That the City Manager 'of the City of Corpus Christi, Texas, is hereby authorized and directed to execute, for and on behalf of the City, a contract with Lindale, Inc., a private corporation, for the construction of water lines in Lindale Park 2 -A in the City of Corpus Christi, a copy of said contract being attached hereto and made a part of this Ordinance for all pertinent purposes. i STATE CF MA,S p con" OF suwm 4 - WHEREAS, LLndale, lac., a private corporation, authorised to do business in the State of Texas, is the owner and developer of Lin, dale Park, Section 2-1 Subdivision in the City of Corpus Christi, Texas, and is desirous of supplying rater to said Subdivision. NOW, TAERBFMFs this agra®ent made and entered into this day of A. D. 1949, by and between the City of Corpus Christi, Texas, a municipal corporation, acting by and through its duly authorized agent, hereinafter called 'City', and Lindale, Inc., a private corporation, with its principal place of business in Corpus Christi, Texas, hereinafter teroed "Developer". Developer has this day paid to the City the Sum of Ten Thousand ose Hundred and Thirty -Two Dollar's and Fifty-seven Cents (81%:L32,57), Said ova is to be applied as payment for the pipe and fittings described in Paragraph 1 of this contract. However, it is understood and agreed when the water lines are completed, adjustments will be made between the parties hereto, and in the eveat.Developer obtains more pipe and fittings fr. the City than set out in this Contract, Developer agrees to pay for same at Gity Warehouse prices if the price is not specified herein. In the event the Developer uses less material than set out in paragraph 1 of this Contract, the City agrees tO,make an adjustmamt and refund Developer for material not used at specified prices herein. 3. It is further agreed and uodarstood that upon completion of this work all water lines Placed in said subdivision are to become the pro- perty of said City. And it is understood and agreed that the`Developer, con- voys by -the emecution of tbis instrument all rigbt, title, interest and claim it may have in and to any and all water lines installed is accordance with this agreement, including the easement on mad across the lands where located. The necessity for providing adequate water facilities for new additions to the City creates a public emergency and public imperative necessity requiring the suspension of the Charter role that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public energency and imperative necessity exist, and having re- quested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, PASSED ADD APPROVED this 2}1 day of dpx, A.
