AN ORDINANCE
CLOSING THAT PORTION OF RABBIT RUN ROAD EX-
TENDING FROM THE EAST BOUNDARY OF PORT AVE-
NUE TO SOUTH BOUNDARY OF MORGAN STREET; ALL
OF SAID STREET AS CLOSED BEING IN THE CITY
OF CORPUS CHRISTI; AND DIRECTING THAT THE
SAID CLOSING BE ONLY FOR THE LIMITED PURPOSE
OF CLOSING SAID PORTION OF RABBIT RUN ROAD
TO TRAFFIC AND TO THE EXISTENCE AND MAINTEN- ✓
ANCE OF SAID STREET, SAVE AND EXCEPT THAT
PORTION TO BE USED AS UTILITY EASEMENT AND
RELINQUISH ALL TITLE THERETO; AND DECLARING
AN EMERGENCY.
WHEREAS, The City Council of the City of Corpus Christi has
been petitioned that a portion of Rabbit Run Road hereinafter described,
be closed for street purposes; and,
71HERF.AS, Notice of the proposed closing of said street
has been given by publication and by mail to the last known address
of all owners abutting said street and within 450 feet therefrom, in
accordance with the Charter of the City of Corpus Christi as provided
for under Article II, Section 6 thereof; and,
WHEREAS, in accordance with the Notice given as above set out,
a public hearing was held by the City Council of the City of Corpus
Christi at Wo o'clock P. M. on the 1st day of August, 1950, in the
City Council Chamber at the City Hall, and,
WHEREAS, the public welfare, safety, convenience and necessity
will be better served by the closing of certain portions of said street
to traffic and to the existence and maintenance of said street; SAVE AND
EXCEPT as a right -of -way for public utility easement or easement or other
municipal purposes.
NOW, THEREFORE, BE IT ORDAINID`BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:

SECTION 1. That a portion of Rabbit Run Road described as follas:
BEGINNING At a point, the south corner of the S. D. Roberts
Tract, being the intersection of the east boundary line of
Port Avenue and the northwest boundary line of Rabbit Run
Road for a corner of this tract;
THENCE N 28 deg.. 201 E with the northwest boundary line
of Rabbit Run Road a distance of 167.97 feet to a point in
the south boundary line of Morgan Avenue for a corner of
this tract;
THENCE N 88 deg. 45, E with the south boundary line of
Morgan Avenue a distance of 47 plus or minus feet to a point
in the northwest boundary line of lot 14, Block 1 of the Roosevelt
Place, an addition to the City of Corpus Christi as shown by map
or plat of record in Volume 8 page 7 of the Map Records of
Nueces County, Texas for a corner of this tract;
THENCE in a southwesterly direction with the are of a curve
having a radius of 30 feet and a central angle of 60 deg. 15,
a distance of 5.5 plus or minus feet to the point of tangent
to said curve;
THENCE S 28 deg. 201 W with the southeast boundary line
of Rabbit Run Road a distance of 225.79 feet to a point, the
point of curve of a circular curve to the left having a radius
of 30 feet and a central angle of 119 deg. -30';
THENCE with said curve to the left a distance of 62.57 feet
to a point in the north boundary line of Segrest Street for a
corner of this tract;
THENCE S 88 deg. 451 W a distance of 10 feet to the point
of curve of a circular curve to the right having a radius of
30 feet and a central angle of 89 deg. 431;
THENCE along said curve to the right a distance of 46.98
feet to a point, being the point of tangent to said curve;
THENCE N 0 deg. 58' W a distance of 72 plus or minus feet
to the PLACE OF BEGINNING; SAVE AND EXCEPT a strip of land
10.feet in width and 46 feet in length, more particularly de..
scribed by metes and bounds as follows:
BEGINNING at a point in the east boundary line of Rabbit
Run Road being also the west boundary line of Lot 15, Block
1 of the Roosevelt Addition to the City of Corpus Christi,
as shown by map or plat recorded in Volume 82 page 7 of the
Map Records of Nueces County, Texas, said point bears S 28 deg.
201 W 5.75 feet from the Northwest corner of said Lot 1�;
THENCE S 88 deg. 45' W crossing Rabbit Run Road a distance
of 46 feet to a point in the west boundary line of Rabbit Run
Road for the southwest corner of this description;
THENCE N 28 deg. 201 E with the west boundary line of
Rabbit Run Road a distance of 11.50 feet to a point for the
northwest corner of this description,
THENCE N 88 deg. 45' E crossing Rabbit Run Road a dis-
tance of 46 feet to a point in the east boundary line of
Rabbit Run Road for the northeast corner of this description;
THENCE S 28 deg. 201 W along the east boundary line of
Rabbit Run Road a distance of 11.50 feet to the place of
beginning,
be and the same is hereby closed to the public.
„ SECTION 2. That the City of Corpus Christi hereby releases and
relinquishes all right, title and interest in or to any of said street
described in SECTION 1 hereof to the property owners abutting said street
and the same shall revert to said owners; SAVE AND EXCEPT that strip of
land 10 feet in width and 46 feet in length more particularly described
by metes and bounds as follows:
Beginning at a point in the east boundary line of Rabbit
Run Road beingalso the west boundary line of Lot 15, Block 1

of the Roosevelt Addition to the City of Corpus Christi, as
shown by map or plat recorded in Volume 8, Page 7 of the Map
Records of Nueces County, Texas, said point bears S 280 20' W
5.75 feet from the northwest corner of said Lot 15.
Thence S 880 45' W crossing Rabbit Run Road a dis-
tance of 46 feet to a point in the west boundary line of Rabbit
Run Road for the southwest corner of this description;
Thence N 280 2D' E with the west boundary line of
Rabbit Run Road a distance of 11.50 feet to a point for the
northwest corner of this description;
Thence N 880 45' E crossing Rabbit Run Road
a distance of 46 feet to a point in the east boundary line
of Rabbit Run Road for the northeast corner of this descrip-
tion;
Thence S 280 20' W along the east boundary line
of Rabbit Run Road a distance of 11.50 feet to the place of
beginning
for the use of the same as an easement for public utilities and storm
sewer and drainage purposes, and the dedication thereof is not vacated
and the same is hereby retained for all such purposes.
SECTION 3. The fact that public convenience and necessity
will be better served by the closing of said street as a public thorough-
fare creates a public emergency and a public imperative necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance
or resolution shall be read at three several meetings of the City Council;
and the Mayor, having declared that such public emergency and imperative
necessity exist, and having requested that such Charter Rule be suspended
and that this Ordinance be passed finally on the date it is introduced,
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or.requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
