HomeMy WebLinkAbout02846 ORD - 08/08/1950lruu iugGi : SY 8/7/50 (6) AN ORDINANCE CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF THE PROPERTY ABUTTING UPON PORTIONS CF CERTAIN STREETS WITHIN THE LIMITS DESCRIBED IN SECTION 3 OF ORDINANCE 2797, PASSED AND AP- PROVED ON THE 27th day of JTJNE, 1950, AND TO THE REAL AND TRUE OWNERS OF ANY RAILWAYS, STREET RAIL- WAYS AND INTERURBANS USING, OCCUPYING, OR CROSSING SAID STREETS AS TO SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND SAID RAILWAYS, STREET RAILWAYS, AND INTERURBANS AND THE REAL AND TRUE OWNERS THERE- OF BY VIRTUE OF THE IMPROVEMENT OF SAID STREETS, BY CONSTRUCTING SIDEWALIUi WITHIN THE LIMITS DEFINED AND AS TO ANY ERROR, INVALIDITY OR IRREGULARITY IN ANY OF THE PROCEEDINGS OR CONTRACT THEREFOR; OVERRULING AND DENYING ALL PROTESTS AND OBJECTIONS OFFERED EX- CEPT AS PERTAIN TO A REDUCTION AND ADJUSTMENT OF THE AMOUNTS „OF PROPE ING REDU AGAINST ING AND FR OPERTY WITHIN T AND COST OF HEREIN PROPERTY OF APOR OF SAID CHARGE SAID POR OWNER OR OF ASSIG ACCEPTAN MEET AND CCMPLETI DECLARD WHEREAS, Texas, heretofore termined the nece portions of cert ed in said ordin specifications he therefor, and a d in the name of sai Texas, on the 27th WHEREAS, Texas, after havin struction of said BE ASSESSED AGAINST THE SEVERAL PARCELS TY AS APPEARS HEREIN AND ORDERING AND GRANT - TION AND ADJUSTMENT IN SAID AMOUNT ASSESSED ARCELS OF PROPERTY AS HEREIN SET OUT; FIND - ETERMINING THAT EACH AND EVERY PARCEL OF ABUTTING UPON THi PORTIONS OF SAID STREETS LIMITS DEFINED WILL BE SPECIALLY BENEFITED ED IN VALUE IN EXCESS OF THE AMOUNT OF THE AID IMPROVEMENT AS REDUCED AND ADJUSTED POSED TO BE AND AS ASSESSED AGAINST SAID AND LEVYING AN ASSESSMENT FOR THE PAYMENT ICN OF THE COST OF IMPROVING SAID PORTIONS TREETS WITHIN THE LIMITS DEFINED; FIXING A LIEN AGAINST THE PROPERTY ABUTTING UPON ONS OF SAID STREETS AND THE REAL AND TRUE OWNERS THEREOF; PROVIDING FOR THE ISSUANCE ABLE CERTIFICATES UPON THE COMPLETION AND E OF SAID WORK; THE MANNER AND TDVS OF PAY - PROVIDING FOR THE MANNER AND METHOD OF N OF SAID ASSESSMENTS AND CERTIFICATES; AND AN EMERGENCY. he City Council of the City of Corpus Christi, on June 27th, 1950, by duly enacted ordinance de- ity for and ordered the improvement of certain streets within certain limits as fully describ- e in.the manner and according to the plans and tofore approved and adopted by the City Council executed Notice of said ordinance was filed City with the County Clerk of Nueces County, day of June, 1950; and aid City Council of the City of Corpus Christi, advertised for and received bids on the con - provements for the length of time and in the manner and form as required by the Charter of said City and the lawn of the State of Texas, and after having duly and regularly made appropriation of funds available for such purpose to cover the estimated cost to said City of said improvements, all as provided by the Corpus Christi City Charter and by law, did award a contract for the construction of said improvements to J. M. Dellinger, Inc., on ite lowest and most advantageous bid and said contract has been heretofore duly executed by said City of Corpus Christi, Texas, and J. M. Dellinger, Inc., and is dated June 27, 1950, and the perform anoe bond required by said oontract has been properly furnished and posted by said J. M. Dellinger, Inc., and accepted by said City Council of said City as to form and amount as required by the Charter of said City and the laws of the State of Texas; and WHEREAS, the said City Council has caused the said Direotor of Public Works to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against the property abutting upon said streets to be improved and against any railways, street railwakys, and inter- urbane using, occupying or crossing same, and the real and true owners thereof, and said Director of Public Works has heretofore filed said estimates and a statement of other matters relating thereto with maid Council, and same have been received and examined by said City Council; and WHEREAS, in order to facilitate the commencement of the oonetruction of the improvements contemplated by Ordinanoe No. 2797 which declared the necessity for such improvements and which was passed on the 27th day of June, 1950, and because the ownership . rolls of the various properties abutting upon the portions of the various streets as described in Ordinanoe No. 2797 were that immediately available, the City Council ordered that an assess- ment hearing be held and such hearing was properly held, after due and legal notice, and assessments were made against property abutting upon the portions of certain streets as desoribed in Ordinance No. 2797; and 11HEREAS, since the making of assessments on portions of certain streets as described in said Ordinance No. 2797, the owner- ship rolls of the various properties abutting upon the portions of the streets described in said Ordinance No. 2797 have been fully completed and are now presently available; and WHEREAS, it has been determined that portions of certain streets along and upon which it was originally contemplated that sidewalks would be placed, should be omitted entirely from the pro- ject because of defective descriptions and other good and auffieient reasons, and by agreement between