AN ORDINANCE
PROVIDING FOR THE ASSESSMENT OF COURT
COSTS OF THREE DOLLARS ($3.00) IN COIF
PORATION COURT OF THE CITY OF CORPUS
CHRISTI, TEXAS, UPON ANY PERSON NAMED
IN A COMPLAINT IN SAID COURT, WHO HAS
AGREED OR POSTED BOND TO APPEAR AND
ANSWER SAID COMPLAINT OR HAVING BEEN
GIVEN NOTICE TO APPEAR AND ANSWER SAID
COMPLAINT, WHO FAILS TO APPEAR AND AN-
SWER SUCH COMPLAINT; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS;
SECTION 1. When any person who, having been named
as a defendant in a complaint on file in the Corporation Court of
the City of Corpus Christi, Texas, and who has signed an agreement
to appear in said corporation court and answer such complaint, or
has posted bond to appear in Corporation Court and answer such com-
plaint, shall fail to appear in Corporation Court at the time indi-
cated in such agreement to appear or by such appearance bond, any
such appearance bond may be forfeited, and the Clerk of the Corpora-
tion Court may issue a warrant for the arrest of such person named
in said complaint.
SECTION 2. When any person, who having been named as
a defendant in a complaint on file in the Corporation Court of the
City of Corpus Christi, Texas, and who has signed an agreement to
appear in said court and answer such complaint or has posted bond
to appear in Corporation Court and answer such complaint, shall
fail to appear in said court at the time indicated in such agree-
ment to appear or such appearance bond, or when any person having
been named as a defendant in a complaint on file in the Corporation
Court of the City of Corpus Christi, Texas, fails to appear at the
time of the trial of such cause, such case may be re -set, and the
Clerk of the Corporation Court shall forthwith give written notice

of such re- setting, which said notice shall be mailed to the
defendant named in such complaint at his last ]mown address,
and proof of the deposit of such notice in the United States
mails shall be prima facie evidence of the receipt of said
notice. When any person shall fail to appear and answer such
complaint after notice of such re- setting of the said cause
has been duly given, a warrant shall be issued for such person's
arrest.
SECTION 3. There is hereby established a warrant
fee of THREE DOLLARS ($3.00) which shall be assessed as costs
of court against any person convicted of an offense in Corpora-
tion Court and for whom a warrant for arrest has been issued.
SECTION 4. The need to defray a portion of the
cost of securing the attendance of persons charged with viola-
tions in Corporation Court by assessing court costs upon failure
to appear after notice creates a public emergency and imperative
public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist,
requesting that such Charter rule be suspended and that this
ordinance be passed finally on the date of its introduction and
take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council= I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
