CITY OF CORPUS CHRISTI, TEXAS
REGULAR COUNCIL MEETING
August 20, 1975

Mayor Pro Tem Tipton called the meeting to order in the Council
Chamber of the City Hall.
The Invocation was given by Reverend Mark Spence, Assistant Minister
of Grace Presbyterian Church.
City Secretary Bill G. Read called the roll of those in attendance.
Motion by Lozano, seconded by de Ases and passed, that the absence
of Mayor Luby be excused for just cause.
Motion by Lozano, seconded by Sample and passed, that the Minutes
of the Special Meeting of August 4, at 2 p.m.; Special Meeting of August 6, at
3:30 p.m.; Regular Meeting of August 6, at 2 p.m.; and of the Regular Meeting of
July 30, at 2 p.m., be approved as submitted to the Council.
Mayor Pro Tem Tipton called for the City Manager's Reports, and City
Manager Townsend presented requests and recommendations with related comments and
explanations as follows:
a. That bids be received at 11:00 a.m., on Tuesday, September 9,
1975 for truck and automotive repair and maintenance items for a 4 -month period
for City Garage, Transit System and Fire Department.
b. That bids be received at 11:00 a.m., Tuesday, September 9, 1975
for new, rebuilt or used 167 KVA transformers for the Stevens Filter Plant as part
of a budgeted project to transfer two pumps now located at the Savage Lane Pump
Station to the Stevens Filter Plant to increase raw water pumping capacity by 20 mgd.
c. That bids be received at 11:00 a.m., Tuesday September 9, 1975
for 35 one-way, three section 8" Tense traffic signals to replace obsolete four-
way signals at variousintersections to increase safety and driver observance of
signals. The intersections to be improved include Ayers and Tarlton, Ayers and
Blevins, Leopard and Nueces Bay Boulevard, Kostoryz and Norton, Alameda and
Louisiana and Old Robstown Road and Agnes.
d. That contracts be awarded to the following firms to furnish
the City's 1975-76 requirements for the items indicated:

Bids were received from various firms which are not recommended even though
they are the apparent low bids for the following reasons: (1) they did not
meet specifications, (2) fluctuating prices were bid and it would be more
economical to take the firm bid by another company, and (3) there was an
error in the bid submitted. Since no bids were received on hand and garden
tools Lots XIII (special ratchet wrenches), XIV (moil points and breaker
chisels) and XIX (Mueller tools), it is recommended that the first two lots be
purchased by competitive bid on the open market as needed and that the third
item which is a special item and hence should not have been bid as an annual
supply contract, be rebid. It is also recommended that the only bid received
on Lot VIII, pipe repair clamps (ductile iron service saddles) of $1,094.12 by
Ford Meter Box Company of Wabash, Indiana, be rejected as not meeting specifi-
cations. This was a new item in annual supply contract and ductile iron saddles
were going to be used in lieu of bronze saddles in some applications because it
was thought they would be less expensive. The bid received, however, shows this
is not the case; and therefore, it is recommended that bronze ones continue to
be used. Bids were received from 88 firms and a price comparison reveals an
increase of approximately .8%. (Bid Tabulation #49-75)

Bids were received from various firms which are not recommended even though
they are the apparent low bids because the bids did not meet various specifi-
cations or because fluctuating prices were bid and would be more economical for
the City to take the firm bid by another company. Bids were received from 34
firms and a price comparison reveals a decrease of approximately 4.4%. (Bid Tab.50-75)
f. That a contract for sale and removal of a two story frame garage apart-
ment (10 apartments) at 1707 and 1707' North Shoreline between Brewster and Hughes
Streets be awarded to H. G. Rivera of Taft on the basis of the only bid received
of $311.00. This property is located south of the auditorium site in the Bayfront
Arts & Science Park.
g. That contracts for the sale and removal of buildings and improve-
ments at 4714 and 4907 Gulfbreeze be awarded to 0. M. Greene of Mathis for $1,420.00
and Olene Minims of Corpus Christi for $550.00 respectively. The first lot is
between Gulden and Sandvar streets with a one-story, one -bedroom frame house.
The second lot is between Woodrow and Bryan streets with a one-story, two-bedroom
frame house. The lots were acquired as part of the Corpus Christi Beach Park.
Bids'were received from three firms.
h. That the plans and specifications for the construction of access
roads and parking lots for Poenisch Park be approved, and bids be received on
Tuesday, September 9, 1975 at 2:00 p.m. The project includes 10 parking spaces
and access roads. Irrigation, landscaping and sodding will be performed by
Park Division crews.
i. That plans and specifications for the construction of the drainage
outfall improvements required for the Waldron Road Street Paving Project be
approved, and bids be received on September 10, 1975. The plans originally
called for these improvements to be included in the street paving plans on which
the State Department of Highways and Public Transportation is to receive bids in
October or November. By separating this work, the total project can be expedited,
the cost of the project will probably be less, and it would provide the possibility
of taking alternate bids for a larger size pipe to drain the property at the corner
of Purdue and Waldron. Bids will be taken for construction of the outfall either

