AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER
FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI TO EXECUTE A CONTRACT WITH BELDEN-
FEW BROTHERS FOR THE-MOM OF CO SMOM

WIN THE PLANS AND SPECIFICATIONS ATTACHED
HERETO AND MADE A PART HEREOF; AND APPROP-
RIATING THE SUM OF $41,800.00 OUT OF FU

ENGINEERING AND CONTINGENCY COSTS; AND
DECLARING AN EMERGENCY.
WHEREAS, The present capacity of the Oso Sewage Treat-
ment Plant is over -taxed and in need of enlargment, and it is
necessary to make appropriation out of the proper fund for the
payment thereof and to enter into a contract for the construction
of said enlargement; and
WHEREAS, Bids have been received, considered, and an award
made for the most advantageous bid to the City of Corpus Christi,
Texas, and it is now necessary to authorize the execution of a
contract in accordance with said award;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized
and directed to execute for and on behalf of the City of Corpus
Christi a contract for the construction of said enlargement of the
Oso Sewage Treatment Plant as described in contract documents here-
inafter mentioned, with Heldenfels Brothers of Nueces County, Texas,
which contract has been awarded in accordance with plans, specifica-
tions and contract documents on file in the office of the City Secre-
tary, all of which are made a part hereof by reference, and according

to the bid of said Heldenfels Brothers opened on the 18th day of
July, the said bid of Heldenfels Brothers being the lowest and most
advantageous to the City of Corpus Christi, Texas.
SECTION 2. That there is hereby appropriated out of Fund
No. 299 - 1950 Sanitary Sewer Improvement Fund the sum of $hl,800.00,
out of which fund there is to be paid according to the terms of the
contract described in Section 1 hereof the sum of $38,000.00, and
the balance of said appropriation is the amount equivalent to ten
percent of said contract price, which amount is hereby appropriated
for the payment of engineering and contingent costs of said project.
SECTION 3. The necessity for enlarging the Oso Sewage
Treatment Plant in order to protect the health and general welfare of
the citizens of Corpus Christi, Texas, ,creates a public emergency and
imperative public necessity requiring the suspension of that certain
Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and the
Mayor, having declared that such emergency and necessity exist, re-
questing that such Charter rule be suspended and that this ordinance
be passed finally on the date it is introduced and take effect and be
in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED.

for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City

and such money is not appropriated for any other purpose.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