the City and the contractor, the following portions of certain streets have been eliminated, to -wit: East side Clark Dr. from Roosevelt Dr. to Norton St. East side Logan Avenue from Normandy Drive to Florida Weet aide Logan Ave. from Normandy Drive to Florida Ave. West side Florida Ave. from Logan Avenue to York Avenue= WHEREAS, the City Council by duly enacted ordinance dated June 27, 1950, did determine the necessity of levying an assessment for that portion of certain streets as attached hereto and made a part hereof: -3« trot sido ta.arlor ea from olwatomtkoto to Tomo air. M. on the 3rd day of August, 1950, at the City Council Chamber of the City Ball, Corpus Christi, Texas, for the real and true owner or owners of the property abutting upon said streets within the limits above defined and of the railways, street railways and interurban using, occupying or crossing said streets and for all others owning or olaiming apy interest in or otherwise interested in said property and any of said matters as to the assessments and amounts to be assessed against each parcel of abutting property and each railway, street railway and interurban using, occupying, or crossing said streets and the real and true owner or owners thereof, and as to the special benefits to accrue to said abutting property and said railways, street railways, and interurbans by virtue of said improvements, if any, or concerning any error, in- validity, irregularity or deficiency in any proceedings or contract, to appear and be heard in person or by counsel and offer evidence in reference to said matters; and said City Council did, by said ordinanoe, order and direct the City Secretary of said City to give notice of said hearing to the real and true owners of the property abutting upon said streets within the limits defined and of said railways, street railways and interurban, by publication in the Corpus &:briati;;Cgkler- Tiwpe$ the official newspaper of the City of Corpus Christi, Texas, a newspaper published in the City of Corpus Christi, Texas, of general circulation, said notice to be published in said newspaper at least three times prior to the date of said hearing, the first publication of which to be at bast ten days prior thereto, all as provided for and in accordanoe with the provisions of said City Charter and of Chapter 106 of the Acts of the First Called Session of the lFOth Legislature of the State of Texas, known and shown as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas; and B'n'RAS, said notioe as ordered and directed by said City Council, and as required by said Acts and Charter of said City as above identified, has been duly given by publication of same in the Corpus Christi Caller- Time., a newspaper published in the City of Corpus Christi, Texas, on July 22, 1950, July 29, 1950, and July 31, 1950; and 9MEREAS, after due, legal, and proper notice thereof, all as provided by law and the Charter of the City of Corpus Christi, said hearing of which notioe was so given was opened on the 3rd day of August, 1950 at 2:00 otclook P. M. in the Council Chamber of the City Hall in the City of Corpus Christi, Texas, in accordance with said ordinance and the notice and a quorum being present, the hearing was held and the following appeared and offered testimony: - 5, Mayor Pro Tem Jack DeForrest asked the City Secre- tary, C. W. oetters to explain the purpose of the hearing. Mr. getters: "This meeting is held in order to give the real and true owners of property abutting on por- tions of certain streets proposed to be improved by the placing of sidewalks thereon the opportunity to be heard and offer testimony as to said assess nts, and to the amounts thereof, proposed to be assessed against said abut- ting property and the real and true owners thereof, and as to the special benefits to ea�'-d property to be received from said improvements. Also, whether or not such assess- ment program concerns any error, invalidity, irregularity, or deficiency in any proceedings or contracts, as well:: as any matter or thing connected with the construction of said sidewalks . " City Attorney, T. M. Singer* asked Mr. Harry Stirman, Director of Public Works, to explain the project. Mr. 3tirman: "This project covers the installation of sidewalks on the streets of the City of Corpus Christi, mainly over thoroughfares leading to schools and other public places. This whole project was set out ie the plans submitted by the PTA Committee and in the Notice of Public Hearing as published in the Caller -Times three times. These sidewalks will consist of concrete walks with steel dowel bars and ex- pension joints at approximately 40 foot spaces, 4° in depth and 4° in width, to the grades established by the engineer- ing departments. All of said improvements to be done in the manner and according to the plans and specifications therefor heretofore adopted and approved by the City Coun- cil, and the contract for said improvements, all of which have been filed with the City Secretary. The sidewalks are to be located one foot back from the property line, but it may in some instances be necessary to vary this to save personal improvements, or for other reason; however, this PAGE 2 project will involve the removal of some shrubs and so forth." Mayor Pro Tim called for thos