as a box or pipe. The outfall will be along Purdue Road from Waldron to near
Laguna Shores Road.
j. That a modification be submitted to the Department of Labor amending
the City's Title II Comprehensive Employment and Training Act Program to extend
the cost of living increase recently approved by the City Council to Title II
participants. The total amount of program funds remains $946,677 and the program
runs through June 30, 1976. The number of positions will be phased down from 176
to 23 over a nine-month period with these positions being picked up in the Title
VI program.
k. That a modification be submitted to the Department of Labor amending
the City's Title VI Comprehensive Employment and Training Act Program incorporating
an additional $1,043,952 in 1976 funds. This money will extend the City's Title VI
emergency jobs program through June 30, 1976. The modification provides an increase
in positions from 89 to 265 to be interlinked with the Title II program as a gradual
reduction of positions occurs in that program through June 30, 1976. Modification
also extends the cost of living increase recently approved by the City Council to
Title VI participants, continues present subcontracts with other area agencies,
and provides an additional 23 positions in Police (patrolmen), Health (Animal
Control), Street (to repair curbs and sidewalks), Water (to improve maintenance
at the Dam) and Aviation (more mowing and painting).
1. That authority be granted to execute contract modifications and all
related documents on behalf of the City of Corpus Christi acting as program agent
with the following employing agencies for public service employment under Title VI
of the Comprehensive Employment and Training Act of 1973:

The Title VI contract modifications will extend the public service employ-
ment programs from December 31, 1975 through June 30, 1976. The largest increase
in contract funds is with the Corpus Christi Independent School District with twenty
phased -down Title II positions replaced with Title VI positions. The number of
positions in the other contract modification remain the same.

m. That authority be granted for the City of Corpus Christi, as the
Administrative Unit of the Manpower Consortium, to submit a CETA, Title VI Grant
Modification in the amount of $1,592,004 for a new total of $2,402,799 providing
for additional public service employment opportunities to units of local government
within the Consortium. This increased funding will provide for approximately 250
additional jobs.
n. That the contract with the Nueces County Rural Fire Prevention District
#2 (Flour Bluff) be renewed for an additional year. The contract provides that the
City will pay the district $35,000 in return for the district not to levy a tax and
provide fire service including at least 10 volunteer firemen in any serious brush,
grass, or other major fire within the district. The City also provides and
maintains the district's radio equipment. Other provisions of the contract provide
for the purchase of gasoline by the district under the City's contracts with
reimbursement to the City for the cost of the gasoline purchased and for 30 -day
cancellation by either party. The contract also stipulates that the district is
to serve only as a source of support in their district and that the City is the
responsible agency for managing fire defense in both the City and the district.
o. That Tax Adjustments for the period February 1 thru April 30, 1975,
resulting in the following decreases, be approved:

Significant decreases include: $3,593.00 for the Casa De Oro Apart-
ments, owned by the First Assembly of God Church as exempt; $2,427 for Homestead
Exemptions omitted for 49 properties, partially offset by increases of $649 on 11
properties for invalid exemptions; $988 on various leases of E. Flato Estate
because of a clerical error and $379 on personal property of Petty Construction
Company which had no taxable assets on January 1.
p. That the 200, 300 & 400 blocks of Chaparral Street and the 300 and 400
Blocks of Lawrence & Williams Streets be closed to vehicular traffic from 7:30 p.m.
Friday, September 12, 1975, to 12:00 midnight Sunday, September 14, 1975, so that
LULAC Ladies Council No. 26 can sponsor their 5th Annual Fiesta Mexicana de Corpus
Christi. The Central Business District Association has endorsed the Fiesta.
q. That a public hearing be held at 3:30 p.m. during the Regular Council
Meeting on September 10, 1975 on the following zoning application:

