AN ORDINANCE
APPROPRIATING $143,433.01 FROM N0. 299 BOND IM-'
PROVEMENTS 1950 CONSTRUCTION FUND (SANITARY SEWERS)
TO BE PAID AS CONSIDERATION IN THE CONSTRUCTION OF
SANITARY SE"JER MAINS AND LATERAL EXTENSIONS IN
CARROLL LANE PARK SUBDIVISION, KATiM CARROLL SUB-
DIVISION, GOCHER SUBDIVISION, HOUSTON STREET, NEWTON
STREET, HORNE ROAD, KOSTROYZ ROAD, GOLLIHAR ROAD,
COTTAGE STREET, HOLLYWOOD TERRACE, PORT AVENUE,
AYRES STREET, EDGEWATER TERRACE, AND A PORTION OF
ALAMEDA STREET; AUTHORIZING AND DI.RECTING THE CITY
MANAGER FOR AND ON BEHALF OF THE CITY TO EXECUTE A
CONTRACT WITH T. H. LEE, CONTRACTOR, FOR THE CON-
STRUCTION OF SAID IMPROVEMENTS; MAKING THE CONTRACT
DOCUMENTS, PLANS AND SPECIFICATIONS A PART HEREOF
BY REFERENCE; AND DECLARING AN EMERGENCY
WHEREAS, Certain improvements have been determined to be
necessary, and it is necessary to make appropriations out of the
proper fund for the payment thereof and to enter into a contract
for the construction of said improvements; and
WHEREAS, Bids have been received, considered and an award
made for !he most advantageous bid to the City of Corpus Christi,
Texas, and it is now necessary to make such appropriation and to
authorize the execution of a contract in accordance with said award;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated out of Fund
No. 299 Improvement Bonds 1950 Construction Fund (Sanitary Sewer im-
Provements) the sum of $1433433.01, out of which amount there is to
be paid according to the terms of the contract described in Section
2 hereof the contract price of $130,393.65, and the balance of said
appropriation is the amount equivalent to ten per cent of said contract
price, which amount of $13,039.36 is hereby appropriated for the pay-
ment of engineering and contingent costs of said project.
SECTION 2. That the City Manager is hereby authorized and
directed to execute for and on behalf of the City of Corpus Christi
a contract for the construction of Sanitary sewer mains and laterial
extensions in Carroll'Lane Park Subdivision, Kathryn Carroll Subdivi-
sion, Gocher Subdivision, Houston Street, Newton Street, Ha=e Road,
Zg�{
Kostory� Road, Gollihar Road, Cottage Street, Hollywood Terrace, Port
Avenue, Ayres Street, Edgewater Terrace, Alameda Street in the City
of Corpus Christi, Texas, with T. H. Lee, Contractor, in accordance
with the contract documents, plans and specifications on file in
the office of the City Secretary, all of which are incorporated here-
in and made a part hereof by reference, which contract has been award-
ed said T. H. Lee according to the low bid of said T. H. Lee opened
on the 25th day of July, 1950, and using the base bid on vitrified
tile pipe in sizes 6" and through 1211 in diameter, and using the
treated concrete pipe in the larger sizes at greater depths where
the temperature would not be excessive and only in the wide street
right -of -ways which is covered by using Items 35 Alternate and 36
Alternate bid only; the said bid of T. H• Lee being the lowest and
most advantageous to the City of Corpus Christi, Texas.
SECTION 3. The necessity for providing adequate sanitary
sewer improvements in the City of Corpus Christi to protect the health
and general welfare of its citizens creates a public emergency and an
imperative public necessity requiring the suspension of the Charter
rule providing that no ordinance or resolution shall be passed final-
ly on the day it is introduced and that such ordinance or resolution
shall be read at three several meetings of the City Council, and the
Mayor, declaring such emergency and necessity to exist, having request-
ed such Charter rule be suspended and that this ordinance be passed
finally on the day it is introduced and that it take effect and be
in full force and effect from and after its passage, IT IS SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a .public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