present to appear in order left to right from front to back, and the follow- ing appear: D. W. MEM, 3737 Mueller, or Leopards "My name is 0. W. Kushm and Hive at 3737 Mueller. I am speaking for about four or five families who live in that block, and we have some objections to the placing of sidewalks at the present time. In the first place, we feel that it le almost useless to put in sidewalks until you can Iv* us better drainage. Oak Park School has fill -in shell in front of school, and there is a place in front of the school where it has obstructed the flow of water and it stands 15 or 16 inches deep when it rains. If sidewalks are put Sin, the water will stand 12 inches above the side- walk when it rains. They,- would be of small benefit to the children when it rains. "In the second place, they are placing the sidewalks on the wrong side of the street. Now take Dr- coil Village; the sidewalks should run on that side for the reason that by putting them in on our side of the street you are making three hazardous crossings to get to the sidewalk, where you wouldn't if you put them on that side, but would have only one crossing. Why penalise us? Why not let the subdivider of Driscoll Village put in sidewalks on their share or carry half of the expense? Thsv have built their houses 6 to 8 feet from the street. I would be willing to put sidewalks in if they share one -half of the expense. Also, there are three times as many children on the other side of the street as on ours. It is not fair." MRS. D. R. R VELLE, 3745 -49 leopard: (E.M.) "Our property adjoins Mr. Euehm's, and we have the same objeetions. Our houses are too close to the street as it is, and with sidewalks, we would have no front yard at all. In wet weather it would be useless to have sidewalks, too. Then, all the children core from Oak Park, not from our neighborhood. (Mrs. Reveile continued) "There is some discriminations Grant has built his houses so close together you eau hardly see between them, but when we built we tried to get permission to build back further on the lot. This property was after that rezoned and we can buii! a duplex on it. If we build a duple, can we he the walks." propert7 linet It would not leave rods for side- Mr. Colliers "Does your property front on the street ?" Mrs. Revell*: "No, but the children willcontimu to go across my backward to go to school." Mr. Collier: "All houses in Driscoll Village are required to build sidewalks on front of property; it is their side property that is without sidewalks. Mr. Lsuha: "Can I put in sidewalks if I meet speei- fications4" Mr. Singer: "As a legal matter lien has been fixed, but if it is a homestead there is no lien create*. If you have already put sidewalks in, there would be no necessity for putting them in. That is, if it cosplys with grading and specifications of the engineering estimates." Mr. Keuhm: "I can put them in if I build them accord- ing to qualifications ?" Mr. Singer: "No, the lien has already been fixed." Mr. xeuhm: "What right has the City to put a lien on my property?" Mr. Singer: "The state law Bays that certain im- provements way be deemed necessary and a notice is filed at the Courthouse stating that the City proposes certain in- provenents. The ordinance determining the necessity orders the City engineer to prepare the specifications and the plan of where they are going to put in such improvements, and these are approved by the City Council, and adopted. There is an ordinance on record determining the necessity for and adopting plans and specifications. Thereafter follows ad- vertisement for bids on the project; our Charter provides that the most advantageous bid be taken. Then a contract is let to the lowest bidder. At the time of determining the necessity, a notice is filed setting out the improve- ments to be made, fixing a lien against the abutting pro- perty and the real and true owners thereof, and the method of making such assessments, the amount of which are to be determined hereto today, in line with the figures that are now in the Council's hands, as to what part is pay- able by the property owner, howeeueh the City has to pay, and to forth. After this hearing, corrections made and charges fixed, then a work order is given to proeeed with the work. When it is commenced, the City Engineer, or the Director of Public Works, inspects the work and continues to inspect the work, and issues work orders on various ports of it Until it is completed. When it is completed, it is certified to the City Council, and the Council recognizes the completeness of the project. It was the intention of the City to eet a dead line by advising the public of the proposed improvements as required by law. As there has to be some place to dray the line, this dates back to the time of the notice fixing lien, after which notice was duly published in thepaper three tines as required. As I have stated, when the procedure is completed as aforesaid, the lien dates back to the time of notice, which has been filed with the County Clerk on June 27th, and anyone buying property during that time takes it knowing that such lien is in exist- ence.