AN ORDINANCE
RECEIVING AND ACCEPTING THE WORK COMPLETED BY
HELDENFELS BROS. ON STORM DRAINAGE IMPROVEMENTS
-OLD ROBSTOWN ROAD EXTENSION -IN THE CITY OF CORPUS
CHRISTI, TEXAS, UNDER CONTRACT DATED THE 11 DAY
OF March , 1950, BY AND BETAM THE IZ` 17AND
HEM9EM-MOS. AND AUTHORIZING FINAL PAYMENT AS
SET OUT IN THE FINAL ESTIMATE MADE A PART HEREOF;
AND DECLARING AN EMERGENCY,
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the work of installing storm sewer mains
in the Old Robstown Road Extension in the City of Corpus Christi,
Texas, as storm drainage improvements in the City of Corpus Christi,
as set out in that certain contract by and between the City and Heldenfels
Bros., performed by Heldenfels Bros. under its said contract dated the
11 day of March , 19509 having been performed and completed
in accordance with the terms and provisions of the contract, plans,
and specifications, and the Director of Public Works having inspected
the same and certified to the completion of said work in accordance
with said plans and specifications, the work aforesaid is hereby
found to have been completed in accordance with the plans and speci-
fications and is here and now accepted and received by she City Coun-
cil of the City of Corpus Christi, Texas.
SECTION 2. That final payment due under the contract men-
tioned and as set out in the final estimate attached hereto and made
a part hereof, prepared and checked by the Director of Public Works,
dated June 30, 1950, in the amount of $6,266.25 be made in accordance
with the terms of such contract and paid from Fund No. 296 improve-
ment Bonds 1950 Construction Fund (Storm Sewer Improvements), as
previously has been appropriated.
SECTION 3. The necessity for the completion of -this pro-
ject, the work on same having been finished, by such acceptance and
by the final payment as aforesaid creates a public emergency and
imperative public necessity requiring the suspension of the Charter
rule requiring that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and the
Mayor, having declared that such emergency and necessity exist, re-
questing that said Charter rule be suspended and that this ordinance
be passed finally on the day it is introduced and that it take effect
and be in full force and effect from and after its passage, IT IS AC-
CORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a .public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

Attached are copies of Estimate No. It and final covering work com-
pleted by Heldenfels Brothers on Storm Drainage Imprwasmaks - Old
Robstoan Road Extension.
This work has been performed in accordance with the plans and speci-
fications, and it is recommended that Coundl Authority be obtained
for acceptance and final payment of this project.
Please return the voucher and estimates to this office for transmittal
to the Contractor. This estimate has been prepared and checked by this
department.
