Read Gabe Lozano, Sr. Edward Sample Mayor Luby called the meeting to„order and stated the purpose of the Special Meeting was to hold public hearings on'zoning applications and any other business as may properly come before the Council. City Secretary Read noted that a quorum of the Council and required ; Charter Officers were present to conduct a valid meeting. } Assistant City Manager Walker presented Application 975-1, Poindexter & Wharton Sales Corporation, for change of zoning from "A-1” Apartment House District and a Special Permit to "B-1" Neighborhood Business District on Lots 11, 12, & 13, x p Block B, Diaz Addition, located on the south side of Winnebago Street east of Brownlee Boulevard. Chief Planner Larry Wenger gave background information on the case and showed pictures of the area. He stated that under special permits granted in 1970 and 1972 the applicant was permitted to operate a convenience store and Laundromat but that the Laundromat was not in operation at this time due to a fire in that part of the building some time ago. The applicant now wishes to open a lounge in the part of the building which used to be the Laundromat, and still operate the adjoining convenience store. A request for "B-1" was denied on August 6, 1975. Chief Planner Wenger stated that the Planning Commission recommended approval at its September 2 meeting but that the staff's recommendation is that it be denied because they feel that a convenience store and Laundromat serves the needs for that area and that the site plan of 15 parking spaces is satisfactory for those uses but'6 additional off-street parking spaces would be needed for the club, and there is only room for the present 15 spaces. Mayor Luby inquired if the lounge is in operation now. Chief Planner Wenger replied that the convenience store is presently in business and that he has heard reports both ways with regard to the lounge and is not sure. The applicant, Mr. Poindexter, presented signed petitions to the Council and stated that Winnebago Street where his business is located is the main thorough- fare for their community and they are trying to build it up. He stated that the Minutes -Special Council Meeting October 1, 1975 Page 2 Corpus Christi Economic Development Corporation is willing to work with them; that they wish to acquire more land and start up other minority businesses along Winnebago. He explained that there is no place for young adults in their neighborhood to go; that they want to keep them in their community and away from other, more dangerous portions of the City. He reported that at the present time these young adults between the ages of 18 and 25 enter his store to purchase beer and wine and then stand out along the street drinking, and that sometimes as many as 50 to 80 young people gather there. He stated that denying them a place inside to drink and enjoy themselves is keeping them in the streets drinking, and that by having them inside his building in his club he would be able to control them. Mr. Poindexter also pointed out to the Council that the level of unemploy- ment is very high in that area now and that the kids need something to do and some place to go. He told the Council that they had helped him build booths and redecorate the inside of the property and that they now felt like it was theirs too; that they were proud of it and would take care of it. Mr. Poindexter reported that the proposed club had a seating capacity of 68 and that he only plans to sell beer and wine in the lounge. He stated that he did not expect any increase in the number of cars parked there with the opening of the club because most of his customers live in the neighborhood and would walk there. Miss Hulen Avery, 1501 Van Loan, appeared before the Council. She is an employee of the Mental Health -Mental Retardation Community Center, but spoke as a resident and outreach worker in that community. She said she believes that people need some feeling of success by being able to own something. She stated that every- thing in that community is owned by white absentee landlords, and she is in favor of the application. Mr. George Hamilton, Jr., of the First Afro Development Corporation, stated that his corporation is concerned with development of this area and that property owners in this area are willing to sell their properties but are concerned with whether or not there is going to be a lot of opposition when they come requesting a zoning change. They feel that some of the requirements for zoning should be waived in this area because it is a small area with limited space without a nice business district. He stated he favored the application. Mr. Eldridge Sneed, who is going to be the manager of the club, spoke in favor of the application on behalf of the young people in the neighborhood who need Minutes :Special Council Meeting October 1, 1975 Page 3 some place to go rather than drinking in the streets. Mr. Donnie Mazone, 1705 Sycamore, pointed out that the nearby apartment complex does not have adequate parking and stated that he was in ''avor of the application. Mr. Clyde Vary (?) spoke on behalf of Joe Wharton, a partner in the corporation. He stated that he has known Mr. Wharton for a number of years, that he worked with him, and he is sure he will be able to control the business there in the neighborhood. Minister Eddie 2X O'Neal, of the Muhammad's Temple of IAam, spoke in favor of the application. Mr. Roosevelt Porter, 1114 Sam Rankin, spoke as a community organizer in favor of the application. Commissioner Tipton asked Mr. Poindexter what would restrict him from going to the Liquor Board and getting a permit to serve mixed drinks if he was granted this zoning. Mr. Poindexter replied that nothing would, but that he does not intend to at this time. Mrs. Cruz Colomo, 1733 Sun Beam, spoke in favor of the application. Mr. Poindexter stated that he could control the young adults inside his place and that they respect him. Mr. Poindexter was then asked what would happen if he moves away and someone else takes over the business. He replied that he has no intention of leaving Corpus; that he has been here for a number of years and is establishing businesses here and wants to help the community grow. No one appeared in opposition to the foregoing application. Motion by Sample, seconded by Tipton and passed, that the hearing be closed. 