* Mr. DeForrest: "Notification is not necessary then ?" Mr. Singer: "No." Mr. Keuhm: "There is no lien on homesteads then ?" Mr. Singer: "llo. The contractor will not place a sidewalk where there is no security of having it paid for." llr. Keuhm: "In case it is a homestead and if 1 meet specifieations, I can put my own sidewalks in then?" Mr. Stirman: "We do that by issuing you a sidewalk permit. (to Mr. Singer) Would we have the right to is a permit under these circumstances ?" Mr. Singer: The contractor would probably weave PAGE 5 his right ender the contract in the case of homesteads." The next person to appear was F. M. PEARCE of 1645 16th Street, and he stated: (1403 Block) Mr. Pearce: "I an not against sidewalks being put but I would like a correction to be made. I an down for Lots 13,14,15, and 16. I have had sidewalks on lots 13 and 16 for about 9 or ten years. I want them put in where I live though, in front of lots 9 and 10„ where it dew: not occur." Mr. Stirman: "Such errors occur and, of course, corrections will be made." Mr. Cott: "We'll not tear your sidewalk up where you have them down." Tiers WILLIAM WOLF of 1225 Logan appeared and stated: Mr. Wolf: pI want the sidewalks, but I question the prise and what is being put in. They wouldn't stand up to having trucks ran over them. Also, every lot I know of in treadle needs tilling in. This should be dons before the sidewalks are put down, or in a years time it will have been useless to have put them down." Mr. Stirman: "It is not provided for in this pro- gran." Mr. DeForrsst: "Why don't you fill in before the sidewalks are put down." Mr. Wolf: "They have been filling in for years from year to year. Nov it will just mean more filling in." Mr. Stirman stated: "The specification wsrrs sat as low as possible and they can be increased upon request." Mr. Wolf: "Another objection I have is as to where they are to be put down. My lawn is bars, but I understand that the sidewalks are to be put in ten feet from curb line and this would throw traffic right up in my front yard and people will get a good look Tinto my front room. Sidewalks adjoining the curb would eliminate that. Wee realy need drainage more than we need . sidewalks right now. Also there stems to be some loading in the cost, which I think is caused by the collection by the eontractor. Mine is a homestead and I fully intend to put my own sidewalk* down." (no Wolf) MR. PEYTON BRYAN, 221 Norton appeared, saying: We need sidewalks but the cost is famewhat hight. Now that one item of cost has been explained that I hadn't taken into eonside ration, it does not *ow as each." RR. C. C. NORWOOD,1123 Logan: "On Logan, the City should spend the money for drainage first, then sidewalks. If you put a storm serer in, I am for it 100%. If they put in sidewalks now, and do nothing about the drainage, and since the water stands in front of my house for 10 to 20 days after a rain, I will still have to run ■y car through water twice a day and the use of the sidewalks will be impossible. Also, we are too far from school for the children to use the sidewalks to go to school. I bad rather spend my part of the money for drainage and let sidewalks come later." R. DE FOIST: We put through a great many drainage projects last year and are working on this as fast as possible." Came A. B. GREENWOOD, 112'1 Logan: "I feel that we do not 'slave enough traffic to warrant sidewalks. I agree with Norwood - we need drainage far more. I think the coney would be better spent for drainage. I brought a petition signed by the majority of the property owners in our block and gave it to ?4r. Collier's secretary. This petition re- Quested that they not put Logan. KLASINO appear- ed and asked if they could build their sidewalks which have already been planned. Mr. Singer answered that it would have to be cleared with the contractor as to legal- ity. Mr. Klasing also stated that there was a drain- age problem too: Nueces Transportation Co. drains their wash racks into the sewer, and the sewer mains not being large enough, the water stands as the sewer is choked. Can't something be done about this was the question ask- ed by Mr. Kissing. Then Mr. Kissing asked if the City would give them the grade for the sidewalks, and was an- swered that it could probably be cleared. Mr. Singer asked Mr. Quails to come forward and Mr. Quails did so, stating that hia name was 'red Quaile, that he had lived in the City for about 30 years, is in the real estate business, and is familiar with the plans and specifications for the sidewalk project, lin- eluding the fact that the price has been set at 44¢ a square foot or $1.76 per lineal foot. In Mr. Quaile'e opinion such improvements will benefit the abutting property at least to the extent of the coat of said improvements, and he thought that the limprovements would be a safety measure. rAU y MR. I. C. CARRIAGE: "is the City going to pay half the cost ?" I understand from the news - paper that it would." MR. 3tirman: The cost to be borne by the City will pay for the sidewalks at intersections, ad- jacent to alleyways and abutting other City property only. Carriage: "I understand from the answers here that a lien can not be taken on a home- stead and the homestead property owners can put down their own sidewalks; I believe that I can do it cheap- er than $1.76. Also they have me down for 150 feet that I do not own on Winnebago between Carrico and Tancahua an the