HomeMy WebLinkAbout02770 ORD - 05/02/1950AN ORDINANCE CLOSING THE ALLEY EXTENDING FROM 10TH STRE -T ON THE EAST TO THE WEST BOUNDARY LINE OF LOT 13 BLOCS 12 CHAMBERLAIN ADDITION EXTENDED AND BEING A PORTION OF THE ALLEY IN BLOCK 12 OF CHAMBERLAIN ADDITION TO THE CITY OF CORPUS CHRISTI, TEXAS, RESTRICTING THE USE OF SAID CLOSED ALLEY UNTIL 30 DAYS NOTICE BE GIVEN THE CITY FOR REMOVAL OF UTILITY LINES AND REIMBURSEMENT MADE TO THE CITY FOR THE COST OF REMOVAL AND RELOCATION OF SUCH; AUTHORIZING THE EXECUTION OF A QUITCLAIM DEED TO THE ABUTTING PROPERTY OWNERS; AND DECLAR- ING AN EMERGENCY. WHEREAS, The City Council of the City of Corpus Christi has been petitioned that a portion of the alley in Block 12 of Chamberlain Addition to the City of Corpus Christi hereinafter described be closed; and WHEREAS, Notice of the proposed closing of said alley has been given by publication and by mail to the last known ad- dress of all known owners of property abutting said alley and within 450 feet therefrom in accordance with the Charter of the City of Corpus Christi as provided for in Article II, Section 6 thereof; and VdHEREAS, In accordance with the notice given as above set out, a public hearing was held in the City Council Chamber of the City Hall at 4 :00 o'clock p.m. on the 25th day of April 19503 by the City Council of the City of Corpus Christi, Texas; and WHEREAS, The public welfare, safety, convenience, and necessity would be better served by the closing of that certain portion of said alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the alley extending from 10th Street on the east to the west boundary line of Lot 13, Block 129 Chamberlain Addition extended, and being a portion of the alley in Block 12 of Chamberlain Addition to the City of Corpus -- 7-W0 Christi, Texas, be and the same is hereby closed and dedication thereof is vacated; provided, however, that before any use be made of the same by the abutting property owners that notice of at least 30 days be given the City of Corpus Christi by trans- mittal to the head of the Department of Public Utilities, noti- fying the City to remove from said alleyway all utility lines therein, and further provided that the City be reimbursed for the reasonable cost and expense of removal and relocation of said utility lines. SECTION II. That the City of Corpus Christi here- by releases and relinquishes all right, title, and interest in and to said alley described in Section 1 hereof to the property owners abutting said alley and the City Manager of the City is hereby authorized and directed to execute for and on behalf of the City a Quitclaim Deed releasing and relinquishing to the abutting property owners all right, title, and interest there- in as an easement and alley; said Quitclaim Deed to be deliver- ed upon compliance with the conditions set forth in Section 1 hereof regarding the removal of utility lines, SECTION III. The fact that public convenience and necessity will be better served by the closing of said alley creates a public emergency and a public imperative neces- sity requiring the suspension of the Charter rule that no ordin- ance or resolution shall be passed finally on the dap it is in- troduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, hay.. ing declared such emergency and necessity to exist, requesting that said Charter rule be suspended and that this ordinance be passed finally on the day it is introduced and that it take effect and be in full force and effect from and after its pass- age, IT IS ACCORDINGLY SO OPMAINED.
