HomeMy WebLinkAbout02637 ORD - 11/15/1949Y n AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY, To PURCHASE 0.595 ACRES OF LAND BEING THE NORTH FIFTY FEET OF BLOCK 1317 PORT ARANSAS CLIFFS ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEAS, FRGS W. G. BAUEBFiIIND, FOR THE SUM OF $892.50 CASH, AND TITLE Eder NSE; AUTHORIZING AND DIRECT- ING THE SAID CITY MANAGER TO E%ECUTE THE NECESSARY CON- TRACTS AND INSTRUMENTS TO COMPLETE THE PURCHASE OF THE AFORESAID LAND; PROVIDING THAT PAY604T FOR THE PURCHASE OF THE SAME SHALL BE PAID FROM NO. 295 IMPROVAAENT BONS, 1948 CONSTRUCTION FUND (STORM SDM IMPROVRM$NTS); AND DECLARING AN EMEROWY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized and directed, for and on behalf of the City, to purchase 0.595 acres of land described as follows, to -wits A tract of land 80 feet in width and 323.4 feet in length and being the north 50 feet of Block 1317 Port Aransas Cliffs Addition to the City of Corpus Christi as shown by map or plat of record in Volume A page 27 of the Map Records of Nueces County, Texas, said tract of land being more particularly described by mates and bounds as follows: Beginning at a point in the southwest boundary line of Alameda Street (Central Boulevard), said point bears N 310 061 W 780 feet from the intersection of the southwesterly extension of the center line of Doddridge Street and the southwest boundary line of Alameda Street (Central Boule- vard); Thence S 580 - 54+ W a distance of 1245 feet to a point for the southeast corner and beginning point of the tract hereby conveyed, said point being in the centerline of Pueblo Street as shown on the aforementioned plat of Port Aransas Cliffs; Thence N 310 _ o6+ W with said centerline of Pueblo Street, a distance of 80 feet to a point in the centerline of Proctor Street as shown by the aforementioned plat of Port Aransas Cliffs, for the northeast corner of the tract hereby conveyed; Thence in a southwesterly direction with the line of a fence as now exists on the ground a distance of 323.4 feet to a point that is 1.5 feet northwest of the centerline of said Proctor Street and 3.4 feet southwest of the centerline of Trinidad Street as shown on said plat of Port Aransas Cliffs for the northwest corner of the tract hereby conveyed; Thence in a southeasterly direction along a fence line that now exists on the ground a distance of 81.5 feet to a point for the southwest corner of the tract hereby conveyed; �� 3'1 r Thence N 580 - 54, E parallel to and 80 feet southeast of the centerline of Proctor Street a distance of 323.4 feet to the place of beginning. Containing 0.595 acres of land more or less. all of said lands to be used for drainage purposes now under construction, and other municipal purposes. SECTION 2. That the City Manager is hereby authorized and directed to execute the necessary contracts for the purchase of said lands described in Section 1 hereof and to do all things incident to or requisite to obtain- ing the title and possession of said lands. SECTION 3. That the purchase price of the property described herein of Eight Hundred and Ninety -Two Dollars and Fifty Cants ($892.50), and such additional some as may be incurred as title expense incident to the acquisi- tion of said land are to be paid from No. 295 Improvement Bonds 1948 Construe- tion Fund (Storm Sewer Improvements). - SECTION 4. The necessity for acquiring land at the location of said land herein described and the fact that the said land is required im- mediately for the use of the drainage project creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and affect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. For the reasons set forth in the emergency olause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council, I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