south side." Mr. Carriage was asked if he knew who did own this property and he replied that Mary Gilmenot owned part of it and that the Bailey Funeral Have was on another part of it." (Note) MR. CLARENCE A. HERTEL, 3254 Topeka: "Mine is a homestead. I understood that the necessity for sidewalks has to be established before an emergency is declared. I can not see the necessity for sidewalks on the east side of our street. There are sidewalks down on the other side from Glazebrook to Minnesota. It is my opinion that this satisfies those concerned with this project. The sidewalks are only tan steps away from anyone wanting to walk down them from the other way. I see no reason for putting them down on the east side, specially on the last 200 or so feet to the corner. And as far as the propety value being increas- ed, to me it would seem to be negative." Mr. DeForrest: "You mmuldn't take today PAGE 1O what you paid for it, would you ?" Mr. Hertel: "No, I wouldn't. The 1083 of the shrubs and trees would lower the value though. It looks to me as if there is a bit of discrimination. I have paid my share for the sewage and for the pav- ing of the street. On the next street over, they have none from end to end. I am not interested in putting in sidewalks. I don't want my shrubbery mutilated. This is my homestead.. I think that sidewalks on one side will serve the community alright." MR6. LAURA GENTRY, 1121 Tenth: I don't own a foot of ground down on.Craig and they have me down for 125 feet. I have sidewalks and curbs in front of my house." (note) MR. R. T. MALLEY, 337 Norton: "I just want to know if the City is committed for these side- walks so that there is no going back." Mr. bePorrestt The City does not start these projects. The people started this one/ How- ever, the City is committed. We have signed a con- tract." Mr. Malley. "Then I will confine my re- marks to the specifications. I don't think b" aidewalka are good enough. Also, if a man has a driveway across his property, will that be deducted ?" He was answered that it would be. Then Mr. Nally went on to say that he didn't think that the walks would particularly be good across b *sentire property." I wrote a letter re- garding the drainage situation to Mr. Stirman," he said, and Mr. Stirman answered that he had received the complaint and that as a just one the correction would be made." MRS. WILLIAM ROSCOE, 16th and Staples: "Is it going in on both sides of our street ?" Mr. Stirman referred to the plans and answered that they:. are going in on both sides. Mrs. Roscoe* "They will catch me on both sides then. On one side there is a concrete service station and on the other a drive -in with a shell front - -it doesn't seem necessary to have sidewalks in either of these places." Mr. Stirman told Mrs. Roscoe that sidewalks were usually put in in such places. Mr. Bill Neyland Jr. came to the front and said that he had lived in Corpus Christi for about 25 years, that he had looked at the map and the pro- posed improvements. That, although he didn't know the legal definition for a 4" sidewalk, he did know what one vas, and that he could picture in his mind the various areas of the City. Mr. Neyland stated that he was engaged in the Real estate business and in such had handled the type of property in question. That he thought there was a difference in the value of property where there is and where there is not sidewalks. That he understood the coat of $1.76 a lineal foot or 441 per square foot, and that he did not believe that, or he didn't know if, it had ever been mentioned the definite increaae if the value of property where sidewalks lead to definite places, but he thought that it would be a definite benefit to the property owners, and that it would more than justify the coats. He stated that if a lot averaged 65 feet, the coat for the lot would be $100, and that he thought the money would be well spent. Further, that he had always tried to put them down in his subdivisions and hadn't even asked the City to pay for anything, as he thought that it increased the value of the property even if the walks were not a part of a traffic plan. Mr. Singer told Mr. Neyland that the cost would not average more than 08 for one property. MR. TYSON WOOD OF 102 E. Vanderbilt: "We need the drainage in our area too. Also, the children don't go this way to school. They cut across or their parents take the to school or they ride b'ic efo s. With the drainage what it is, if sidewalks are put down as they are proposed, the kids would have to go the long way and by the route of heavily trafficed streets. On Clark, for instance, this would create a hazard, as the Children would play in the the street. If they are put on my property, when it rains, the kids would have to swim off. Mr. Greenwood to Mr. Wayland: "You mean that we are neglecting to increase the value of our property by not building ;sidewalks? Are you trying to show that we are depreciating our property by not put- ting them down ?" Mr. Nelyand answered that he thought $0. Mr. Singer: "There are no places that do not have walks where you do not have to walk in the street. Mr. Greenwood; "Why question a real es- tate man? Have you had any experience in buying or selling real estate ?" Mr. Singer: "Don't you feel that itwould increase