HomeMy WebLinkAbout02628 ORD - 11/01/1949AN ORDINANCE RECEIVING AND ACCEPTING THE IVORK OF CONSTRUCTION OF PORT AND AGNES STORM SEWER, MAINS, LATERALS AND APPURTENANT STRUCTURES 21 THE CITY OF CDI&US CHRISTI, TEXAS, SAME BEING THE STORM SEWER I34- PROVEi'ENTS AUTHORIZED UNDER CONTRACT DATED NUM- HER 10, 1948, BETWEEN THE CITY OF CORPUS CHRISTI AND HEDMIFELS BROTHERS; AUTHORIZING FINAL PAY- MENT TO HELDMUELS BROTHERS UNDER TIM CONTRACT FOR SAID IMPROVEMENTS; AND DECLARING AN EMRGENCY. BE IT ORDAIM) BY THE CITY COUNCIL OF THE CITY OF CORPUS CI::ISTI, TEXAS: SECTION 1. That the work of construction of Port and Agnes storm sewer mains, laterals and appurtenant structures in the City of Carpus Christi, Texas, performed by Heldeafels Brothers, having been performed and completed in accordance with the terms and provisions of the contract and the plans and specifications therein contained, said contract having been entered into by and between the City and Ilelden£els Brothers on the 10th day of November, 1948, and the Director of Public 'forks having inspected the same and certified to the completion of said worIg in accordance with said plans and specifications, and said work aforesaid is .hereby found to have been completed in accordance with the plans and specifications and is here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate prepared by the Director of Public Jorks dated October 31, 1949, in the sum of Fifty -five Thousand Two Hundred Twenty Dollars (+455,220.00) be made in accordance with the terms of such contract and that such payment be made from No. 295 Improvement Bonds, 1948 Construction Fund (Storm Sewer Improvements). SECTION 3. The necessity for providing adequate drainage in the areas of Port Avenue and Agnes Street within the City of Carpus Christi creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force end effect from and after its passage, IT IS ACCORDIPIGLY SO ORDAINED. ( , 1949 TO THS MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen, For the reasons set forth in the emergency clause of the fore- going ordinance, a publio emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinanoe finally on the date it is introduced, or at the present meeting of the City Council.
