AN ORDINANCE APPROPRIATING $79,613.32 TO BE PAID AS_CONSIDERATION FORASPHALT SURFACE TREATMENT ON 8.9 MILES OF STREETS AND SHELL BASE COURSE ON 14.2 MILES. OF STREETS IN THE CITY OF CORPUS CHRISTI, TEXAS, FROM.FUND No. 296 IMPROVEMENT, BONDS 1950 CONSTRUCTION FUND (STREET IMPROVEMENTS); AUTHORIZING AND DIRECT- ING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS.CHRISTI TO EXECUTE A CONTRACT WITH HEGDENFELS BROS. FOR SAID PROJECT; MAKING SUCH CONTRACT DOCU- MENTS AND PLANS AND SPECIFICATIONS A PART HEREOF BY REFERENCE;- AND.DECLARING AN EMERGENCY. WHEREAS, Certain improvements have been de- termined to be necessary; and WHEREAS, There are sufficient funds unappropri- ated in No. 296 Improvements Bonds 1950 Construction Fund (Street Improvements) from which appropriation for the payment for said improvements may be made; and WHEREAS, Bids have been received, considered, and an award made for the most advantageous bid to the City of Corpus Christi, Texas; and WHEREAS, It is now necessary to make such ap- propriation and to authorize the execution of a contract in accordance with said award; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby, appropriated out of Fund No. 296 Improvement Bonds 1950 Construction Fund (Street Improvements) the sum of X79,613.32, out of which there is to be paid according to the terms of the contract described in Section 2 hereof the sum of 072,375.75 as the contract price therefor, and the balance of said appropriation is the amount equivalent to ten per cent (10 %) of the said contract price, which amount of $7,237.57 is hereby appropriated for the payment of en- gineering and contingent costs of said project. SECTION 2. That the City Manager is hereby authorized and directed to execute, for and on behalf of the City of Corpus Christi, a contract £ or the as- phalt surface treatment of 8.9 miles of streets and shell base course on 14.2 miles of streets in the City of Corpus Christi, Texas, withHeldenfels Bros., Inc. of the City of Corpus Christi, Texas, which contract has been awarded said Heldenfels Bros., Inc., in ac- cordance with plans and specifications and contract documents on file in the office of the City Secretary, all incorporated herein and made a part hereof by re- n ference, and according to the bid of said Heldenfels Bros., Inc. opened on the 24th day of July, 1950, the said bid of Heldenfels Bros. being the lowest and most advantageous bid to the City of Corpus Christi, Texas. SECTION 3. The necessity for providing for the maintenance of our City streets to protect the gen- eral welfare and safety of the public creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed finally on the date it is introduced and take effect and be in full force and effect from and after its passage, IT IS AC- CORDINGLY SO ORDAINED.
