DECLARING AN MMG$NCY. BE IT ORDAINED BY TM CITY COUNCIL OF TII; CITY OF CORPUS CIMISTI, TETJLS: SECTION 1. That Item Ir. of Section 7 of Ordinance No. 1491 adopted the 1st day of September, 19112 and entitled "Defining +ISilk, and Certgin 'lull Products,i lla.lk Producers, : Pasteurizationt, etc., Prohibit- ing the sale of adulterated and mis- branded milk and milk products, requiring permits for the sale of milk and milk products, regulating the inspection of dairy farms and milk plants, the examination, grading, labeling, placording, pasteurization, re- grading, distribution, and sale of milk and milk products, providing for the publishing of milk grades, construction of future dairies and milk plants, the repealing of all ordinances or parts of ordinances in conflict herewith, the enforcement of this ordinance and the fixing of penal- ties; and Declaring an Emergency" be amended so as to hereafter read as follows: "Item Ir. COIS, TUBERCULOSIS, BANGS AM OTBER DISEASES. A tuberculin test . of all herds and addi- tions thereto shall be made before any milk there- from is sold, and at least every 12 months thereafter, by a licensed veterinarian approved by the State Live - Stook Sanitary Commission; PROVIDED, That is modified accredited counties in which modified accredited area plan is applied to the dairy herds,,the modified accredited area system approved by the United States Bureau of Animal Industry shall be accepted in lieu of annual testing. Said test shall be made and reactors disposed of in accordance with the requirements approved by the United States Department of Agriculture, Bureau of Animal Industry, for accredited herds, Additions to all existing herds shall be tested for Bangs Disease as shown by blood serum tests for agglutinins against Brucella Abortus made in a laboratory approved by the health officer. The calfhood vacinnation plan approved by the United States Department of Agriculture, Bureau of ..Animal Industry and the Texas Livestock Sanitary Commission shall be per- -, Vh mitted. Inoculation of producing animals shall not be permitted, All dairies not supplying milk or milk products to the City of Corpus Christi on the effective date of this ordinance, and who shall apply for a permit after this ordinance becomes effective shall meet the above requirements regard- ing Bangs and Tuberculosis testing but must be free of both diseases before a permit is issued. No animals which react to either disease shall be added to any herd. True copies of the results of these tests, both 12 month test and all subsequent tests when reactors are found, signed by a veterinerain and laboratory technician and :_identifying each animal by number, shall be sulmitted 'to the Health Officer for his.records......." SECTION 2. The importance of conformity to state regulations regarding testing requirements for dairy herds creates a ,public emergency and imperative public necessity raquiring ".the -- suspension of the Charter rule pro- viding that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three meetings of the City Council, andthe iiayor having declared that such public emergency and imperative necessity exists, and requests that said Charter rule be suspended, and that this Ordinance take effect and be in force and effect from and after its massage, and it is accordingly so ordained.
