AUTHORIZING AND DIRECTING THE CITY MANAGER FOR
AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO
ACQUIRE 10.7 ACRES OF LAND OUT OF SECTION 17 OF
THE FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS
NEEDED FOR THE EXTENSION OF OSO DISPOSAL PLANT,
FROM NOLAN SMITH AND JOE H. BAKER BY GENERAL WARRANTY
DEED, FOR THE CONSIDERATION OF $1,000 PER ACRE; AP-
PROPRIATING $10,700 TO BE PAID AS THE CONSIDERATION
FOR SUCH LAND OUT OF FUND NO. 299 Improvement Bonds
1950 Construction Fund (Sanitary Sewers); AUTHORIZ-
ING AND DIRECTING SAID CITY MANAGER TO EXECUTE THE
NECESSARY INSTRUMENTS AND TO DO ALL THINGS REQUISITE
TO SUCH ACQUISITION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION I. That the City Manager is hereby authorized and
directed for and on behalf of the City to acquire a General Warranty
Deed from Nolan Smith and Joe H. Baker covering the fee simple title
to that certain tract of land described as follows, to -wit:
BEGINNING At a point, the mat southerly corner
of that certain tract of land out of Section 17
of the Flour Bluff and Encinal. Farm and Garden
Tracts, acquired by the United State of America
in Cause No. 187 in the United States District
Court for the Southern District of Texas, for the
northeast corner of this tract;
THENCE N 61 deg. 071 20" W along the south -
wast boundary line of the aforesaid United States
of America Tract a distance of 1,613.19 feet, to
a point, the most westerly corner of said United
States of America Tract, for a corner of this tract;
THENCES 86 deg. 581 20" W a distance of 439.97
feet to a point in the common boundary line between
lots 2 -A and 3 -A, Section 17, of the Flour Bluff and
Encinal Farm and Garden Tract for a corner of this
tract;
THENCE S 28 deg. 50+ 10" W with the common boun-
dary line between said lots 2 -A and 3 -A a distance of
21.40 feet to a point, the common corner of lots 2 -A,
3-A, 11 and 12, Section 17, of the Flour Bluff and
Encinal Farm and Garden Tracts for the most westerly
corner of this tract;
THENCE S 60 deg. 57t 20" E with the southwest
boundary line of lots Nos. 3-A, 4 -A and 5 -A a distance
of 1986.07 feet to a point, the northeast corner of
lot 9, Section 17 of the Flour Bluff and Encinal Farm
and Garden Tracts, for the most southerly corner of
this tract;
THENCE N 29 deg. O1, 10" E with the northeasterly
extension of the southeast boundary line of said lot
9 a distance of 259.75 feet to the PLACE OF BEGINNING,
said tract being needed for extension of Oso Disposal Plant for the
City of Corpus Christi, Texas.
SECTION II. That the City Manager is hereby authorized
and directed to acquire said land and to execute the necessary in-
struments incident to said acquisition of said land described in
Section I hereof.
SECTION III. That the purchase price of $10,700 is here-
by appropriated out of Fund No. 299 Improvement Bonds 1950 Construc-
tion Fund (Sanitary Sewers) and is to be paid therefrom upon the
delivery, to the City of said Warranty Deed.
SECTION IV. The importance of providing adequate facili-
ties for sanitary sewage disposal,by the said extension and possible
future expansion of the Oso Treatment Plant, for the City of Corpus
Christi creates a public imperative necessity and public emergency
requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally onthe date of its introduction
and that such ordinance shall be read at three several meetings of
the City Councils and the Mayor having declared that such emergency
and necessity exists requesting that such Charter rule be suspended
and that this ordinance be passed finally on the date of its intro-
duction and take effect andbe in full force and effect from and after
its passages IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a .public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at .three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
