THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE, FOR AND ON BEHALF OF SAID CITY AN AGREEMENT WITH W. M. BEVLY AND, BEN H. JANSSEN; THAT A TRACT OF LAND OUT OF LOTS 3, 4, 13, and 14, SECTION 2, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, NUECES COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED HEREIN SHALL BE INCLUD- ED WITHIN THE BOUNDARIES OF SAID CITY CONDI- TIONED UPON PERFORMANCE OF THE EXPRESS COVE- NANTS AS CONTAINED IN SAID AGREEMENT WHICH IS MADE A PART HEREOF; AND DECLARING AND EMERGENCY. WHEREAS, W. M. Bevly and Ben H. JANSSEN are the owners in fee simple title to and of the property herein described, which adjoins the City of Corpus Christi, Texas; and WHEREAS, There are no resident voters within the area described; and WHEREAS, The City Council in the City of Corpus Christi, Texas, deem such action of incorporation of such property with- in the corporate limits of the City of Corpus Christi, Texas, to be in the best interest of the City of Corpus Christi, Texas; and WHEREAS, Such territory, when so admitted into the City shall bear its proportionate part of all taxes levied by the City and its residents shall have all the privileges and be subject to all the duties of other residents of such city; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager of the City of Corpus Christi be and he is hereby authorized to execute, for and on behalf of the said City of Corpus Christi, Texas, an agreement with W. M. Bevly and Ben H. Janssen of Corpus Christi, Texas, a copy of which agreement is attached hereto and made a part hereof: Z -7CQ/ STATE OF TEXAS O COUNTY OF NUSCRS 0 THIS CONTRACT AND AGMM' T entered into in duplicate by and be- tween'W. M. Bevly and Ben S. Janssen and the City of Corpus Christi, Texas, a municipal co_poration, ITITNWSETH: That W. M. Bevly and Ben H. Janssen are owners in fee simple of the following described property, located in Nueees County, Texas and adjoining the corporate limits of the City of Corpus Christi, Texas, to -wits A tract of land out of Lots 3, 4, 13 and 14, See. 2, Flour Bluff and Eacinal Farm and Garden Tracts, Nueees County, Texas, and being more particularly described as follows: Beginning at a point, the common corner of Lots 14, 15, 18 and 19, Sec. 2 Flour Bluff and Sncinal Fars and Garden Tracts for the West corner and point of beginning of this description; Thence N. 290 E. 2640.0 ft. to a point, the common corner for Lots 2, 3, Sec. 2, and 12 and 13, Sec. 1, Flour Bluff and Encinal Farm and Garden Tracts for the North Corner of this tract; Thence S. 610 B. 849.0 ft. to a point in the HE line of Lot 4, Sec, 2, Flour Bluff and Encinal Farm and Garden Tracts for the East Corner of this tract; Thence S. 290 W. 2640.0 ft. to a point in the 5W line of Lot 13, Sec. 2, Flour Bluff and hncinal Farm and Garden Tracts, for the South corner of this tract; Thence N. 610 W. 849.0 ft. to the point of beginning containing in all 51.45 acres more or less. There are no resident voters in the above described territory. It is therefore agreed by and between the parties hereto, W. M. Bevly and Ben H. Janssen and the City of Corpus Christi, Texas, that the above des- cribed territory shall be included within the boundaries of said City of Corpus Christi, Texas and shall became a part thereof upon the performance Of th0exPreas covenants hereinafter contained: The said W. M. Bevly and Ben H. Janssen agree to the following ex- pressed conditions to the admission of the above described territory into the City of Corpus Christi, Texas: i. That any development of said territoary will comply with the standards of improvements required by the Depa teems of Public Works and the Zoning and Planning Conmission of the City of Corpus Christi, Teams, including sidewalks on both lidos of street, located in any subdivision tarred out of such territory. 3. That they, the osnera of said territory, agreq that in the development or subdivision of aar such territory tbay will conform to the policy for the dedication of park area as 'tsbliehsd by the City of Corpus Christi, Texas. 14. That the owners of said territory understand and agree that such annexation of such territory be abject to "the capacity of the sewer system to permit connection of the property in said territory to such system of tie City of Corpus Christi and the capacity of the sewage disposal plant: to accommodate such additional 1cadl. the determination of such capacity to be mods soley by the Dir"tor Of Public Boris and his decision shall be binding up+m the said owners. ATTSM APPROM AS To =GAL FORM BM Jt6 sea CITY OF CORPUS CwSTI, TEIAS DIV r Section 2: The shortage of suitable building sites for the erection of medium priced homes within the corporate limits of the City of Corpus Christi, Texas creates a public emergency and public necessity requiring the suspension of the charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read in three several meetings of the City Council, and the Mayor having declared that such public emergency and necessity exist, and having required that such charter rule be suspended, and that such ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage, iT IS, ACCORDINGLY, SO ORDAIM. AS TO LEGAL FORM: CORPUS CHRISTI, TEXAS 1955 TO THE NENBERS OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going Ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no Ordinance or Resolu- tion shall be passed finally on the date it is introduced, and that such Or- dinance er Resolution shall be read at three meetings of the City Council; I. therefore, hereby request that you suspend said Charter rule or require- ment and pass this Ordinance finally on the date it is introduced, or at the present meeting of the City Council.
