OF HIGHWAY No. 9 ON THAT CERTAIN 0.030 ACRES OF LAND OUT OF THE EAST ONE -HALF OF LOT NO. 9. TRACT "C" OF THE BAN - CROFT FARM. LOPS FROM MRS. J. J.. UEIMINGER, A WIDOW, OF_ JEFFERSON COUNTY, TEXAS, _ AND WITOID B. CARTER OF NUECES COUNTY, TEXAS, FOR THE SUM OF THESE HUNDRED DOLLARS ($300) CA8Hj.AUTHORIZING AND..DIRECTING THE CITY MINAGER TO IISECUTE THE NECESSARY INSTRIMTTS IN CONNECTION HEREWITH; PROVIDING THAT TEE CONSIDERATION IN SAID RIG'IPT -OF -WAY EASE TT SHALL _BE PAID FRGS 110. 295 11TROVEMENT BONDS 1948. COITSTRUCTION FUND (STREET IMFaOV=, US); AND DECLARING AN =RGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF CORPUS CHRISTI, T:S: SECTION 1, That the City Manager is hereby authorized and direct- ed for and on behalf of the City to acquire a right- of-way easement far the widening of Highway No. 9 on that certain 0,030 acres of land, more pertiou- larly described as follows, to -wits BEGINNING At a point on the south right -of- way line of State Hwy, No. 9, said Doint being the northeast corner of the east 1/2 Of Lot No. 9, Tract C, of the Bancroft Farm Lots; THENCE -S 29 deg. 461 W along the East line of said Lot 9, a distance of,22,30 feet to a point; THENCE N 53 deg• 01 W a distance of 61.69 feet to a point in the south right of way line of State Highway No. 9; THENCE S 89 deg. 40+ E along the south right - of-way line a distance Of 70-27 feet to the POINT OF BEG110ING; Said parcel of land contains 0.030 Acres, more or less all of said land belonging to Mrs. J. J. Uehlinger and Witold B. -Carter. SECTION 2. That the City Manager is hereby authorized and directed to acquire said land and to execute the necessary instruments incident to said acquisition of the parcel of land described in Section 1 hereof and from the owners thereof. SECTION 3, That the purchase price of the property described here- in of Three Hundred Dollars 0300) is to be paid from No. 295 Improvement Bonds 1948 Construction Fund (Street Improvements). SECTION 4. The fact that the State Highway Dapartment is cooperat- ing with the City in the establishment, construction and widening of said Highway No. 9 at the location of the property hereby authorised to be acquired and is ready to proceed with the construction work immediately on and adjacent to said property creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shell be passed finally oa the date it is introduced and that such ordin- ance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and im- perative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and teke effect and be in fill force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. D. 1949. ,ST. 1 City of Corpus Christi, Texas City Secretary APPR VED A3 TO 'AL OR4[' i A rosy Corpus Christi, Texas ,4�, a 7 1949 TO THS XWEBS OF THS CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
