AN ORDINANCE
RECEIVING AND ACCEPTING THE EQUIPIiEhiT FURNISHED ffi4
AND THE INSTALLATION THEREOF BY FAIRBANKS, MORSE, &
COMPANY ON PUMPING PLANTS *BAYFRONT PROTECTION AND
STORM WATER CONTROL PROJECT* IN THE CITY OF CORPUS
CHRISTI, TEE SAME BEING THE EQUIPMENT AND INSTALLA-
TION CONTRACTED FOR UNDER CONTRACT DATED JANUARY 23,
1948, AS AUTHORIZED BY ORDINANCE NO. 2210 DATED JAN-
UARY 13, 19148; AND AUTHORIZING FINAL PAYMENT TO SAID
COMPANY AS SET OUT IN THE ESTIMATE ATTACHED HERETO
AND MADE A PART HEREOF, SAID PAYlM TO BE PAID OUT
OF.FUND NO. 258 SEAWALL AND BREAKWATER CONSTRUCTION
FUND AS AUTHORIZED IN ABOVEMENTIONED ORDINANCE; AND
DECLARING AN ENERGENCYo
WHEREAS, It has been previously determined to be neces-
nary to provide for the protection of the Bayfront of the City of
Corpus Christi, from the elements and from storms and other damage;
and, as well, for the control of storm waters; and
WHEREAS, Provisions have previously been made for the
commencement of such oonstruction, purchase of such equipment and
installation thereof, and the taking of other measures requisite
to the accomplishment of such Bayfront Protection and Storm Water
Control; and
WHEREAS.. As a part of this project, the City Council
of the City of Corpus Christi did execute a contract on January 23,
1948 asp authorized by Ordinance No. 2210 providing for the furnish-
ing of equipment and installation thereof in the pumping plants
by Fairbanks, Mores and Company, and appropriating money to be paid
as consideration therefor; and
WHEREAS, Said equipment and final estimate has met the
specifications for this project and has been approved by the Direc-
tor of Public Works and others for the City, and Wars and Noyes
and Associates, as engineers for the Bonding Company, and it has
been recommended that the City Council authority be secured for
the acceptance of this equipment and final payment to said company
be made;
BE IT ORDAINED BY THE CITY COUNCIL CF THE CITY OF CORPUS
CHRISTI, TEMs
SECTION I. That the equipment furnished by and the work
of installation thereof for the pumping plants in the Bayfront
Protection and Storm Water Control Project havingbeen performed
and completed in accordance with the terns and provisions of the
contract, and the plans and specifications therein contained,
entered into by and between the City and Fairbanks, Mores and
Company on the 23rd day of January, 1948, and the Director of
Public Works having inspected the same and the equipment and
certified to the completion of said work and that the equipment
has met the specifications for this project in accordance with
said plans and specifications, and said equipment and installa-
tiom aforesaid is hereby found to have been completed in ac-
cordance with the plans and specifications and is here now ac-
cepted and received by the City Council of the City of Corpus
Christi, Texas.
SECTION II. That final payment due under the contract
and as set out in the final estimate attached hereto and made a
part hereof, prepared by the Director of Public Works dated May
25, 1950, in the sum of $16,667.84 be made in accordance with
the terms of such contract and that such payment be made from
No. 258 Seawall and Breakwater Construction Fund, as previously
appropriated.
SECTION III. The installation and equipment aforesaid,
being a part of the Bayfront Protection and Storm Water Control
Project, having been completed and approved as aforesaid, and
it appearing to be necessary to finally approve and accept said
equipment and installation and to provide for the final payment
therefor i+mod at*4 creates a public emergency and imperative
Public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the
day it is introduced and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the
Mayor,declaring such emergency and necessity to eicist, having request-
ed the suspension of said Charter rule and that this ordinance be
passed finally on the day it is introduced and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED.

Attached are copies of Estimate No. 6 and Final covering
equipment furnished by Fairbanks, Morse, and Comparor on
Pumping Plants - Bayfront protection and Storm Water Con-
trol Project.
This equipment has met the specific4tions for this project,
has been inspected by this department, and it is recommended
that Council Authority be secured for the acceptance of this
equipment and final payment to Fairbanks, Morse, and Company
of the amount of 316,667.84 as set out in the attached esti-
mate.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council,
