That on behalf of the City of Corpus Christi, Texas, the City Council hereby exercises its option and elects to have the City and all of the employees of the ?Mater Division of the Departz-±ent of Public Utilities of the City of Corpus Christi participate in the Texas Iiwv cipal Retirement Systeru as provided in House Dill 29, Chapter 75, page 10£3, Acts Of the 50th Legislature in 1947, being,. Article 6243h of Vernon's Annotated Civil Statutes; and all of the benefits and obligations of such systerl are hereby accepted. SECTION 2. That, the City 1 -lana. er of the City of Corpus Christi Is hereby directed to notify the Board of Trustees of the Texas municipal I etireriont Syste°s that the City of Corpus Christi, Texas, has elected to Participate and have the employees of the Water Division of the Department of Public Utilities of the City of Corpus Christi participate in such systett, a-? q 2 SECTION 3. Each person who becomes an employee of the Water Division of the Department of Public Utilities, on or after the effective date of participation of said Department, shall be included within and subject to the provisions of the Texas Municipal Retirement System beL inning upon the date such person becomes an "employee" as defined in subsection 14, Section 2 of such system. SECTIOii 4. That, the City of Corpus Christi, Texas, nay in the fixture by vote of the City Council elect to add other departments and the employees thereof of the City of Corpus Christi to participate in such system and upon such election, notice of such election_ shall be given by the City lTana�;er to the Board of Trustees as required by the provisions of said system. &$CTIOTi 5. That, the City of Corpus Christi, Texas, may in the future refuse to add new departments or new employees to such system but shall never discontinue as to any participants except as may hereafter be provided by law. SECTIOTI 6. That, the Director of Finance is hereby directed to remit to the Board of Trustees of the Texas Municipal Retirement System, at its office in Austin, Texas, the City's proper contributions to the system and the amounts which shall be deducted from the compensation or payroll of employees, all of said remittances to be dispatched as required by said Board under the provisions of Chapter 75, Acts of the 50th LeLis- lature of the State of Texas, 194.7, and the said Director of Finance is hereby authorized and directed to ascertain and certify officially on be- half of the City of Corpus Christi, Texas, the prior service rendered to said nunicipality by each of the employees of the Water Division of the Department of Public Utilities and such other departments as may elect to participate in said system, and the average prior service compensation received by each, and to make and execute all other reports and certificates, which nay be required of the City of Corpus Christi, Texas, under the provisions of Chapter 24, Acts Regular Session 50th Legislature or the rules and re- ul.ati.ons of the board of Trustees of the Texas Municipal Retirement System. SECTION 7. The fact that municipal employees are not covered by Federal Social Security and that it Will be in the public interest for the City to have its employees participate in the Texas Plunicipal Retirement System at as early a date as possible, particularly the Water Division of the Department of Public Utilities, creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetimEs of the City Council, and the tiayor having declared that such public emergency and imperative necessity exist, and havir requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and taL-e effect and be in full force and effect from and after its passage, IT IS ACCORDIiGLY SO 0 ?DAII:ED. PASSED AIM APPROVED this 27 day of / / S� T: City Secretary APPROVED AS TO POIZt1: City A t rney '~ 2;AYOP City of Corpus Christi, Texas Corpus Christi, Texas �- 1950 TO THE 2MMERS OF THE CITY COUIdCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a .public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