(1) Nueces County Hospital District dba Memorial Center -"A-2"
to "B-1", on the north side of Buford Street between 22nd and
23rd Streets.
r. That approximately 1,700 square feet of office space be leased for
two years from the Nueces Trust Company at 311 South Shoreline at 374 per square
foot to provide additional City Hall office space. The City presently leases
514 square feet of office space at 31e per square foot for the Human Relations
staff and will expire September 1, 1975. The additional 1,200 square feet of
office space will meet the need for additional City Hall office space.
s. That authority be granted to submit an amendment for a supplemental
grant to the Governor's Committee on Aging for the Title VII Elderly Nutrition
Program providing for an increase in funding of $48,830. $11,585 of this amount
will be used locally to provide sixty (60) additional meals daily for a period
of five months. The additional $37,245 will be used during the next three months
(September, October and November) for expansion of the nutrition program into
Jim Wells County. These funds will be used to cover start-up costs such as
administration facilities, equipment, staff, etc., in preparation for the meals
program to begin in December, 1975. No City funds are involved in this program.
t. That the 1975-76 Budget for the Nueces County Mental Health and Mental
Retardation Community Center be approved in the amount of $2,805,181, and the
supplemental grants-in-aid in the amount of $115,890 also be approved upon approval
of the Texas Department of Mental Health and Mental Retardation.
Motion by Lozano, seconded by Sample and passed, with de Ases abstaining
on the portion of Item "e" pertaining to the Famous Department Store bid award on
a variety'of uniforms, and Gulley voting "Nay" on Item "p", that the City Manager's
Reports be accepted, and Items "a" through "t" be granted, approved and adopted,
as presented by City Manager Townsend.
City Manager Townsend presented ordinances with related comments and
explanations for the Council's consideration, as follows:
ORDINANCE NO. 12758
AMENDING SUBSECTION 6.32 OF THE LAND DRILLING ORDINANCE, NO. 8879, BY AMENDING
ITEM 4 OF PARAGRAPH F SO AS TO PERMIT RENEWAL OF "IN LIEU OF PLUGGING" BONDS ONLY
FOR THOSE WELLS WHICH HAVE NOT BEEN PLUGGED AND ABANDONED WHERE THE OPERATOR
STILL HOLDS A VALID LEASE ON THE MINERALS UNDERLYING THE SURFACE WHERE SUCH WELL
IS LOCATED, AND TO PROVIDE THE PETROLEUM INSPECTION DIVISION WITH EVIDENCE THAT
HE DOES IN FACT OWN OR CONTROL THE MINERALS UNDERLYING THAT WELL; FURTHER PROVIDING
THAT WHERE THE MINERALS LEASE HAS EXPIRED AND WELLS HAVE NOT BEEN PLUGGED THAT

AUTHORIZING THE CITY MANAGER TO EXECUTE A 5 -YEAR CONCESSION LEASE AGREEMENT WITH
MARGIE BENNETT FOR OPERATION OF A CONCESSION AT THE GREENWOOD SOFTBALL COMPLEX,
ALL AS MORE FULLY SET FORTH IN THE LEASE AGREEMENT, IN SUBSTANTIALLY THE FORM

LADIES COUNCIL#26; PROVIDING FOR BARRICADES AND EMERGENCY VEHICLE ENTRANCE; PRO-
VIDING FOR LIABILITY INSURANCE, RESTORATION OF DAMAGED CITY PROPERTY, APPROVAL OF
THE DIRECTOR OF ENGINEERING AND PHYSICAL' DEVELOPMENT FOR CERTAIN CHANGES; REQUIR-
ING PERMITS FOR BEER AND FOOD; REQUIRING COMPLIANCE WITH CITY CODES; PROHIBITING
PAINTINGS OR MARKINGS ON STREETS AND TRAFFIC CONTROL DEVICES; REQUIRING THE SPONSOR
TO RESTORE THE AREA FOR USE BY VEHICULAR TRAFFIC; AUTHORIZING THE CITY MANAGER TO
EXECUTE THE ATTACHED APPLICATION PERMIT; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING
FOR PUBLICATION; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by
the following vote: Tipton, de Ases, Gill, Lozano and Sample, present and voting
"Aye"; Gulley voting "Nay"; and Luby Absent.
Mayor Pro Tem Tipton called for petitions or information from the audience
on matters not scheduled on the agenda.
Mr. David Helpenstell, 1009 Burkshire, appeared and complained that his
property taxes had been increased 78 percent this year. He stated he was not
objecting so much to the increase in valuation and did not object to paying his
fair share of taxes but did strenuously object to the increase all in one year.
He stated he felt his property had been decreased in value in the last two weeks
because he is being forced to send his children across town to school instead of
to the neighborhood school which was his reason for purchasing the property in
the first place, whereas children living across the street from him have the
benefit of the neighborhood school with the same assessed valuation on their
property.
City Manager Townsend explained that the procedures and timetables for
taxation are set by state law and not within the power of the Council to change.
He pointed out that the increase complained of by Mr. Helpenstell had been delayed
for several years and he should have been paying more taxes in the past.
Mrs..Blancherde LalSahchez;01 Norton, restated her complaint of several weeks
ago that a traffic signal of some kind is needed at this location to keep people
from making an unexpected U-turn and often landing in her front yard. City Manager
Townsend stated this complaint would be referred to the Traffic Engineer for investi-
gation.
There being no further business to come before the Council, motion by
Gill, seconded by Sample and passed, that the meeting be adjourned at 2:40 p.m.,
August 20, 1975.