the value. Mr. Greenwood: "I think it depends on the individual property." Mr. Singer; .s ?BO you do not argue -- You think that a connected system of sidewalks is good." Mr. Underwood: "But what I want to know is,why call in a real estate Haan ?" Mr. Collier: "Maybe I can answer that: Under state law, in proceedings of this kind the council le suppose to receive the opinions as opinions of recognized real estate people as to whether or not the property value is enhanced." "To establish benefit ". "'Thank you." Someone asked the question as to whether this would increase the taxes. and Jr. i D.Forrest answered that taxes were not going to be raised; that they had been set in the budget. MR. BILL SFiIREMAN ASKED TO BE HEARD, and stated: "In regard to the area around Pisoher Sebool, there is no question of the value of the sidewalks. I do see that many are questioning the wisdom of the plan and are voicing objections because of what it means to thew personally. I might weight it to see how much it means to we financially. The idea of the PTA Committees was to try to get sidewalks in that area, so that the children in Bessar Park and Alameda Estates could get to Fischer and the High School without walking in the mad. And I have heard move favorable com- ment from the people about this than any thing during the administration. They -not this administration- were critiaed for not going ahead with a sidewalk program. In a City of this size you need an overall plan of sidewalks. In every other community I have .lived i_in, you found sidewalks pretty genernlly throughout the city. It is a constant source of anent to me that they have so few sidewalks in this City. And I am glad to see that they are bing required in the new developments. Part of Alameda and a number of other streets has sidewalks, where the owners have voluntarily put them down. If this program doesn't go through, there being sidewalks on portions of these streets won't do a bit of good. It is worse for a child to walk on the sidewalk part of the way, then in the mud, back on the sidewalk, then to the street. This is worse than walking the street all the way. I have lived here for 25 years and I have never fought a thing that was for the good of the City, but if I wanted sidewalks I would have built them. I live on one of the heaviest travelled intersections in the City. I have spent ten years planting shrubbery on the Santa Fe side. Sidewalks would destroy all of • this. It may increase the value of some men's property, but that is a broad statement, that it will increase it generally. There are no schools for blocks around. I tried to get than to rezone this as business property. If they put sidewalks in, the only thing I can do is to sell my home to Mr. Quaile or someone else." MRS. DOLLY J. SPITZMILLER, 318 Clark Drive, at Vanderbilt and Norton; "The only people using this sidewalk would be children living in our block and I have a petition signed by my neigh- bors. These are all homesteads. We are definitely not in favor of sidewalks in our neighborhood." MRS. ELLIOTT GOULD, 604 Artesian. "I am in favor of sidewalks, but there is no use in putting them down until something is done about the drainage and about trucks parking acroas the sidewalks. IRPING DIET Z, SR., 3242 Topeka: "I am glad that the City is vigorously pursuing the policy established by the State Legislature, regarding the zoning on subdivisions with- in the five :wile radius of the City. I think that some here will realize and admit that if the City had had such veer years ago, our City would have better drainage and would have sidewalks already down in some of these places. I think the City is just about threw years late in putting these sidewalks down. They started a sidewalk program then and should have gone right through with it. I think it you could get 75% Of the property owners to sign, the City should compel the remaining lot to put in sidewalks also. Mr. Hurtel said the majority on our side of the street don't have sidewalks and don't want them. Let me say that it is four who do not and seven that do. If the law can not force homeowners to place sidewalks, we will continue to have this situation of off again and on again, until some remedy is Pound. Three years ago it could have been done at about half the cost." Mr. Hurtels "If I made a false statement, let me apologize. I live next door to Dietz and I have enjoyed it." 1R. SECTION 2. That the said City Council hereby finds and determines upon the evidence heard in reference to each and every parcel of property abutting upon said streets within the limits in Section 1 defined, that the special benefits in the enhanced value to accrue to said property and the real and true owner or owners thereof, by virtue of the construction of said improvements, to -wit, sidewalks, along said portions of said streets, will be in excess of the amount of the costs of said improvements as proposed, to be, and as herein assessed against said abutting property and the real and true owner or owners thereof, and finds that the apportion- ment of the costs of said improvements and that the assessments hereinbelow made are just and equitable and produce substantial equality, considering the benefits received and the burdens im- posed thereby, and are