LAND ABUTTING ON THE PRESENT COMANCHE STREET. BEING A. STRIP SEVEN (7) FEET IN DEPTH AND FRONTING FORTY (40) FEET ON COMANCHE STREET, FROM MARM R. AND MOSES R. VILLAPONDO; AND A STRIP OF LAM SEVEN (7) FEET IN DEPTH AND FRONTING FORTY (40) FEET ON COMANCBE STREET, FROM MANUEL GARZA AND WIFE. SARAH V. GARZA, FOR THE SUM OF TWO HUNDRED SIUY_ DOLLARS ( =260_) CASH; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EAECUTE THE NECESSARY CONTRACTS AND INSTRUMENTS TO COMPLETE THE PURCHASE OF AFORESAID LAND AND TO OBTAIN THE FEE SIMPLE TITLE THERETO ;. PROVIDING THE PAYMENT FOR THE PURCHASE OF SAME TO BE PAID FROM FOND NO. 220 STREET IMPROVD0NT CON - STRUCTION; AND DECLARING AN EMERGENCY. TEXAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI. SECTION I. That the City Manager is hereby authorized and directed ta_pureligaePeraddon behalf of the City of Corpus Christi, the following described tract of land from Maria R. and Moses R. Villaponds, to -wit: Being a strip of lend 40.00 feet in length and 7 feet in width and lying along the north side of Comanche Street, being a part of the Prieur original 115 core Tract out of the E. Villareal Grant. Said strip of land being more particularly described as follows, to -:it: BEGINNING At the southwest corner of the tract herein conveyed, said corner bears N 70 deg. 211 28" E 300.00 feet from the southwest corner of a tract of land conveyed to Mrs. Sallie Bangle, a Widows by Joke J. Runk and wife, Lydia Runk, by dead dated January 3. 1935 and recorded in Volume 211 page 610 of Deed Records of Nueoes County, Texas, said oomer be- ing in the present north boundary line of Comanche Street; THENCE N 0 deg. 10, 28" E a distance of 7.44 fact to a point for the northwest corner of the tract herein conveyed; THENCE N 70 deg. 211 28" E parallel to and 7.00 feet north of the present north boundary of Comshohe Street, a distance of 40.00 feet to a point for the northeast comer of the tract herein conveyed; THENCE S 0 deg. 101 28" W s distance of 7-44 fe'bi to a point in the present north_boiMdary line of Comanche Street for the southeast corner of the tract herein conveyed; THENCE S 70 deg. 211 28" W with the present north boundary of Comanche Street, a distance of 40.00 feet to the place of BEGINNING. Containing 280 square feet more or lasso all of said lands TO- BE_USED for widening, improving and paving C® ohe Street. SECTION 11. That the City Manager is hereby authorized and directed, for and an behalf of the City of Corpus Christi, to purchase the fellow- ing described tract of land from Manuel Garza, and wife, Sarah V. Garza, to-, it; Being a strip of land 10.00 feet in length and 7 feet in width and lying along the north side of Comanche Street, being a part of the Priour original 115 Aore Tract out of the E. Villareal Grant. Said strip of land being more particularly described as follows, to -wit: a��� BEGINNING At the southwest corner of the tract - herein conveyed, said comer bears N 70 deg. 211 28" E 260 feet from the southwest comer of a tract of load conveyed bs Mrs. Sallie Pangle, a Widow, by John J. Runk, and wife, Lydia Runk,by deed dated January 3, 1935 and recorded ip Volume 211 page 610 of the Deed Records of Bascom County, Texas, said corner being in the present north boundary line of Comanche Street; TONCE N 0 deg. 10+ 28" E a distance of,7.114 feet to a point for the northwest corner of the tract herein conveyed; THENCE N 70 deg, 21t 26" 8 parallel to and 7 feet north of the present north boundary line of Comanche Street, a dis- tance of 40.00 feet to a point for the northeast corner of the tract herein conveyed; THENCE S 0 deg. 101 28" W a distance of 7,14 feet to a point in the present north boundary line of Comanche Street for the southeast corner of the tract herein conveyed; THENCE S 70 deg. 21, 28" W with the present north boundary line of Comanche Street a distance of 40.00 feet to the PLACE OF BEGIMTING, Containing 280 square feet more or less3 all of said lands to be used for widening, improving end paving Comanche Street* SECTION III. That the City Manager is hereby authorised and directed to execute the necessary contracts for the purchase of said lands deaoiib- ad in Sections Fend II hereof and to do all things incident to or requisite to obtaining the title and possession of said lands. SECTION IV. That the purchase price of the property described herein as to each tract is the sum of $130, payable to each of the said Maria R. and Moses R. Villapando and the said Manuel Garzd andwifs� Sarah V. Garza, all to be paid from Fiend No. 220 Street Improvement Construction. SECTION V. The necessity for settling the dispute existing between the City and each of the persons named as ownera of the respective strips of lands, concerning the nature of the interest in the land described which the City obtained by easements dated February 19, 19498 and the necessity for settling said claims to the sstiefaetien of all concerned creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is iatroduoed and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and impera- tive necessity exist, and having requested that much Charter rule be suapendedy and that this ordinance be In ssed finally on the date of its introduction and take effect and be in full force and effect from mud after its passage, IT IS ACCORDINGLY SO ORDAINED. Corpus Christi, Texas ,&- . 2 0 , 1949 TO TB8 MMUS OF TES CITY COUNCIL Corpus Christi, Texas Gentleman$ For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally oa the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
