FOR SUCH CONSTRUCTION; S ID CONTRACT DOCtR2NT3, FLANS,
AND SPECIPICATIONS BEING VADE A PART IIGREOF BY p„ Fir,R-
ENCE; AND DECLARING AN D ERGENCY.
,NI RK&S, Certain improvements have been determined to
be necessary, and
'v'MREAS, There is needed the sum of $115,400.69 for
certain small storm sewer projects in the City of Corpus Christi,
and
V1TE.13 AS, There is available in Fund No. 296 improve-
ment Bonds 1950 Construction Fund (Storm Sewer Improvements) said
amount needed for such improvements; and
PIiEREAS, Bids have been received, considered, and an
award made for the most advantageous bid to the City of Corpus
Christi, and it is now necessary to make such appropriation and
to authorize the execation of a contract in accordance with said
award;

SECTION 1. That there is hereby appropriated out of Fund
Ill. 296 Improvement Bonds 1950 Construction Fund (Storm Sewer Im-
provements) the sure of Y115,400.69, out of which amount there is
to be paid according to the terms of the contract described in Sec-
tion 2 hereof the sum of 8104,909.72 as contract price; the bal-
ance of said appropriation is the amount equivalent to ten per cent
of said contract price, which amount is hereby appropriated for the
payment of engineering and contingent costs of said project.
SEC'T'ION 2. That the City Manager is hereby authorized
and directed to execute for and on behalf of the City of Corpus
Christi a contract for the construction of such small storm sewer
projects — drainage improvements on:
Lou Street from Osage to Pueblo,
Ruth Street from Harmon to Eleanor,
Highland Street from Ruth to Sabinas,
Sabinas Street from highland to tlorgan,
Rossiter Street from Ocean Drive to Bay,
itlameda Street from Louis_ana to Texas,
Lawnview from Louisiana to Dreezeway,
Texas from Lawnview to Topeka;
with T. H. Lee, Contractor, which contract has been awarded said
T. H. Lee in accordance with plans and specifications and the con-
tract documents on file in the office of the City Secretary, all
incorporated herein and made a part hereof by reference, and ac-
cording to the bid of said T. H. Lee, opened on the 23rd day of
May, A.D. 1950, said bid being the most advantageous, and lowest,
to the City of Corpus Christi.
SECTION 3. The need to appropriate said amount and
to authorize the execution of said contract in order to protect
the public health and general welfare by the repairing, mainten,
ance, Dying and relaying of storm sewers within the City of
Corpus Christi creates a public emergency and imperative public
necessitr requirinC the suspension of the Charter rule that no
ordinance or resolution ;;hall be passed and approved finally on
the day it is introduced and that such ordinance or resolution
shall be read at three several meetings of the City Council, and
the Mayor, having declared such emergency and necessity to exist,
requesting the suspension of said Charter rule, and that this or-
dinance be passed finally on the day it is introduced and take ef-
fect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of Fund No. 296 Lirpovement Ponds. 1950

Sewer Improvements) from which it is proposed to be drawn,
and such money is not appropriated for any other purpose.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
