WHEREAS, The City Council of the City of Corpus Christi, Texas, has determined the necessity for, and has decided to improve portions of certain streets within the City of Corpus Christi, as hereinafter fully described by constructing sidewalks along said streets: NWT, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there exists a public necessity for, and the City Council of the City of Corpus Christi, Texas, does hereby determine that it is necessary to improve portions of certain streets, hereinafter described, within the said City, by the constructing of sidewalks along said streets, within the limits prescribed, and in the manner herein provided. SECTION 2. That the plans of the Director of Public worlm of the City of Corpus Christi, Texas, submitted to the City Council and on file in the office of the City Secretary of said City, for the purpose of improving portions of certain streets as hereinafter described and designated, by constructing sidewalks along said streets, are hereby approved and adopted for the use on the portions of said a_ 91 street$ met out therein and herein. That the designation of the various portions Of certain streets to be improved as separate projects as above de» scribed, does not in any respect preclude the City of Corpus Christi from letting contracts on all of said projects together, but the said City does hereby reserve the right to let the contracts on all of said Projects or on each individual project or any number of said projects or to abandon any one or more of said projects without prejudice to its rights to proceed on the remaining projects, and the fact that the City shall proceed on lose than all of said projects shall not constitute any grounds of objection on the part of any individual or property owner, nor shall the abandonment of or failure to proceed on any one or more projects in any way invalidate or affect the assess- ment against other property which abate on the portion of any other street or streets in any other project. SECTION 5. That it is hereby ordered that said streets with.. in the limits above described shall be improved by the constructing, and aligning, of sidewalks along the described portions of said streets, and each of them, together with all other necessary incidentals and appurtenances, as provided for in the plans and specifications for such improvements as prepared by the Director of Public Works of said City; that said improvements shall consist of 4" concrete sidewalk, 41 in width. SECTION 6. In providing for and making such improvements, the City Council hereby determines to proceed under and in the ex- ercise of the powers, terms and provisions of Section 6 of Article 2 of the Charter of the City of Corpus Christi, Texas, and as set out in the Acts of the First - Called Session of the 40th Legislature of the State of Texas, 1927, Chapter 106, said act being commonly known as Article 1105 -b, Revised Civil Statutes of Texas, 1925, as amended. SECTION 7. That the Director of Public Works of the City of Corpus Christi is hereby directed and instructed to prepare im- mediately and file with the City Council of the City of Corpus Christi complete plans and specifications for such improvement of said streets and each of them, as hereinbefore described and with- in the limits designated, and, in the event the Director of Public Works of the said City has prepared plane for such improvement of said portions of said streets, he shall immediately file with the City Council said complete plans and specifieati ns for said im- provements. SECTION 8. The cost of said improvements shall be paid as follows: (a) The cost of constructing sidewalks within the area between and under rails, tracks, double tracks, turn -outs, and switches, and two feet on each side thereof, of any railroad, street railroad, or interurban using, occupying or crossing such street or portion thereof hereby ordered improved, shall be paid by the respective owners thereof, and assessed against such railroad, street railroad, or interurban, and its road bed, ties, rails, fixtures, rights and franchises, and the real and true owners thereof, in the manner provided by the terms of the City Charter Of the City of Corpus Christi, Texas, and by said Acts of the 40th Legislature of the State of Texas (1927) above indentified. (b) The City of Corpus Christi will pay all engineering costs incurred in establishing the line and grade of all sidewalks to be constructed pursuant to this ordinance, and shall pay not more than the balance of the total remaining cost of such improve- ments over and above that amount assessed against the property abutting upon said streets within the limits as above defined, and the real and true owners thereof, The City shall also pay the cost of such improvements on corner lots between the intersection of easement lines and the curb to which they are immediately ad- jacent. (c) The property abutting upon said streets within the limits above defined and the real and true owners thereof, shall be assessed and pay not to exceed the total coat of constructing of sidewalks along theportions of said streets to be improved, as described and designated in Section 4 hereof, exclusive of the amount thereof herein specified to be paid by any railway, street railway, or interurban, as set out in subs- aeetion (a) above, and by the City of Corpus Christi as set out in sub - section (b) above. The amounts payable by the abutting property and the real and true owners thereof and shall be assessed . against such property and the real and true owners thereof and shall constitute a first and prior lien upon such abutting property and a .personal liabil- ity of the real and true owner thereof, and shall be payable as follows: The amodat of said assessments shall be payable in two equal installments, the first of which to be due and payable twenty days after the date said improvements are completed and accepted by the City Council of the City of Corpus Christi, and the remain, ing one installment to be due and payable one year from and after the date of such acceptance, together with interest thereon from said date of acceptance at the rate of five per cent (5 %) per annum, Payable on the date the said installment is due; provided, however, that the owner of said property shall have the privilege of paying any one or all of such installments at any time before maturity thereof, by paying the total amount of principal due, together with interest accrued to date of payment; further, that if default be made in the payment of any said installment or principal or interest Promptly as same maturea, then at the option of the contractor or assigns, the entire amount of the assessment upon which such de- fault is made, shall be and become immediately due and payable, together with reasonable attoaasys fees and collections cost, if incurred, however, it is specifically stipulated and provided that no assessment shall in any case be made against any property or the real and true owner thereof in excess of the special bene- fits to accrue to such property in the enhanced value thereof, re- sulting from such improvements. SECTION 9. It is further provided, as is stipulated by the provisions of the City Charter and the laws above identified, that said improvements may be omitted in front of any property exempt from the lien of such assessment for the improvements with- out invalidating or affecting the assessments against the other property abutting upon said streets. SECTION 10. The City Secretary of the City of Corpus Christi is hereby authorised and directed to prepare a notice in the name of said City of the action taken herein and to have sane filed by the County Clark of Nueces County, Texas, among the mortgage records of said County. SECTION 11. The fact that portions of certain streets within the City of Corpus Christi, as above described, do not have sidewalks, and the further fact that such sidewalks along said streets are necessary to the health and public welfare of the in- habitants of said City, epeoi&21y in view of the increased traffic along streets in the City, creates a public emergency and impera- tive public necessity requiring the suspension of the Charter rule that no Ordinance or Resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the 1[ayor, having declared such emergency and necessity to exist, re- questing that such Charter rule be suspended, and that this Oxdin.. ante take effect and be passed finally on the date it is introduced and take effect and be in full force and effect from and after its passage, IT 15 ACCORDINGLY SO ORDAINED. That in said Ordinance No.� 7 7 said City Coun- cil did determine to proceed under and in the exercise of the pavers, terms and provisions of Section 6 of Article 2 of the Charter of the City of Corpus Christi, Texas, and as set out in the Acts of the First Called Session of the 40th Legislature of the State of Texas, 1927, Ch*pter 106, said act being commonly known as Article 1105 -b, Revised Civil Statutes of Texas, 1925, as amended.
