CITY, TO PURCHASE .52 ACRES OF LAND BEING PART OF LOT 12, PAISLEY'S SUBDIVISION, OF THE. HOFFMAN TRACT.. NOE0ES COUNTY, TEXAS, nom ROBERT BALL•RD AND WIFE, SYLVIA BALLARD, FOR THE SUM OF $750.00 CASH, AND TITLE EXPENSE; AUTHORIZING AND DIRECTING THE SAID CITY MANAGER TO EXECUTE TEE NEC- ESSARY CONTRACTS AND INSTRUMENTS TO COMPLETE THE PUR- CHASE OF THE AFORESAID LAND; PROVIDING THAT PAYMENT FOR THE PURCHASE OF THE SAME SHALL BE PAID FROM N0. 295 IMPROVEMENT BONDS, 1948 CONSTRUCTION FUND (STORM SEVER IMPROVEMENTS); AND DECLARING AN EMERGENCY. BE IT ORDAINED HY TEE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorised and directed, for and on behalf of the city, to purobase .52 acres of land described as follows, to -wit: Being a strip of land 20 feet in width and 1140 feet in length off of the north aide of a 10.75 sore tract conveyed to Robert Ballard and wife, SylviaBallard by Verna Everhart Livingston and husband, Price Livingston, by deed dated June 20, 1945 and recorded in Volume 312, pages 217 -219 of the Deed Records of Nueoes County, Texas, said strip of land being more particularly desoribed as follows, to-wits Beginning at a point in the east boundary line of aaid Lot 12, Section A for the northeast oorner of the trot herein described, being the intersection of the east boundary line of said Lot 12, Seotion A and the south boundary line of a forty (40) foot Publio Road as shown by nap of reoord in Map Beak A, page 28 of the Map records of Nueoes County, Texas. Said point bears 8 280 - 10' - 40° W20 feet from the common corner of Lot. 5,6,11 and 12., Section A, Paisleys Subdivision of the Hoffman Tract; Thence 8 28° - 10' - 40° Width the east boundary line of said Lot 12, Section A a distance of 2) feet to a point for the southeast corner of the tract herein described; Thence N 61° - 140' W parallel to and 20 feet south of the south boundary line of said 40 foot Public Road a distance of 1140 feet to a point in the east line of a tract of land con- veyed to Houston Natural GasCorporation by Robert Ballard and wife, Sylvia Ballard by deed dated NOY 19. 1949 for the south.- west corner of the tract herein described; Thence N 28° - 10' - 40° E with the east Boundary line of said Houston Natural Gas Corporation Traot a distance of 2) feet to a point in the south boundary line of said 40 foot Public Road for the northwest corner of the tract herein dasoribedj Thou** 8 61° - 40' E with the south boundary line of said 40 foot Publio Road adiatanoe of 1140 feet to the place of beginning. Containing 0.52 sores of land more or leas. all of said lands to be used for drainage ditch project now under oonatruo- tion and other municipal purposes. SECTION 2. That the City Manager is hereby authorised and directed to execute the necessary contracts for the purchase of said lands described in Section 1 hereof and to do all things incident to or requisite to ob- taining the title and possession of said lands. SECTION 3. That the purohase price of the property described herein of Seven Hundred and Fifty Dollars (*750.00), and such additional sumo as may be incurred as title expense inoident to the acquisition of said land are to be paid from No. 295, Improvement Bonds, 1948 Construction Fiend (Storm Sewer Improvements). SECTION 17. The necessity for acquiring land at the location of said ]and herein described and the fact that the said land is required immediately for the use of the drainage project creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or reaolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally an the date of its introduction and take effect sad be in full force and effect from and after its paaeage, IT IS ACCORDINGLY SO ORDAINED.
