SECTION 5a, PROVIDING FOR LEAVE-OF ABSENCE FOR MILITARY SERVICE FROM THE EMPLOYMENT OF THE CITY, STATING,THE_TERMS AND CONDITIONS UNDER WHICH,LEAVE OF ABSENCE WILL.BE GRANTED AND THE CONDITIONS OF RE- INSTATEMENT, PROVID- ING FOR NO PAYMENT FOR ACCUMULATED VACATION TIME OR ACCUMULATED SICK LEAVE DURING LEAVE OF ABSENCE FOR MILITARY SERVICE, PROVIDING FOR SENIORITY CREDIT DUR_ING,ABSENCE,.PRO- VIDING FOR.NO ACCRUAL OF SICK LEAVE OR VACA- TION TIME DURING.LEAVE OF ABSENCE; AND DE- CLARING AN EMERGENCY. WHEREAS, It is now proper and necessary for employees and officers of the City of Corpus Christi to enter military service, and it is desirable that their existing employment and position be open for reinstate- ment of such employee upon return from such military ser- vice; and WHEREAS, The Rules and Regulations of the Civil Service Board of the City of Corpus Christi contain no provision for leave of absence for military service, it is desired that the same be amended so as to include such amendment; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That Article 11 of the Rules and Regulations of the Civil Service Board be amended by the addition of a section to be known and numbered Article 11 Section 5a, reading as follows: "Article 11, Section 5a. MILITARY LEAVE OF ABSENCE: In time of war or national em- ergency, any permanent employee in the classi- fied serkicewho leaves a position to serve in the armed forces of the United States shall be granted a military leave of absence without pay, . t and shall be eligible for reinstatement to his former position, or its equiva- lent, and at thethen current rate of pay, upon presentment to the Civil Service Board of a certificate of honorable dis- charge within ninety (90) days after his discharge, provided such employee be ptiysi -- cally and mentally qualified for reinstate- ment, and further provided his service with the armed forces began at or about the time he left the City's employment therefor. At the time of his reinstatement he shall re- ceive full seniority credit for the time he was absent for military service. If upon termination of such leave of absence, the employee is physically or mentally incapaci- tated and not qualified to perform the duties of the position held by the employee at the time of the commencement of such absence, he shall, nevertheless, be eligible for placement in such other position for which he may be qualified. No payment for ac- cumulated vacation time or sick leave shall be made upon the granting of any such leave of absence and no additional credit of either vacation time or sick leave shall accrue dur- ing absence;t?ut, the status as of the time of beginning of such leave shall be resumed upon reinstatement." SECTION II. The:..fact that the Authority granted herein to the Civil Service Board is immediately necessary for the efficient administration of the classified Civil Service of this City in that it necessary and proper at this time for employees and officers of the City of Corpus Christi to enter military service and it is necessary that certain standards be had and maintained at all times creates an emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the day it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, declar- ing that such emergency and necessity do exist, requesting that such Charter rule be suspended and that this ordinance be passed fonally on the day it is introduced and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
