TEXAS SUCH IMPROVEMENTS; SAID AMOUNT IS HEREBY APPRO- PRIATED FROM NO. 296 IMPROVEMENT BONDS 1950 CON- STRUCTION FUND (STREET I 5 r ; ATTHORIZ_ ING AND DIRECTING THE CITY MANAGER FOR AND ON BE- HALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH BROWN AND ROOT INC. FOR THE RE- S Rai FACING OF SAID STREETS; SAID CONTRACT DOCUMENTS AND PLANS AND SPECIFICATIONS ARE MADE A PART HERE- OF BY REFERENCE; AND DECLARING AN EMERGENCY. Vflr?REAS, Certain improvements have been determined to be necessary; and WHEREAS, There are unappropriated funds available in Fund No. 296 Improvement Bonds 1950 Construction Fund (Street Improvements) from which to make payment for said improvements; and WHEREAS, Bids have been received, considered, and an award made for the most advantageous bid to the City of Corpus Christi, Texas, and it now becomes necessary to make appropria_ tions for such payment and to authorize the execution of a con- tract in accordance with said award; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION I. That there is hereby appropriated out of No* 296 Improvement Bonds 1950 Construction Fund (Street Improve- ments) the sum of $71,975.86, out of which amount there is to be Paid according to the terms of the contract described in Section II hereof the sum of $65,132.60 as the contract price; the bal- ance of said appropriation is the amount equivalent to ten per cent (10%) of said contract price, which amount is hereby appro- priated for the payment of engineering and contingent cost of said project„ -Z?Z Z SECTION II. That the City Manager is hereby authorized and directed for and on behalf of the City to execute a contract for the resurfacing of said streets with Brown and Root. Inc., which contract has been awarded said Brown and Root, Inc. in so- cordance with plans and specifications and contract documents on file in the office of the City Secretary, all incorporated here- in and made a part hereof by reference, and according to the bid of said Brown and Root, Inc. opened on the 12th day of July, A.D. 1950, the said bid of Brown and Root, Inc. being the lowest and most advantageous bid to the City of Corpus Christi, Texas. SECTION III. The necessity for the maintenance and upkeep of the public streets in order to protect the life and general welfare of the people of Corpus Christi creates a public emergency and imperative public necessity requiring the suspen- sion of the Charter rule that provides that no ordinance or reso- lution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, requesting the suspen- sion of said Charter rule and that this ordinance be passed fin- ally on the date it is introduced and takeeffect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED• PASSED AND APPROVED, This theaday of July, 1950. r A EST: j OR P W o wv CITY C� CORPUS CHRISTI,TE%AS City Secretary AS TD EGAL FOiid�I: 'CDy i A torney Corpus Christi, Texas 1950 TO THE E"v'�.l'BERS OF TM- CITY COUNCIL Corpus Christi, Texas Gentlemens For the reasons set forth in the emergency clause of the fore- going ordinance, a .public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is. introduced, or at the present meeting of the City Council.
