HomeMy WebLinkAbout02630 ORD - 11/01/1949LN AN ORDINANCE AUTHORIZING AND DIRECTIT.IG THE CITY laVILGEP., FOR XM ON BEHALF OF THE CITY, TO PROCURE FAR THE CITY A UTILITY WEI-= ON AND ALONG THE NORTH SIDE OF LOTS 12 AND 15, BLOCK 5, CARVER ADDITION TO THE CITY OF CORPUS C.viISTI FOR A SM NOT EXCEEDING $125.00; AUTHORIZING AND DIRECTING THE CITY WANAGER TO EXECUTE THE NECESSARY CONTRACTS AND INSTEMOOTS TO CCM- PLETE THE PURCHASE OF THE SAID UTILITY EASE - MENT, AND PROVIDING PAMENT THEREFOR FROM FuB NO. 295 WROVETWT BONDS, 1948 CONSTRUCTION FUND (SANITARY SEMR INPROVM—INTS); AND DECLAR- ING AN "fRRGENCY. BE IT ORDAIPED By 'f_�P CITY COUITCIL OF THE CITY OF CORPUS CL ISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized and directed, for and on behalf of the City to procure and pay for the following described utility easement on and across that certain tract of land described as follows: Beginning at the Northwest corner of Lot 15, Block 5, Carver Addition to the City of Corpus Christi, Nueces County, Texas, thence in an easterly direction along the boundary line between Lots 15 and 16, and con- tinuing eastward along the boundary line between Lots 11 and 12, all in Block 5 o the said Carver Addition to the Northeast corner of Lot 12; thence along the property line m the westem side of Rabbit Run Road, a distance of 10 Pest for a point of the Southeast corner of this oaaement; thence in a westerly direction parallel to the northern boundary of said Lots 12 and 15, and 10 feet from said northern boundary line to the property line of Elgin Street on the western boundary of said Lot 15; thence 10 feet to the Northwest comer of said Lot 15 to the place of beginning, all of said land to be used for utility easement for the laying of lines and pipes and the maintaining of such lines and pipes for all public utilities. SECTION 2. That the City Ya ager is hereby authorized and directed to execute the necessary contracts for the purchase of said land described in Section 1 hereof and to do all things incident to or requisite to obtaining the rights and uses of said land for utility easement purposes. SECTION j. That the expenditure for the obtaining of said easement in the total amount of not exceeding One Hundred Twenty Five Dollars ($125.00) is to be paid from Fund No. 295 Improvement Bonds, 1944 Construction Fund (Sanitary Sewer Improvementa). SECTION 4. The necessity= for acquiring of easements for the com- pletion and construction of the sanitary sewer lines now in the process of construction is required immediately creates a public emergency and public a� imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is intro- duced and that such ordinance or resolution shall be read at tree several =etinz_s of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and Navin; requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect frog: and after its passage, IT IS ACCOiDIIG1Y SO CIDAIaED.
