HomeMy WebLinkAbout02810 ORD - 07/06/1950F/3/'5T(5)' (5)r AN ORDINANCE RECEIVING AND ACCEPTING THE WORK ON SANITARY SEWER MAINS - EXTENSIONS OF OSO DISPOSAL SYSTEM- BY HELDENFELS BROTHERS AS AUTHORIZED UNDER CONTRACT DATED THE DAY OF August , 1948, FOR SAID PRO- JECT BY AND BETWEEN THE CITY AND BELDENFELS BROS.; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXASs SECTION 1. That the work of Heldenfels Bros„ under its con- tract with the City dated the 3 day of August , 19R8, on Sanitary Sewer Mains - Extensions of Oso Disposal System, having been performed and completed in accordance with the terms and provisions of the said contract, and plans and specifications for said work, and the Director of Public Works having inspected the same and certified to the com- pletion of said work in accordance with said plans and specifications, and the materials therein incorporated having been tested and approv- ed, the work aforesaid is hereby found to have been completed in ac- cordance with the plans and specifications and is here and now accept- ed and received by the City Council of the City of Corpus Christi, Texas, SECTION 2. That final payment due under the contract mention- ed and as set out in the final estimates! which is attached hereto and made a part, prepared and checked by the Director of Public Works and recommended for payment, dated June 30, 1950, in the sum of $106,139.12 be made in accordance with the terms of said contract and from Fund No. 295 Improvement Bonds 1948 Construction Fund (Sanitary Sewers) as pre- viously set aside for such payment. SECTION 3. The necessity for completion of this project by such acceptance and by the approval for final payment of such final estimate as aforesaid creates a public emergency and imperative public necessity requiringthe suspension of that Charter rule providing that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having de- clared that such emergency and necessity exist, requesting that said Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in 17x.0 force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
