RECEIVING AND ACCEPTING THE WORK OF
CONSTRUCTION OF BUILDINGS AND INSTAL-
LATION OF MACHINERY AND EQVIFAMT AND
THE FURlIISHING OF ENGINES, GEARS AND
PUMPS, SANE BEING TIE PUMPING PLANTS- -
BAYFRONT PROTECTION AND STORM WATER
CCNTROL AUTHCRIZED UNDER CONTRACT
DATED JANUARY 21, 1948, BETWEEN TBE
CITY OF CORPUS CHRISTI AND J. DEPUY &
SON; AUTHORIZING FINAL PAYMENT TO J.
DEPUY & SON UNDER THE CONTRACT FOR
SAID IMPROVENENTS; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COU14CIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the work of construction of buildings and instal-
lation of machinery and equipment and the furnishing of engines, gears and
pumps, same being the pumping plants-- Boyfront protection and Storm Water
control, in the City of Corpus Christi, Texas, performed by J. DePLly & Son,
having been performed and completed in accordance with the terms and pro-
visions of the contract and the plans and specifications therein contained,
said contract having been entered into by and between the City and J. Depuy
& Son on the 21st day of January, 1948, and the Director of Public Works
having inspected the same and certified to the completion of said work in
accordance with said plans and specifications, and said work aforesaid is
hereby found to have been completed in accordance with the plans and speci-
fications and is here now accepted and received by the City Council of the
City of Corpus Christi, Texas.
SECTION 2. That final payment due under the contract and as set
out in the final estimate prepared by the Director of Public Works dated
October 19, 1949, in the sum of Thirty -four Thousand Six Hundred Thirteen
Dollars and Ninsty -nine Cents ($34,613.99) be made in accordance with the
terms of such contract and that such payment be made from No. 258 Seawall
and Breakwater Construction Fund.
SECTION 3. The necessity for providing adequate pumping plants
for bayfront protection and storm water control withiuthe City of Corpus
Christi Grantee a public emergency and public imperative necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall be

passed finally on the date it is introduced and that such ordinance or
resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such public emergency and imperative
necessity exist, and having requested that such Charter rule be suspended,
and that this z dinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,

Gentlemen;
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
