTNER STREET EXTENDING FROM
THE 'NORTH LINE OF KINNESOTA STREET TO.THE SOUTH
LINE OF GLAZE:BROOK STREF,T, ALL OF SAID STREET
AS CLOSED BEING IN THE CITY OF CORPUS CHRISTI,
TEXAS; AND DIRECTING THAT THE SAID CLOSING BE
ONLY FOR TEE LIMITED PURPOSE OF CLOSING SAID
PORTION OF SVLWT19M DRIVE TO TRAFFIC A1,D TO THE
EXISTENCE AND l4AINT'ENANCE OF SAID STREET; AND
DECLARING AN EMBRGENCY.
WTHERFM, the City Council of the City of Corpus Christi has been
petitioned that a portion of Swantner Drive hereinafter described, be closed
for street purposes; and,
"MREAS, notice of the proposed closing of said street has been
given by publication and by mail to the last ;mown address of all ormers
abutting said street and ,ithi, 450 feet therefrom, in accordance with the
Charter of the City of Corpus Christi as provided for under Article II, Sec-
tion 6 thereof; and,
MdERLAS, in accordance with the Notice given as above set out, a
Public hearing was held by the City Council of the City of Corpus Christi
at 11 :00 o,clock P. M. on the 12th day of July, 1949, in the City Council
Chamber at the City Hall; and,
vuHEREAS, the public welfare, safety, convenience and necessity
will be better served by the closing of certain portions of said street
to traffic and to the existence and maintenance of said street;
NOW, THEREFOPE, BE IT CRDAINED BY TIE CITY COUNCIL OF 'TIE, CITY
Ur' CORPUS CHRISTI, TEXAS:
SECTICH 1. That a portion of Swantner Drive, sometimes known as
Swantner Street, described as follows, to -wit:
All that portion of Swantner Drive, sometimes
known as Swamtner Street, lying between the north
property line of Minnesota Street and the south
property line of Glazebrook Street and lying in
Lindale Park No. 4 Addition to the City of Corpus
Christi, Nueces County, Texas,
be and the same is hereby closed to public use for street purposes; but the
dedication thereof is not vacated and the same is hereby retained for all
other purposes including the use thereof as an easement for public utilities.
SECTION 2. That the City of Corpus Christi does net release or re-
linquish any right, title and interest in or to my of said street described -

in Section 1 hereof to the property on�ners abutting said street, but ex-
pressly retains all right, title and interest therein by closing said sec-
tions of said street to public travel and traffic, street maintenance and as
a public thoroughfare.
SECTION 3. The fact that public convenience and necessity will be
better served by the closing of said street as a public thoroughfare creates
a public emergency and a public imperative necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date it is introduced, and that such Ordinance or Resolution shall be
read at three regular meetings of the City Council; and the lsyor, having de-
clared that such public emergency and imperative necessity exist, and having
requested that such Charter rule be suspended, and that this Ordinance be
passed finally on the date of its introduction, and take effect and be in
Hall force and effect from and after its passage, IT IS ACCORDIPiGLY SO
ORDAINED.

Gentlemen.
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
