HomeMy WebLinkAbout02669 ORD - 12/27/1949ORDINANCE N0. 2649 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON DECEMBER 21, 1949, ON THE QUESTION OF GRANTING TO CENTRAL P02211 AND LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN EXTENSION AND AMENDMENT OF ITS ELECTRIC FRAN- CHISE, AND DECLARING AN EMERGENCY. WHEREAS, there was held in the City of Corpus Christi, Texas, on the 21st day of December, 1949, an election at which was submitted to the qualified resident electors of said City the following proposition, to -wit: PROPOSITION "Shall the City Council of the City of Corpus Christi be authorized to pass and approve an ordi- nance and do the things requisite to the granting of an extension and amendment of the electric fran- chise of Central Power and Light Company to extend the term thereof until December 1, 1979, and pro- vide for the payment to the City of the sum of $5,000.00 annually, and in addition thereto, an- nually in semi - annual installments, whichever is the greater, either $80,000.00 or 2% of the fran- chise holder's gross receipts during the year from the sale of electric energy in and for use in the City, in the form, upon the conditions stated in, and in accordance with the ordinance proposed to be passed as set out in the ordinance passed and approved by the City Council of the City of Corpus Christi on November 15, A. D., 1949, ordering publication thereof, and in the ordinance passed and approved by the City Council of the City of Corpus Christi on November 29, 1949, ordering this election. "; WHEREAS, there were cast at said election 2917 votes as follows: FOR THE GRANTING OF THE FRANCHISE EXTENSION AND AMENDMENT AGAINST THE GRANTING OF THE FRAN- CHISE EXTENSION AND AMENDMENT MAJORITY FOR THE GRANTING OF THE FRANCHISE EXTENSION AND AMENDMENT 2786 votes 31 votes 2755 votes as shown in the official election returns heretofore submitted to this City Council and filed with the City Secretary; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That said election was duly called and no- ticethereof given in accordance with the law; that said election (r65/ was held in the manner required by law; that due returns of said election have been made by the proper officers; that said election has resulted favorably to the granting of the franchise extension and amendment; and that a ma- jority of the qualified voters Voting at said election have voted in favor of the granting of the franchise extension and amendment. Section 2. That the City Council is now authorized to pass and approve an ordinance and do the things requisite to the granting of said extension and amendment of the elec- tric franchise of Central Power and Light Company. Section 3. That the provision of the City Charter for canvassing the returns and declaring the results of special elections within one week after the election is held, and the circumstances that the franchise extension and amendment will make feasible the financing and making of improvements and extensions in the electric distribution facilities that are needed and that will be beneficial to the City and its inhabitants; that by such extension and amendment the City will receive and realize additional revenues and other sav- ings and advantages for which there is a great and pressing need by the City create an emergency and imperative necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date that it is introduced and that such ordinance or resolution shall be read at three regular meetings of the City Council, and the Mayor having declared that such emergency and imperative necessity exists and having requested in writing that such Charter rule or requirement be suspended and that this ordi- nance be passed finally on the date of its introduction, such rules and provisions are hereby suspended and this ordinance 18 passed and shall take effect as an emergency measure and shall be in full force and effect immediately upon its passage.
