C. STONE, FRANK SPARKS, AND J. A. C. RAM, AGREEING ON THE SETTLEMENT OF ALL CLAIMS FOR DAMAGES TO THEIR RESPECTIVE PROPERTIES BY REASON OF THE WIDENING AND IM- PROVING OF WATER STREET; PROVIDING FOR THE PAYMENT OF SAID CLAIMS FROM FUND NO. 295, IMPROVEMENT BONDS 1948 CONSTRUCTION FUND (STREET IMPROVEMENTS); PROVIDING THAT SAID PAYMENTS WHEN MADE SHALL FOLLY FC;ZFa•E THE CITY FROM ANY FUR- THER LIABILITY; AND DECLARING AN EMERGENCY." BEING ORDINANCE NO. 2%4, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 21ST DAY OF JUNE, 1949, AND APPEARING OF RECORD IN VOLUME 17, PAGE 411; OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, BY AMMDING PARAGRAPH b. OF SECTION 1. THEREOF; AND DECLARING AN EMERGENCY. BE IT ORDADNED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 2544 entitled: "AN ORDINANCE AUTHORIZING AND DIRECTING TITS' CITY MANAGER TO EXECUTE CONTRACTS FOR AIM ON BEHALF. OF THE CITY WITH EACH OF THE FOLLOWING PERSONS: JOHN MIRCOVICH, JR.. C. C. STONE, FRANK SPARKS, AND J. A. C. BASER, AGREEING ON THE SETTLEMENT OF ALL CLAIMS FOR DAMAGES TO THEIR RESPECTIVE PROPERTIES BY REASON OF THE WIDENING AND IMPROVING OF WATER STREET; PROVIDING FOR THE PAYMENT OF SAID CLAIMS FROM FOND NO. .295, IMPROVEMENT BONDS 194e CON- STRUCTION FOND (STREET IMPROVEMENTS), PROVIDING THAT SAID PAYh=S WHEN MADE SHALL FULLY RELEASE THE CITY FROM ANY FURTHER LIABILITY; AND DECLAR- ING AN EMERGENCY ", . appearing of record in Volume 17, Page La4, be and the same is hereby amended so that paragraph b. of Section 1. of said Ordinance No. 2544 shall hereafter read as follows: "b. C. C. Stone regarding Lots 1 and 2, Block 5, Water Beach Portion of the City of Corpus Christi, Texas, and settlement of his claim for damages in the amount of f 1, 669.50.:: SECTION 2. That the payment of all of the amounts provided to be paid herein be made from Fund No. 295 Improvement Bonds 1948 Construction Fund (Street Improvements). SECTION j. The necessity for correction of Ordinance No. 2544 due to the fact that the damages for the required destruction and removal of a concrete block building situated on a portion of the property was omitted calculation of the damages originally contemplated in the said Ordinance No. 2514 making it necessary to revise said original contract in that, regard so as to include an additional item of $¢995.00 for said destriction and re- moval of said building and the necessity for the completion of the contem- plated improvements on Water Street as promptly as possible, creates a public emergency and public imperative necessity requiring the suspension of the ChWer rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having re- quested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDIEGLY SO ORDAINED. D. 191& w5 Corpus Christi, Texas lit 1 Q 1949 TO THE EBS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen; For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
