AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR
AND ON BEHALF OF THE CITY, TO PURCHASE 4.127 .ACHES,
OFF TIM SOUTHWEST PORTION OF 14.22 ACRES OUT OF
LOT 4, SECTION B PAISLEYS SUBDIVISION OF THE HOFF-
MAN TRACT, NUECES COUNTY, TEXAS, FROM HERBERT J.
JONES, FOR THE SUM OF $5,158.75 CASH, AND TITLE
EXPENSE; AUTHORIZING AND DIRECTING THE SAID.CITY
MANAGER TO EUMM THE NECESSARY CONTRACTS AND
INSTRUIENTS TO COMPLETE THE PURCHASE OF THE AFcRE-
SAID LAND; PROVIDING THAT PAYMENT FOR THE PDRCBASE
OF THE SANK SHALL BE PAID FROM NO. 295 IMPROVENENT
BONDS, 1948 CONSTRUCTION FUND (STORM SEWER INPBOVE-
VENTS); AND DECLARING AS EINRG8NCY.
BE IT CRDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized and directed,
for and on behalf of the City, to purchase 4.127 aorea of land described as
follows, to -site
A tract of land containing 4.127 acres of land
being the Southwest portion of that certain 14.22 acre
tract of land conveyed to Thus Construction CMW62W
by Warranty Deed from Kathryn Heaney Heymann and Hus-
band, H. E. Heymann dated April 25, 1949, and reoorded
in Volume 10 page 12 of the Deed Records of Hueoea
County, Texas, and conveyed by Warranty Deed from
Thomas Construction Company to Herbert J. Jones dated
April 26, 19149, and recorded in the Deed Records of
Nueoes County, Texas, in Volume 426 Page 15. The
tract herein conveyed is out of, and a part of Lot 4,
Suction,B Paisleys Subdivision of the Hoffman Tract
as shown by map or plat of same recorded in the Map
Records of Nueoes County, Texas, in Volume A page 28
and also a part of what is known as the Urish Lott
portion of the George May Tract, all of said land being
in Nusoes County Texas. The tract herein conveyed is
more partioularly described by matey and bounds as
follewss
Beginning at an iron spike in the oenterline of
what is known as Kostoryz Road at the west corner of
the northeast one -half of Lot 4, Section B Paisleys
Subdivision of the Hoffman Tract for the west oorner
of this tract; _
Thence northeasterly along the oeaterline of
Koateryz Road also being the northwest boundary of
said Lot 4, Section B Paisleys Subdivision of the
Hoffman Tract, N 280- 20'-48" K 194.56 feet to a point,
for the north corner of this tract;
Thence 8 44e- 58' -36" E 196.73 feet to a point
138 feet distant from the northeast boundary of Newton
Street for an interior corner of this tract.
Thence southeasterly along a line parallel with
and 138 feet distant from the northeast boundary of
Newtan Street, S 610- 41' -05" E 1131.41 feet to a point
for the east corner of this-tract, said point being in
the southeast boundary of the 14.22 acre tract afore-
mentioned;

Theme southwesterly along and with the southeast
boundary of said 14.22 sore tract, s 280- 18-55" W
T.00 feet to an iron pipe, the south corner of said
22 acre tract in the northeast boundary of Newton
Street for the south corner of this tract,
Thence northwesterly along the southeaat boundary
of said 14.22 acre tract also being the northeast
boundary of Newton street, N 610- 41-05" W 1319-95
feet to the place of beginning and containing 4.215
acres of lend.
Save and except a strip of land Twenty (20) feet
in width along the northwest boundary of the above
described tract heretofore conveyed by Warranty Deed
from J. N. Laughlin to W. B. Hopkins, County Judge of
Nueces County, Texas, dated November 23, 1900, and re-
corded in the Deed Records of Nueoss County, Texas,
in Volume 6 page 619. The area of this excepted tract
is 0.088 acres, leaving 4.1Z7 acres in the tract of
land herein conveyed.
all of said lands to be used for drainage ditch and/or roadways now under
construction, and other municipal purposes.
SECTION 2. That the City Manager is hereby authorised and directed
to execute the necessary contracts for the purchase of said lands described
in Section 1 hereof and to do all things incident to or requisite to obtain-
ing the title and possession of said lands.
SECTION 3. That the purchase price of the property described herein
of Five Thousand One Hundred Fifty -eight Dollars and Seventy -five Cents
($5,158.75), and such additional sums as may be incurred as title expense
incident to the acquisition of said lend are to be paid from No. 295 Improve-
ment Bonds 19IA Construction Fund (storm sewer Improvements).
MOTION Ly. The necessity for acquiring land at the looation of
said land herein described and the fact that the said land is required im-
mediately for the use of the drainage project mWor roadways oreates a
public emergency and public imperative necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally on the
date it is introduced and that such ordinance or resolution shall be read at
three several meetings of the City Council, and the Mayor having declared that
such public emergency and imperative necessity exist, and having requested that
such Charter rule be suspended, and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY So ORDAINED. -

Gentlemen.
For the reasons set forth in the emergency clause of the fore-
going ordimnoe, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

of Corpus Christi to the credit of Fund Noe 295 IMPROVEMENT BONDS, 1948

and such money is not appropriated for any other purpose°
