OF TBE POLICE DEPABTIMT, APPROPRIAT-
ING A LIKE AMOUNT FROM THE CITY FUNDS;
PROVIDING FOR THE ADIQHISTRATION OF
SAID NEW FUND; AND DECLARING AN EM-
ERGENCY.
WHEREAS. it is under consideration by the City Council of the
City of Corpus Christi to elect to have the City employees, and particular-
ly the employees of the Police Department. participate in the Texas Munioi-
pal Retirement System; and,
]EIREAS, it will be necessary that payments be made each month
as the City's contribution to the Trustees of said System; and.
WHEREAS, the Police Department of the City of Corpus Christi
has elected to participate in said Texas Mumi.cipal Retirement System and has
on hand a fund known as the Policemen's Retirement Fund of the Police Do-
partment Of the City of Corpus Christi and desires to make said fund avail-
able to the City of Corpus Christi for the payment of the obligations of
the City to said Texas Municipal Retirement System;
NOW, TBEREFORE, BE IT ORDAIBED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TESASe
SECTION le That. on behalf of the City of Corpus Christi.
Texas, the City Council hereby accepts a remittance from the Policemen's
Retirement Fund of the Polio* Department of the City of Corpus Christi, Taxes#
in the amount of *11,478.63, which am shall be placed in a fund to be known
as tbeePolioemen'e Retirement Reserve Fund" which food shall be kept separate
from other funds and shall be expended subject to the provisions hereinafter
contained.
SECTION 2. There is hereby appropriated the sum of Eleven Thous-
and Four Hftmdred Soventy�Eight and 85AOO Dollars (tll,476.65), which ava in-
cludes the amount of 110,750.00 included in the budget under Code Es Polio*
Division, from the General Fund of the City of Corpus Christi. and after the
receipt of the remittances of said fund mentioned in Section 1 from the
Policemen's Retirement Fund said $11.478.85 shall be transferred to the
Policemen's Retirement Reserve Fund subject to the provisions hereinafter
sot forth.
SECTION 3e The Policemen's Retirement Reserve Fund shall be
kept in a separate fund and used for the following purpeso*e

a. To make each and every psymeat and contribution payable
to or due to be paid to the Texes Municipal Retirement System u the
City of Corpus Christi may become obligated to pay by reason of its
participation in such system as to the Police Department and the em-
ployees thereof.
b. In the event said Policemen's Retirement Reserve Fund
shall amount in excess of the estimated amount necessary to defray the
entire obligation of the City to the Texas Municipal Retirement System
for the twelve month period beginning October 1, 1949, then such excess
amount may be used for the purpose of payment of salary of one or more
members of the Police force in excess of the number of policemen pro-
vided for in the annual Budget adopted August 1, 1949.
c. A complete statement of the expenditures made from said
Policsmon's Retirement Reserve Fund shall be prepared and one copy of
the same shall be furnished the Chief of the Police Department at the
time of the exhaustion of the said Policaments Retirement Reserve Fand.
d. The Director of Finance of the City of Corpus Christi is
hereby directed to make remittances cut of said fund to the Board of
Trustees of the Texas Municipal Retirement System, at its office in Austin,
Texas, of each and all of the City's contribution to the system at the
times required by said system.
SECTION 4. The fact that municipal employees are not covered
by Federal Social Security and that it will be in the public interest
for the City to have its employees participate in the Texas Municipal He-
tirement System at as early a,Idate as possible and that there is now on
hand a fund from the Police Department which will enable the Police Depart -
meat to commenoe participation immediately creates a public emergency and
public imperative necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on thedate it is
introduced and that such ordinance or resolution shall be read at three
several meetings of the city Council, and the Mayor having declared that
such public emergency and imperative necessity exist, and having requested
that such Charter rule be suspended, and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons act forth in the emergency clause of the fore-
going ordinance, a public emergency and - imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Cotmcil.
