AN ORDINANCE
APPROPRIATING $11,276.20 TO BE PAID AS CONSIDERA-
TION 0 CF CERTAIN PERMANENT PARK
IMPROVEMENTS- 'TM-FURTTO. 296 IMPROVEMENT BONDS
1950 CONSTRUCTION FUND ( :An ; OR-
IZING AND DIRECTING THE CITY MANAGER FOR AND ON BE-
HALF OF THE CITY TO EXECUtE A CONTRACT ',MITH BRASELTON
CONSTRUCTION COMPANY FpR THE CM-MMON OF SAID 19- PROPFNdENTS ERTION OF A COMMUNITY BUILDING IN T. C.
AVERS PARK); SUCH CONTRACT DOCUMENTS, PLANS, AND SPECI-
FICATIORTS ARE MADE A PART HEREOF BY REFERENCE; AND DE-
CLARING AN EMERGENCY.
WHEREAS, Certain improvements have been determined to be neces-
sary; and
WHEFEAS, Bids have been received, considered, and an award made
for the most advantageous bid to the City of Corpus Christi, Texas,
such bid being the contract price of $19,342.00; and
WHEREAS, In accordance with a motion passed by the Nueces County
Commissionerls Court on June 13, 1949, and recorded in Volume X, page
138 of the Commissioner's Court Minutes Book, Nueces County will par-
ticipate in this project in the amount of $10,000.00; and
WHEREAS, It is now necessary to make appropriations out of the
proper fund for the payment of the remainder of the contract price,
such being $9,342,00, and for ten per cent (10 %) of said contract
price to cover architect's fees and contingencies, making a total
appropriation of $11,276.20, and to authorize the execution of a
contract in accordance with said award;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated out of Fund
No. 296 Improvement Bonds 1950 Construction Fund (Park Improve-
ments) the sum of $611,276620, out of which fund there is to be paid
according to the terms of the contract described in Section 2 here-
of the sum of $9042.00, and the balance of said appropriation is
the amount equivalent to ten per cent (10%) of said contract price
of $19,342.00, which amount is hereby appropriated for the payment
of engineering and contingent costs of said project.

SECTION 2. That the City Manager is hereby authorized
and directed to execute for and on behalf of the City of Corpus
Christi a contract for the construction of a community building
in T. C. Ayers Park as a part of the Permanent Park Improvements
of the City of Corpus Christi, with Braselton Construction Com-
pany of Corpus Christi, Texas, which contract has been awarded
said Braselton Construction Company, in accordance with plans
and specifications and contract documents on file in the office
of the City Secretary, all incorporated herein and made a part
hereof by reference, and according to the bid of said Braselton
Construction Company opened on the 2nd day of May, 1950, the said
bid of Braselton Construction Company being the lowest and most
advantageous bid to the City of Corpus Christi, Texas.
SECTION 3. The necessity for pro'v'iding park and recrear
tion facilities and buildings as a part of the permanent park im-
provements of the City of Corpus Christi creates a public emer-
gency and imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be pass-
ed finally on the date of its introduction and that such ordinance
shall be read at three several meetings of the City Council, and
the Mayor, having declared that such emergency and necessity exist,
requesting that such Charter rule be suspended and that this ordin-
ance be passed finally on the date it is introduced and take effect
and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

MEMORANDUM:
TO Hon. George Prowse, County Judge, Nueces County, Texas
Hon. Commissioners Court, Nueces County, Texas
1. On June 13, 1949, at a regular meeting of the
Commissioners Court of Nueces County, Texas, at which all Commis-
sioners, as well as the County Judge, were present, the following
resolution was passed by the Court and same appears of record in
Volume X of the Commissioners Court Minutes Book at page 138:
"On motion of Commissioner Hall, seconded by Commissioner
Caldwell, it was unanimously voted by the Court that
$10,000.00 be appropriated for the 1950 County Budget to be
applied on the construction of a City- County recreational
center, at T. C. Ayers Park."
2. I have just talked with Mr. I. M. Singer -, City
Attorney, who requests that inasmuch as this recreational center
is a joint city- county venture and that the city, through its
Public Works Department, is undertaking the construction of this
building, that this resolution be corrected by this Court so as
to provide that the city of Corpus Christi shall be authorized
to supervise construction of said center, and that payment of the
appropriated money shall be made on estimates furnished by the
Public Works Department of the City of Corpus Christi.
3. This office will be happy to draw the necessary
corrected resolution should the Court desire same.

Upon the recommendation of the County Attorney, it was
moved by Commissioner Caldwell, seconded by Commissioner Hall, and
unanimously voted by the Court that the resolution passed on June
13th, 1949, and recorded in Volume X, Page 138, be corrected to
provide that the City of Corpus Christi through its Public Works
Department shall supervise the construction of the recreational
center at T. C. Ayers Park, and that the payment of the appropriated
money shall be made on estimates furnished by the Public Works
Department of the City of Corpus Christi and approved by the County
Engineer and County Auditor.
