HomeMy WebLinkAbout02629 ORD - 11/01/1949AN ORDINANCE TRANSFERRING THE TAXICAB FRANCBISS NOW HELD BY FELIX SERNA AND PEDRO RODRIGUEZ, D /B /A LEOPARD CAB COMPANY TO MARCUS DE LA GARZA; AND DECLARING AN EMERGENCY. i'FEFELS, the City Council of the City of Corpus Christi, Taxes, did on the 27th day of May, 1947, pass and approve an ordinance granting a 'fro hise to Marcus de le Garza, d/h /a Leopard Cab Company, said Ordinance being numbered 2088 and of record in Volume 15, Page 449 of the Ordinance and Resolution Records of the City of Corpus Christi, Texas; and, 4EUTaS, Felix Serna and Pedro Rodriguez purchased the franchise of Marcus de la Garza, d/b /a leopard Cab Company, including the five (5) permits granted by the City of Corpus Christi, Texas, and such sale was ap- proved by the City Council of the City of Corpus Christi by action of the City Council designated as Ordinance No. 2246; and, =IREAS, Felix Serna and Pedro Rodriguez have now by written assign- ment retransferred and reassigned said franchise to td7m said Marcus de la Garza by an assignment dated October 20, 1949, and desire the approval of the City Council of such transfer and assignment; SECTION 1. That the taxicab franchise and all rights and privileges incident thereto which was issued to Marcus de la Garza, d/b /a Leopard Cab Company and transferred to Felix Serna and Pedro Rodrigues, be and the same is hereby retrana£erred to Marcus de la Garza, and said transfer is hereby approved. SECTION 2. That the said Marcus de is Garza shall be bound by all the terms, covenants and obligations of the original franchise issued to Marcus de la Garza, and the said Marcus de Is Garza shall acknowledge by letter accept- ance of the terms of this transfer of franchise. SECTION j. The fact that Marcus de la Garza cannot legally operate cabs under aforesaid franchise without approval of the City Council creates a public emergency and public imperative necessity requiring the suspension of the Charter rule thatno ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at M three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that Vl� W ZCe L� l such Charter rule be suspended, and that this ordinance be passed finally on the date Of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDA NbD.
