N =--OF -PAY IN THE , NUECES COUNTY, TEXAN; SAVE AND EXCEPT, THE RESERVA- TION OF A PUBLIC UT GE EASEMENT EXTENDING FM 1 H S OF SAID STREET; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND DELIVER A QUITCLAIM DEED 70 EACH OF THE ABUTTING PROPERTY AY- MENT BY EACH OF THE ABUTTING PROPERTY OWNERS OF THE SUM OF $750 CASH AND DEPOSIT WITH THE WATER DEPART- MENT OF THE CITY OF CORPUS CHRISTI OF M ADDITION 3=50 TO DEFRAY EXPENSES CF THE RELOCATION OF WATER MAINS; AND DECLARING AN EMERGENCY. WHEREAS, The City Council of the City of Corpus Christi has been petitioned that a portion of Twentieth Street, to wit: That portion of Twentieth Street lying North of the North line of Laredo Street and extending to the South line of the Right -of -Away of Texas Mexican Railroad Co., in the City of Corpus Christi, Texas, hereinafter more particularly described, be closed; and WHEREAS, Notice of the proposed closing of said street has been given by publication and by mailing to the last (mown ad- dress of all owners of property abutting said street and within 450 feet therefrom, in accordance with the Charter of the City of Corpus Christi, as provided in Article II, Section 6 thereof; and, WHEREAS, In accordance with the Notice given as above set out, a public hearing was held on the 27th day of Jung, 1950, in the Council Chamber of the City Hall in Corpus Christi, Texas, at 4:00 o'clock p.m. by the City Council of the City of Corpus Christi; and WHEREAS, The public welfare, safety, convenience and necessity would be better served by the closing of that certain portion of said street; NOW, THEReFORE, BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That that portion of Twentieth Street from the North line of Laredo Street to the South line of the Texas Mexican Railroad Co. Right-of-way, described as follows, to-wit: Being that portion of Twentieth Street lying between Lot 122 Block 5 and Lot 1 Block 6, PATRICK iNEBB ADDITION to the City of Corpus Christi, Texas be, and the same is hereby, closed and the dedication thereof is hereby vacated; SAVE AND EXCEPT, a ten foot (101) utility and drain- age easement, extending five feet (5t) on each side of the center line of said portion of said street hereby closed upon the payment of the consideration and expenses hereinafter provided. SECTION 2. That upon the payment of the sum of $750 cash and deposit with the Water Department of the City of Corpus Christi of the further sum of $112.50 by each of the abutting property owners, the City. of Corpus Christi will releasei relinquish and quitclaim unto said abutting property owners all right, title and interest in and to said street, SAVE AND EXCEPT, said Ten Foot (10f) ease- ment for utility and drainage purposes; and, that the City Manager for and on behalf of the City of Corpus Christi is hereby authorized and directed to execute a quitclaim deed releasing and relinquish- ing to the abutting property owners respectively all said right, title and interest heretofore held by the City of Corpus Christi; said quitclaim deed to be in the form attached hereto and made a part hereof; and, the same to be delivered upon compliance with the conditions herein set forth. SECTION 3. The fact that public convenience and neces- sity will be better served by the closing of that certain portion of said street immediately creates a public necessity and emergency requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council; and the ,Mayor, having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended and that this Ordin- ance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
