AN ORDINANCE
APPROPRIATING MONIES TO BE PAID AS
CONSIDERATION FOR CERTAIN IMPROVE-
MENTS OUT OF FUND NO. 258 SEAWALL
AND BREAHMQATER CONSTRUCTION FUND;
AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE FOR AND ON BE-
HALF OF THE CITY A CONTRACT WITH
C. L. CASTOR, CONTRACTOR, OF NOECES
COUNTY, TEXAS, FOR THE CONSTRUCTION
OF IMPROVEMENTS PROPOSED FOR THE
PEOPLES STREET T -HEAD AS STORM PRO-
TECTION IMPROVEMENTS; AND DECLARING
AN EMERGENCY.
FEREAS, The filling on the Peoples Street T -Head of the
City of Corpus Christi is rapidly deteriorating through the affect
of -the elements thereon, especially the rains and winds; and
V9ERMIS, It is imperative that protective measures be
taken immediately to protect the filling of said T -Bead from fur-
ther erosion and deterioration; said T -Head being part of the
seawall and storm protection improvements of the City of Corpus
Christi, Texas; and
iLMRP:AS, It is necessary to appropriate the amount to be
paid in consideration for the construction of such improvements;
and
+fEREAS, Bids having been submitted, considered, and an
award made for the most advantageous bid to the City of Corpus
Christi, it new becomes necessary to enter into a contract for
construction of certain improvements on the aforementioned area;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL ON THE
CITY OF CORPUS CHhISII, T:�AS:
SECTION 1. That there is hereby appropriated out of
Fund Iio. 258 Seawall and Breakwater Construction Fund the sum of
O o.407.73, out of which fund there is to be paid according to
the terms of the contract described in Section 2 hereof the sum
of X9,461.57; the balance of said appropriation is the amount

equivalent to ten per cent of said contract price, which amount
is hereby appropriated for the payment of engineering and contin-
gent costs of said project.
SECTION 2. That the City Manager is hereby author-
ized and directed to execute for and on behalf of the City of
Corpus Christi a contract for the construction of said improve-
ments on the Peoples Street T -Head, as described in contract docu-
ments hereinafter mentioned, with C. I,. Castor of Nueces County,
Texas, which contract has been awarded in accordance vi th plans,
specifications and contract documents on file in the office of
the City Secretary, all of which are made a part hereof by refer -
epos, and according to the bid of said C. L. Castor opened on the
21st day of March& 1950, the said 'bid of C. L. Castor being the
lowest and most advantageous to the City of Corpus Christi, Texas.
SECTION 3. The necessity of maintaining adequate
storm protection improvements and the imperative need to take
measures to protect the filling of said T -Head as a part of such
storm protection improvements from further erosion creates a
public emergency and imperative public necessity requiring the
suspension of that certain Charter rule that no ordinance or
resolution shall be passed finally on the date it is introduced
and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the I0ayor, having de-
clared that such emergency and necessity exist, requesting that
such Charter rule be suspended and that this ordinance be passed
finally on the day it is introduced and take effect and be in
full force and effect from and after its 1,assage, IT IS ACCORD-
INGLY SO ORDAINED.

Gentleman:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
