AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER
FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI TO EXECUTE A CONTRACT WITH HELDEN-
FELS BROTHERS FOR THE PURPOSE OF CONSTRUCT-
ING AND INSTALLING CERTAIN IMPROVEMENTS ON
THE PEOPLES STREET T -HEAD ON A PORTION OF
TIE BAYFRONT, THE BREAKWATER AND SEAWALL
CONSTRUCTION PROJECT, MORE PARTICULARLY
DESCRIBED HEREIN, BY THE CONSTRUCTION OF
CURBS, WALKS, WATER LINES AND FILL -SOIL AS
SET OUT IN PLANS AND SPECIFICATIONS, A
COPY OF WHICH IS ATTACHED HERETO AND MADE
A PART HEREOF; AND APPROPRIATING OUT OF
FUND NO. 258 SEAWALL AND BREAKWATER CON-
STRUCTION FUND THE SUM OF $15,275.26, WHICH
SUM INCLUDES $13,886.60 CONTRACT CONSTRUC-
TION COSTS AND TIM, FURTHER SUM OF $1,388.66
ENGINEERING AND CONTINGENCY COSTS; AND
APPROPRIATING THE SUM OF :5,865.58 OUT OF
FUND NO. 296 IMPROVEMENT BONDS - 1950 CON-
STRUCTION FUND - (PARK IMPROVEMENTS) WHICH
SUM INCLUDES THE AMOUNT OF .$4,877.80 CON-
TRACT COSTS AND THE SUM OF $487.78 FOR
ENGINEERING AND CONTINGENCY COSTS; AND
DECLARING AIC EMERGENCY.
WHEREAS, The filling on the Peoples Street T -Head of the
City of Corpus Christi is rapidly deteriorating through the effect
of the elements thereon, especially the rains and winds; and
WHEREAS, It is imperative that protective measures be
taken immediately to protect the filling of said T -Head from fur-
ther erosion and deterioration; said T -Head being part of the
seawall and storm protection improvements of the City of Corpus
Christi, Texas; and
WHEREAS, A portion of the improvements necessary to be
made as protective measures was completed by improvements provided
in Ordinance No. 2733; and
WHEREAS, It is necessary to appropriate the amount to be
paid in consideration for the construction of such improvements;
and
WHEREAS, Bids having been submitted, considered, and an
award made for the most advantageous bid to the City of Corpus
Christi, it now becomes necessary to enter into a contract for

construction of certain improvements on the aforementioned area;
NOIT, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby author-
ized and directed to, execute for and on behalf of the City of
Corpus Christi a contract for the construction of said improve-
ments on the Peoples Street T -Head, as described in contract docu-
ments hereinafter mentioned, with Heldenfels Brothers of Nueces
County, Texas, which contract has been awarded in accordance with
plans, specifications and contract documents on file in the office
of the City Secretary, all of which are made a part hereof by
reference, and according to the bid of said Heldenfels Brothers
opened on the 18th day of July, the said bid of fl ldenfels Brothers
being the lowest and most advantageous to the City of Cox-pus
Christi, Texas.
SECTION 2. There is hereby appropriated out of Fund
No. 285, Seawall and Breakwater Construction Fund, the sum of
Fifteen Thousand Two Hundred Seventy -Five Dollars and Twenty -Six
Cents (315,275.26), out of which sum there is to be paid, according
to the terms of the contract described in Section 1 hereof, the
sum of Thirteen Thousand Eight Hundred Eighty -Six Dollars and Sixty
Cents ($23,886.60) to cover the costs of Items 1, 2 and 4 of the
said contract, and the balance of the Fifteen Thousand Two Hundred
Seventy -Five Dollars and Twenty -Six Cents of said appropriation is
an amount equivalent to the sum of Ten Percent (10 %) of said contract
price, which amount is hereby appropriated for the amount of engineer-
ing and contingency costs of said project.
SECTION 3. In addition to the appropriation provided
in Section 1 hereof, there is hereby appropriated out of Fund No. 296,
Improvement Bonds 1950 Construction Fund (Park Improvements), the sum
of Five Thousand Ei zht Hundred Sixty -Five Dollars and Fifty -Eight
Cents, out of which sum there is to be paid, according to the
terms of the contract described in Section 1 hereof, the sum of
Four Thousand Eight Hundred Seventy -Seven Dollars and Eighty Cents
($1,877.80) in payment of items 3 and 5 described in said contract;
the balance of the Five Thousand Eight Hundred Sixty -Five Dollars
and Fifty -Eight Cents of said appropriation is the amount equivalent
to Ten Percent of said contract price for said items, which amount
is hereby appropriated for the payment of engineering and contingency
costs of said items in said project.
SECTION 4. The necessity of maintaining adequate
storm protection improvements and the imperative need to take
measures to protect the filling of said T -Head as a part of such
storm protection improvements from further erosion creates a
public emergency and imperative public necessity requiring the sus-
pension of that certain Charter rule that no ordinance or resolution
shall be passed finally on the date it is introduced and that such
ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor, having declared that such emergency
and necessity exist, requesting that such Charter rule be suspended
and that this ordinance be passed finally on the day it is intro-
duced and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