1 Motion by Sample, seconded by Gill and passed, that the recommendation of the Planning Commission be concurred in and Application #975-1, Poindexter & Wharton Sales Corporation, for change of zoning from "A-1" Apartment House District and a Special Permit to "B-1" Neighborhood Business District on Lots 11, 12, & 13, Block B, Diaz Addition, located on the south side of Winnebago Street east of Brownlee Boulevard be approved and an ordinance be brought forward effectuating the change. Commissioner Gulley suggested that a time limit be placed on an application before it can be resubmitted for rezoning. Assistant City Attorney Coffin thinks the Council and Planning Commission could adopt such a proposal. He stated that at Minutes Special Council Meeting October 1, 1975 Page 4 one time it was determined at the staff level that six months would be appropriate and a proposal was prepared and submitted but a recommendation never came forth from the Planning Commission. A time limit will be considered. Assistant City Manager Walker presented Application #975-2, Benita L. Lopez, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District, on Lot 8, Block 4, Gollihar Park #2, located on the northeast corner of Delgado and Salazar Street, and gave background information on the applica- tion. He stated that in response to this hearing one letter had been returned in favor of the application and none had been received in opposition. He stated the of recommendation / the Planning Commission is that it be denied and the staff also recommended denial. The applicant, Mrs. Benita L. Lopez, explained that she had taken a course in flower arranging and now wished to do flower arrangements as a small business in her home and would like to have a small sign in front of her house. She stated that she delivers some orders but that most people call in their order and drop by to pick it up, so there wouldn't be a lot of traffic through the neighborhood or in her house. Mr. Martin Lopez appeared in favor of the application. No one appeared in opposition to the foregoing application. Motion by de Ases, seconded by Sample and passed, that the hearing be closed. Motion by de Ases, seconded by Sample and passed, that Application #975-2, Benita L. Lopez, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Nieghborhood Business District, on Lot 8, Block 4, Golliha- Park #2, located on the northeast corner of Delgado and Salazar Street be denied, but in lieu thereof a special permit be granted restricting her from having any outdoor signs and making no change in the exterior of the home, subject to an acceptable site plan. Mrs. Lopez stated the special permit would be acceptable. Assistant City Manager Walker presented Application #975-3, Billy Joseph Henry, for change of zoning from "B-1" Neighborhood Business District to "B-3" Business District on the southwest half of Lot 22, Block 2, Mahan Acres Addition, located on the east side of Kostoryz Road 107.5 feet north of McArdle Road. He outlined the application and stated that the proposed change of zoning would allow more intense uses and larger signs. The Planning Commission recommends that it be approved; the staff recommends that it be denied. Miu,utes Special Council Meeting October 1, 1975 Page 5 The applicant, Billy Joseph Henry, stated that he is a plumber doing mostly repair work. He explained that this site will mainly be an office and storage space for his parts although some cleaning and repair work will be done in the building and some customers may stop by to pick up a part. He emphasized that most of his repair work is out in the field and that his repair trucks leave before 8:00 a.m. and return at 5:00 or 5:30 p.m. each day so he does not foresee a heavy increase in traffic in that area. No one appeared in opposition to the foregoing application. Motion by Tipton, seconded by Sample and passed, that the hearing be closed. Motion by Tipton, seconded by Sample and passed, with Gill voting "Nay", that the recommendation of the Planning Commission be concurred in and Application #975-3, Billy Joseph Henry, for change of zoning from "B-1" Neighborhood Business District to "B-3" Business District on the southwest half of Lot 22, Block 2, Mahan Acres Addition, located on the east side of Kostoryz Road 107.5 flat north of McArdle Road be approved and an ordinance be brought forward effectuating the change. Assistant City Manager Walker stated that on Application #975-4, Corpus Christi Construction Company, Inc., for change of zoning from "R -1B" One -family Dwelling District to "RE" Residential Estate District, on a 96.084 -acre tract out of Lots 1, 2, 3, 4, 5 & 6, Section 52, Flour Bluff & Encinal Farm & Garden Tracts, located south of Mediterranean Drive commencing 220 feet east of Waldron Road, they had received a request from the applicant that it be postponed until October 22, due to the fact that the applicant had been unable to get the plat on the case approved ,by the Planning Commission because the Planning Commission did not have a quorum at their meeting last night. Council agreed to recess the hearing. Two adjoining property owners expressed concern because they want access to their property, and there only exists a 25' easement there. Mayor Luby stated that the Council will open up with this hearing first at the October 22, 1975 meeting. ORDINANCE NO. 12835 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDI- NANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF POINDL"_TER & WHARTON SALES CORPORATION BY AMENDING THE ZONING MAP BY CHANGING THE ZONING 'JN LOTS 11, 12 AND 13, BLOCK B, DIAZ ADDITION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "A-1" APARTMENT HOUSE DISTRICT AND A SPECIAL PERMIT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
