AN ORDINANCE
DEFINING LIQUCRj PROHIBITING ESTABLISHMENTS
SELLING LIQUOR FROM PERMITTING ROOM OR ROOMS
IN TEICH LIQUOR IS STORED OR KEPT FOR SALE FROM
BEING OPEN TO THE PUBLIC DURING THE HOURS IN
TEICH ITS SALE IS PROHIBITED BY THE "TEXAS
LIQUOR CONTROL ACT ", PROVIDING A PETTALTYj CON-
TAINING A SAVINGS CLAUSE] REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; AND PROVIDING FOR
THE METHOD OF PUBLICATION; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEYAS:
SECTION 1. Definition. Wherever the word "liquor" is used
in this ordinance, it shall mean and refer to any alcoholic beverage
containing alcohol in excess of four per cent by weight, unless other-
wise indicated.
SECTION 2. Prohibition of Establishments Selling Liquor From
Permitting Room or Rooms in Which Liquor Is Stored Or Kept For Sale From
Being Open to the Public During the Hours in Which the Sale of Liquor Is
Prohibited by the "Texas Liquor Control Act." No owner, manager, pro-
prietor or employee of any establishment permitted to sell liquor within
the city limits of the City of Corpus Christi, shall permit the room or
rooms where liquor is stored or kept for sale to be open or unlocked to
the public during the hours in which the sale of liquor is prohibited
by the "Texas Liquor Control Act ".
SECTION 3.. Penalty for Violating This Ordinance. Any person,
firm, partnership, corporation, association or society violating any pro-
visions of this ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not less than
Five (85.00) Dollars nor more than Two Hundred ($200.00) Dollars, and
each day such violation continues shall constitute a separate offense.
Each act done in violation of this ordinance or any provision thereof
shall constitute a separate offense, and upon conviction be punishable
as such. In case the liquor establishment which shall violate this
ordinance or any provision thereof be a corporation, than in that event,
the president, vice - president, secretary, treasurer, or any manager,
agent, employee or other legal representative shall be severally liable
to the penalty- herein provided.
SECTION 4, If any section, or the,provisions of any section
of this ordinance shall be declared to be void, ineffective or uncon-
stitutional for any cause whatsoever, the holding of any section or
provision of any section to be void, ineffective or unconstitutional for
any cause whatsoever shall not affect the validity of the remaining
sections and provisions of this ordinance.
SECTION 5, All ordinances or parts of ordinances, including
any and all amendments, in conflict herewith shall be hereby repealed.
SECTION 6. This ordinance shall become effective September 1,
1950, after its publication in the official publication of the City of
Corpus Christi one time, and such publication shall be sufficient if it
contains the caption setting forth the purpose of this ordinance and
the penalty clause herein contained.
SECTION 7. The fact that establishments selling liquor are
being operated within the corporate limits of the city without sufficient
regulation during the hours in which the sale of liquor is not permitted
by the "Texas Liquor Control .Aot" to the detriment of the general welfare
of the citizens of Corpus Christi creates a public emergency and imperative
public necessity requiring suspension of the charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction&

and that said ordinance shall be read at three several meetings of
the City Council, and the Mayor having declared that such emergency
and imperative public necessity exist, and requested said oharter rule
be suspended and that this ordinance be passed finally on the date of
its introduction and take effect and be in full force from and after
its passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at .three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
