HomeMy WebLinkAbout02638 ORD - 11/15/1949AN ORDINANCE PROVIDING FOR THE PU$LICATION IN THE CORPUS CHRISTI TIMES, THE OFFICIAL NEWSPAPER OF THE CITY OF CORPUS CHRISTI, ONCE A WEEK FOR THREE CONSECUTIVE WEEKS OF AN ORDINANCE PROPOSED TO BE PASSED BY THE CITY COUN- CIL OF THE CITY OF CORPUS CHRISTI, TEXAS, EXTENDING AN ORDINANCE AND FRANCHISE FINALLY PASSED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI AND AP- PROVED BY THE MAYOR ON THE 18TH DAY OF JULY, A. D., 1935, AND AMENDED BY ORDINANCE FINALLY PASSED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI AND APPROVED BY THE MAYOR ON THE 17TH DAY OF OCTOBER, A. D., 1939, GRANTING TO CENTRAL POWER AND LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC LIGHT, HEAT AND POWER FRANCHISE, AND AMENDING SAID ORDINANCE AND FRANCHISE TO CHANGE TPA CONSIDERA- TION AND COMPENSATION TO BE PAID TO THE CITY BY THE GRANTEE THEREUNDER, ALL AS DESCRIBED IN SAID ORDI- NANCE, AND DECLARING AN EMERGENCY. WHEREAS, on November 14, 1949, Central Power and Light Company filed an application for an extension of the ordinance and franchise finally passed by the City Council of the City of Corpus Christi and approved by the Mayor on the 18th day of July, A. D., 1935, and amended by ordinance finally passed by the City Council of the City of Corpus Christi and approved by the Mayor on the 17th day of October, A. D., 1939, granting to Central Power and Light Company, its successors and assigns, an elec- tric light, heat and power franchise, and for amendment of said ordinance and franchise to change the consideration and compensation to be paid to the City by the Grantee thereunder; and WHEREAS, under Sections 17 and 18, Article II of the City Charter of the City of Corpus Christi, Texas, it is re- quired that when an application is made to the City Council for any grant or franchise or when an ordinance is introduced proposing to make any grant or franchise, such ordinance as proposed to be passed shall be published in the official news- paper once a week for three consecutive weeks,setting forth in detail all the rights, powers and privileges granted or pro- posed to be granted; and WHEREAS, it appears that the proposed ordinance grant- ing an extension and amendment of the Central Power and Light Company franchise should be published in the official newspaper as required by the Charter of rtdh e City of Corpus Christi; AL 30 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. Section 1. That all recitations and statements set out in the preamble of this ordinance are found to be true and cor- rect. Section 2. The requirement of the City Charter that when an application for a franchise is made to the City Council, the ordinance proposed to be passed shall be published, and the cir- cumstances that the franchise extension and amendment, if ad- opted, will make it feasible for the holder of the franchise to finance and make improvements and extensions in its system and If cilities that are needed and will be beneficial to the City and its inhabitants, that by such extension and amendment the City will receive and realize additional revenues and other savings and advantages, the need of which by the City is imme- diate and imperative and which will begin only upon final pass- age of said ordinance, create A public emergency and imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the day that it is introduced, but shall be considered and voted upon at three regular meetings of the City Council, and the Mayor hav- ing declared that such public emergency and imperative necessity exist and having requested that such Charter rule or require- ment be suspended and that this ordinance be passed finally up- on the dsy of its introduction or at the present meeting of the City Council, IT IS ACCORDINGLY So ORDAINED.
