AUTHORIZING THE CITY TO CONDEMN CERTAIN
REAL ESTATE WITHIN THE CITY OF CORPUS
CHRISTI, TEXAS, AND DIRECTING THE CITY
ATTORNEY TO INSTITUTE PROCEEDINGS IN
ORDER TO CARRY OUT THE INTENTION OF THIS
ORDINANCE; AND DECLARING AN F.NBRGENCT..
SPBEREA3, the City of Corpus Christi intends to establish, widen,
construct and maintain a street and highway and in order to do so it is
necessary that certain real property be acquired by said City and more par-
ticularly described as follows:
Beginning at a point on the south right- of-way
line of State Hwy. No. 9, said point being the north-
east comer of the east 1/2 of Lot No. 9, Tract C,
of the Bancroft Farm Lots;
Thence S 290 46, W. along the east line of said
'Lot 9, a distance of -42.30 feet to a point;
Thence N 53o Of W. a distance of 61.69 feet to
a point in the south right-of-way line of State High-
way No. 9;
Thence S 890 40, E. along the said south right -
of -way line a distance of 70.27 feet to the point of
beginning;
Said parcel of land contains O.O3b Acres, more
or less,
and,
WHEREAS, the record title of said property appears to be in Yrs. J. J.
Uehlinger, a feme sole, of Jefferson County, Texas, and Witold B. Carter of
Nueces County, Texas; as a result thereof it is impossible that an agreement
as to price and value of said property be reached between the City of Corpus
Christi, Texas, and said owners of said property; but it becomes expedient
that said property be condemned by the City of Corpus Christi, Texas, £or
street end public purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. In conformity with the premise, and in accordance with
certain provisions of the City Charter, the said City of Corpus Christi, Texas,
does hereby order the condemnation of certain real estate in Nueoes County,
Texas, and described as follows:
Beginning at a point on the south right- of-way
line of State Hwy. No. 9, said point being the north-
east comer of the east 112-of Lot No. 9, Tract C, of
the Bancroft Farm Lots;
Thence S 290 461 A along the east line of said
Lot 9, a distance of. "30 feet to a point;
Thence N 530 O* W. a distance of 61.69 feet to
a point in the south right-of-way line of State Highway
No. 9;
Thence S 890 4401 E. along the said south right -of-
way line a distMe of 70.27 feet to the point of beginning, -

and the City Attorney is here authorised and directed to institute condem-
nation proceedings against said property and all the persons who might have
an interest therein, and to proceed with said condemnation suit to 15 con-
clusion, with the intention in mind of obtaining fee simple title in and to
said property for the purpose of using the same for street widening, con-
struction and maintenanoe.
SECTICS 2. The public importance of this Ordinance and the neces-
sity for the City to gain possession and title of the real property herein -
before set out so that said street and highway may be widened -, constructed
and maintained, creates a public emergency and public imperative necessity
requiring the suspension of the Charter Rule providing that no ordinance or
resolution be passed finally on the date it is introduoed and that such ordi-
canes or resolution shall be read at three (j) several meetings of the City
Council, end the Mayor, having declared that such public emergency and such
imperative public necessity exist, requests that maid Charter Rule be sus-
pended, and that this Ordinance take effect and be in full force and effect
frcm and after its passage, IT IS.ACCCEDINGLY'OEDAINED.
PASSED AND APPROVED this Lday of October, a. D. 1949.

Gentleman:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City CGuncilz I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
Introduced, or at the present meeting of the City Council.
