HomeMy WebLinkAbout02623 ORD - 10/25/1949AN ORDINANCE ANIENDING THE ZONING ORDINANCE OF THS CITY G-e CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, AND APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF TEE .ORDINANCE AND RESCLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, AND AS AMENDED FROM TIME TO TIME THEREAFTER, AND IN PARTICULAR AS AI+MNDED BY ORDINANCE N0. 2266, PASSED AND APPROTED BY THE CITY COUNCIL ON THE 4TH DAY OF MAY, 1948, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ, OF THE .ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI BY AMD- ING THE ZONING MAP APPP..OVED BY THE CITY COUNCIL ON MAY 4, 194a, IN THE PARTICULARS HEREIN SET FORTH TO TEE EFFECT THAT THE AREAS HEREIN DESCRIBED FROM AND AFTER THIS DATE BE ZONED AS t"'i OVIDED BEMIN, PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERERITH ARE IRSREBY RE- PEALID, AND DECLARING AN MMRGENCY. ti'HOREAS, the Zoning and Planning Commission of the City of Corpus Christi hes recommended to the City Council of said City that it is advisable to make the hereinafter set out changes in the present Zoning Ordinance and the Zoning Plop of the City of Co, pus Christi, and, WHEREAS, the City Council at its regular meeting held on Septem- ber 27, 1949, ordered a Public Hearing to be held on October 18, 1949, at 4.00 o'clock P. M.; and, WHEREAS, proper notice of said hearing was published in the manner provided by law; and, VfiUREAS, the City Council did on October 18, 1949, hold such hearing, where all interested citizens, property owners, and other parties had the opportunity to be heard on the proposed amendments, and that at said hearing all parties interested and wishing to be heard were heard; NONE THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance and Map of the City of Corpus Christi passed on the 27th day of August, 1937, appearing in Volume 9, at Pages 565 at sag of the Ordinea ce and Resolution Records of the City of Corpus • Christi, and as amended from time to time, and in particular as emended by Ordinance No. 2266 passed and approved by the City Council of said City on the 4th day of May, 1948, and appearing in VOlwm 16, Pages 339 at sag of the Ordinance and Resolution Records of said City be amended as follows, A. That the said Zoning Map approved by the City Council on May 4, 194B, be and the same is hereby amended in the following respeetsi 1. That that area described as beginning at the southeast corner of the Bluebonnet Addition to the City of Corpus Christi, Texas, as shown by map of record in the office of the County Clerk of Sueoes Countys Texas; Thence S 120 59, 08" A. with the east boundary line of the Snodgrass-30 sore tract, a dis- tance of 325.32 feet to a point; Thence S. 870 461 13" A, a distance of 203.11 feet to a point for a. corner and beginning of this description; Thence S. 870 461 13" 91, a distance of 786.22 feet to a point, the beginning of a curve to the right, having a radius of 30 feet and a central angle of 860 05+ 13 "; Thence along said ourve to the right, a distance of_ 45.07 feet to a point; Thence S. 10 411 A. a distance of 154.96 feet to a point for the northwest corner of this description; Thence S. 860 071 E. a distance of 876.05 feet to a point for the northeast corner of this description; Thence S. 120 59, OB" Ws a distance of 72.69 feet to a. point, the beginning of a curve to the right, having a radius of 30 feet and a central angle of 790 141 39 ", Thence along said curve to the right, a distanoe of 41.49 feet to the place of beginning, be and the same is hereby rezoned from "Al2" Second Apartment Souse District Use to "S -1s Single Family Dwelling District Use. B. That the said Zoning Map approved by the City Council on May 4, 1948, be and the same is hereby amended in the fallowing respects: 2. That that area described as beginning at the southeast corner of the Bluebonnet addition to ths�City of Corpus Christi, Texas, as shown by map of record in the office of the County Clerk of Nueces County, Texas; Thence S. 12° 59' 08" W. with the east boundary line of the Snodgrass 30 acre tract, a distance of 386.40 feet to a point for the northeast corner and beginning of this description; Thence continuing S. 120 59' 08" Yi. with the east boundary line of said Snodgrass 30 acre tract, a distance o£ 151.56 feet to a point for the southeast corner of this description; Thence S. 870 55' 39" Tf, a distance of 1137.82 feet to a point for the southwest corner of this description; Thence N. to Lat w, a distance of 224.29 feet to a point for the Northwest corner of this description; Thence S. 870 46. *. 13" E. a distance of 1178.92 feet to the place of.beginaing, containing 5.08 acres of land, be and the same is hereby rezoned from "H -I" Heavy Industrial District Use to "R -1" Single Family, Dwelling District Use. SECTION 2. That the official Zoning Map of the City of Corpus Christi, Texas, be and the some is hereby amended as herein ordained. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That the said Zoning Ordinance and Plop of the City of Corpus Christi, approved on the 4th day of Nay, 1948, as amended from time to time, except as herein changed shall remain in full force and effect. SECTION 5. The fact that it is of the greatest public importance to put in force i;m,ediately the changes in the Zoning Ordinance and Map as here3nabove provided, for the purpose of providing for the orderly and pro- gressive growth of the City, and the necessary protection of the lives, health, property and welfare of the citizens creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such public emergency and such imperative public necessity exist;.requests that said Charter rule be suspended, and that this Ordinance take effect and be in full force and effect from and after its passage and after its publication one time as is provided and required by the Charter of the City of Corpus Christi, AND IT IS SO ORDAflp- PASSED AND AP€ROVED this yw day of October, A. For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council, I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