in accordance with the laws of the State of Texas, and the Charter provisions of the City of Corpus Christi, Texas, and that allproceedings and contracts heretofore had with -q - reference to said improvements are in all respects regular, proper and valid, and that all prerequisites to the fixing of the assessment lien against said abutting properties and the spe- cial tax against railways, street railways, and interurbans, as hereinafter described and the personal liability of the real and true owner or owners thereof, whether named or correctly named herein or not, have been in all things regularly had and per- formed, in compliance with the law, Charter provisions and pro- ceedings of said City Council. SECTION 3. That in pursuance of said ordinance, duly enacted, by said City Council, authorizing and ordering the improve- ment of said above described streets within the limits hereinabove named and defined, and in pursuance of said proceedings heretofore had and enacted by said City Council in reference to said improve- ments and by virtue of the powers Vested in said city with respect to said street improvements by the laws of the State of Texas and the Charter of said City, with particular reference to Chapter 106 of the Acts of the First Called Session of the 40th Legislature of the State of Texas, known and shown as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas, there shall be, and is hereby ]e vied, assessed and taxed against the respective parcels of pro- perty abutting upon said portions of said streets, and against said railways, street railways and interurban and their roadbeds, ties, rails, fixtures, rights and franchises, which properties and rail - mays, street railways and interurban are hereinbelow described, and against the real and true owner or owners thereof, whether such real and true owner or owners be named or correctly named herein or not, the several sums of money herebelow mentioned and itemized opposite the description of the respective parcels of said property, - 10 - railway, street railways, and interurbans, the descriptions of such properties, railways, street railways and interurbans, the number of front feet of each, and the several amounts assessed against same and the real and true owners thereof, the names of the apparent owners thereof, all as corrected and adjusted by said City Council, being as follows, to -wits SECTION La.. BE IT FURTHER ORDAINED: That in the event the actual frontage of any property herein assessed shall be found upon the completion of said improvements to be greater or less than the number of feet hereinabove stated, the assessments herein made against any such property and against the real and true owner or owners thereof shall be, and the same are hereby declared to be increased or deoreased, as the case may be, in the proportion which said excess or deficiency of frontage shall bear to the whole number of front feet of property actually improved in accordance with the front foot rate of assessment herein adopted, it being the intention that each parcel of property and the real and true owner or owners thereof, abutting on said streets within the limits above defined, shall pay for said improvements under the "FRONT FOOT RULE OR PLAN," which rule or plan is hereby found and determined to be Just and equitable and producing substantial equality, having in view the special benefits to be received and the burdens imposed thereby, and it is further ordained that upon final completion and acceptance of said improvements, all certificates hereinafter pro- vided for, issued to evidence said assessments against said parcels of property, abutting upon said streets and the real and true owner or owners thereof shall be issued in accordance with, and shall evidence the actual frontage of said property and the actual cost of said improvements, the amount named in said certificate in no case to exceed the amount herein assessed against such property unless such increase be caused by an excess of front footage over the amount hereinabove stated, such actual cost and such actual number of front feet to be determined by the Director of Public Works upon completion of said work, and the finding of said Director of Public Works shall be final and binding upon all parties concerned. —12— SECTION 5. That the several sums mentioned above in Section 3 hereof assessed against said parcels of abutting property and the real and true owner or owners thereof, whether named or correctly named herein or not, subject to the provisions of Section 4 hereof, and the several sums mentioned in said Section 3 assessed against each railway, street railway or interurban, and the real and true owner or owners thereof, together with interest thereon at the rate of five per cent (5 %) per annum and with reasonable attorneys' fees and all costs and expenses of collection, if in- curred, are hereby declared to be and are made a first and prior lien upon the respective parcels of property as above set out, against which same are assessed from and after the date said im- provements were ordered by the City Council on the 27th day of June, 1950, and a personal liability and charge against the real and true owner or owners thereof, whether or not such owner or owners be named or correctly named