PUY UNDER CONT T DAT NOVEMBER , 19148 AUTHORIZED BY ORDINANCE N0. 2Z2 AT THE SAVAGE LANE PLANT FOR THE CITY OF CORPUS CHRISTI, ADm THE FINAL ESTIMATE THEREON; AM AUTHORIZING THE FINAL PAYMENT TO SAID J. DE PUY AND E. D. DE. PUY AS SET OUT IN THE FINAL ESTIMATE MADE A PART HEREOF, SAID PAYMENT BEING MADE OUT OF FUND NO. 298 CITY OF CORPUS CHRISTI WATEMRRS CON- STRUCTION FU _ 1PRQFRLxrr'D BY AFOREMENTIONED ORDINANCE; AND DECLARING AN EMERGENCY 7EEREAS, On the 3rd day of November, 1948 the City did contract with J. De Puy and E. D. De Puy of Bomar County, Texas, for the pumping plant, reservoir and equipment and the installation there- of at the Savage Lane Plant for the City as set out in said contract on file in the City Secretary's Office, as authorized by Ordinance 2402; and EHEREAS, Such installation having been completed and inspected and approved, and the final estimate and recommendation thereon has been submitted for approval and action; NOW, THER,FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the installation of the pumping plant, reservoir and equipment at the Savage Lane Plant for the City of Corpus Christi having been performed rid completed in accordance with the terms and provisions of the contract, and such pumping plant, reservoir and equipment meeting the specifications of such contract, and the plans and specifications therein contained, entered into by and between the City and J. De Puy and E. D. De Puy of Bomar County, Texas, on the 3rd day of November, 1948, and the Director of Public Worls having in- spected the same and the equipment and certified to the completion of said installation and that the equipment, reservoir and pumping plant have met the specifications for this project in accordance with said plans and specifications, and said equipment, reservoir and pumping plant and the installation thereof having been approved by Greeley and Hansen, Engineers for the Bonding Company, said pumping plant, reservoir and equipment aforesaid is hereby found to be inand to have been oom- plated in accordance with the plans and specifications and is here now accepted and received by the City Council for the City of Corpus Christi. a__� 9 5 SECTION II. That final payment due under such contract and as set out in the final estimate attached hereto and made a part here- of, prepared by the Director of Public Works, dated May 244 1950, in the amount of $71,936.27 be made in accordance with the terms of such contract and that such payment be made from No. 298 City of Corpus Christi Waterworks Construotion Fund, as previously appropriated. SECTION IIIe That,the aforementioned equipment and the installation thereof having been approved and completed, the neces- sity of accepting such and making final payment due immediately, in order to complete this project, creates a public emergency and impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the mayor, having declared such emergency and necessity to exist, requesting that such Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINEDe PASSED AND APPROVED, �i/ii the oaa day of , 1950- XAPR Ro -TJ of the AT T= CITY OF CORPUS CHRISTI, TEXAS City Secretary APPR�TO GAL FORM; City A orney Corpus Christi, Texas , 1950 i TO THE P• WEBS OF TIM, CITY COUBTCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist fqr the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
