HomeMy WebLinkAbout02676 ORD - 12/20/1949i ' a AN ORDINANCE TRANSIFERRING THE TAXICAB FRANCHISE NOW HELD BY MARCUS DE IA GARZA D /B /A LEOPARD CAB COMPANY TO THE CORPUS CHRISTI TRANS- PORTATION COMPANY; AND DECLARING AN EMER- GENCY. WHEREAS, the City Council of the City of Corpus Christi, Texas, did on the 27th day of May, 1947, pass and approve an ordinance granting a franchise to Marcus de h Garza d /b /a/ Leopard Cab Company, said ordinance being numbered 2088 and of record in Volume 15, Page 449 of the Ordinance and Resolution Records of the City of Corpus Christi, Texas; and, WHEREAS, Felix Berns. and Pedro Rodriquez purchased the franchise of Marcus de Is Garza d/b /a Leopard Cab Company, including the five (5) permits granted by the City of Corpus Christi, Texas, and such sale was approved by the City Council of the City of Corpus Christi by action of the City Council designated as Ordinance _ No. 2246; and, AHERBAS, Marcus de Is Garza repurchased the franchises transferred to Felix Serna and Pedro Rodriguez d/b /a Leopard Cab Company including the five (5) premits granted by the City of Corpus "bristi, Texas, and such sale and transfer was approved by the City Council of the City of Corpus Christi, Texas, by action of the City Council; and, 'NHEREAS, Marcus de It Garza has now by written assignment transferred and assigned said franchise to the Corpus Christi Transportation Company by an assign- ment dated December 13th, 1949, and desire the approval of the City Council of such transfer and assignment. SECTION 1. That the taxicab franchise and all rights and privileges incident thereto which was issued to Marcus de Is Garza, d/b /a Leopard Cab Company and trans- ferred to Felix Serna and Pedro Rodriguez and back again to Marcus de la Garza, be the same is hereby transferred to the Corpus Christi Transportation Company, and said transfer is hereby approved. SECTION 2. That the said Corpus Christi Transportation Company shall be bound by all the terms, covenants and obligations of the original franchise issued to Marcus de la Garza, and the said Corpus Christi Transportation Company shall acknowledge by letter acceptance of the terms of this transfer of franchise, and that said franchise shall be returned after this transfer to the City Secretary for cancellation. 2�� � SEDTION 3. The fact that the Corpus Christi Transportation Com- pany cannot legally operate cabs under aforesaid franchise without approval of the City Council creates a public emergency and public inperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date is is introduced and that such ordinance or resolution shall be read at three several meeting of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that si:�.ch Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and tade effect and be full force .nd effedt from and after its passage, IT IS ACCORDITTCLY SO ORDA1 °F =_,:D. For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council. Lowman I� Corpus Christi, Texas December 12, 1949 TM: The City Council of the City of Corpus Christi, Texas FROM: Marcus De La Garza d /ba Leopard Cab Company Gentlemen: On the 28th day of October p.D.1949, the City Council of.Corpue Christi, Texas, approved transferring the taxi- cab franchises issued to Felix Serna and Pedro Rodriguez to Marcus De La Garza. The ordinance was duly published and provisions thereof were accepted in writing by Marcus De La Garza. Section 17 of the said ordinance provides that the said franchise, and the permits held by the grantee in connect - tion with said franhise, may be sold, transferred and inherited; provided, however, that any sale or transfer shall be first presented in writing to the City Council for its approval or disapproval and the City Council may disapprove such proposed sale of transfer if it be found that such proposed sale or transferee is not capable of continuing the operation under such franchise in such a manner as to render the services dec:anded in the best interest of the public; the City Council in anprovinS or disapproving any such sale or transfer of this franchise, and the peemits owned in connection therewith, may take into consideration all of the requirements and qualifications of a regular a-,Dplication, and apply same as necessary qualifications of any proposed purchaser or transferee. The grantee, Marcus De La Garza, propose to sell and transfer this franchises and permits to the Corpus Christi Transporation Company, and hereby request approval by the City Council of the proposed sale and transfer. Marcus De La Garza would show: I. That the proposed sale or transfer is in good faith. II. That the proposed purchaser or transferee is capable of continuing the operation under such franchise in such manner as to render the services demanded in the best interest of the public. M. The byyer has sufficient funds to pay eash for the business and has sufficient property and funds to operate the business in the best interests of the public. He will use only first -class equipment, will keep and maintain his equizppsnt in good condition, and will take out insurance to tprotect the public against damage.