herein, and that said lien shall be and constitute the first and prior enforcible claim against the property assessed, and shall be superior to all other liens, claims or titles, except for lawful ad valorem taxes; and that the sums so assessed shall be payable as follows; The amount of said assessments shall be payable in two equal installments, the first of which to be due and payable twenty days after the date said im- provements are completed and accepted by the City Council of the City of Corpus Christi, Texas, and the remaining one installment to be due and payable one year from and after the date of such acceptance, together with interest thereon from said date of accep -. tance at the rate of five per cent (5%) per annum payable on the date the said installment is due; provided, however, that the owner of said property shall have the privilege of paying any one or all 13 .. of such installments at any time before maturity thereof, by paying the total amount of principal due, together with interest accrued to date of payment; further, that if default be made in the payment of any said installment or principal or interest promptly as same matures, then at the option of the contractor or assigns, the entire amount of the assessment upon which suoh default is made, shall be and become immediately due and payable, together with reasonable attorneys, fees and collection costs, if incurred; however, it is specifically stipulated and provided that no assessment sha 11 in any case be made against any property or the real and true owner thereof in excess of the special benefits to accrue to such property in the enhanced value thereof, resulting from such improvements. SECTION 6. That the City of Corpus Christi shallnot in any manner be liable for the payment of any sum hereby assessed against any property and the real. and true owner or owners, for payment of the sums assessed against said respective parcels of property, but said City shall be obligated to furnish J. M. Dellinger, Inc. valid assessments and assessment certificates and shall exercise all of its lawful powers and aid in the enforcement and collection of said liens and assessments; and if default shall be made in the payment of any said sums herein assessed against the said parcels of pro- perty, railways, street railways and interurban, and the real and true owner or owners thereof, collection thereof shall be enforced at option of said J. M. Dellinger, Inc. or its assigns, either by suit in any court having jurisdiction or by sale of the property assessed as nearly as possible in the manner as may be provided by law and Charter in force in said city for the sale of property, for the collection of ad valorem taxes. SECTION 7. That for the purpose of evidencing said assessments, the liens securing same and the several sums assessed against the said parcels of property, railways, street railways and interurbans, and the real and true owner or owners thereof, and the time and terms of payment, and to aid in the enforcement thereof, assignable certificates shall be issued by the City of Corpus Christi, Texas, to J. M. Dellinger Inc., upon the comple- tion of said improvements and acceptance thereof by said City Council, which certificates shall be executed by the Mayor in the name of the City, attested by the City Secretary with the corporate seal, and which shall declare the amounts of said assessments and the times and terms thereof, the rate of interest thereon, the date of completion and acceptance of the improvements for which the certificate is issued, and shall contain the name of the apparent true owner or owners as accurately as possible, and the desoription of the property assessed by lot and block number, or front foot thereof, or such other description as may otherwise identify the same, and if the said property shall be owned by an estate or firm, then to so state the fact shall be sufficient, and no error or mistake in describing any such property, or any rail- way, street railway or interurban, or in giving the name of any owner or owners, shall in anywise invalidate or impair the assess- ment levied hereby or the certificate issued in evidence thereof. That the said certificates shall further provide sub- stantially that if default shall be made in the payment of any installment of principal or interest when due, then at the option of J. M. Dellinger, Inc. or its assigns, or the holder thereof, the whole of said assessment evidenced thereby shall at once become due and payable and shall be collectible with reasonable attorneys, fees and all expenses and costs of collection, if incurred, and said certificates shall set forth and evidence the personal liability of the real and true owner or owners of such property, railway, street railways or interurbans, whether named or correctly named therein or not, and the lien upon such property, and such railway - 15 - street railways and interurban, and that said lien is first and paramount thereon, superior to all other liens, titles and charges, except for lawful ad valorem taxes, from and after the date said improvements were ordered by said City Council, to -wit, June 27, 1950, and shall provide in effect that if default shall be made in the payment thereof, the same may be enforced, at the option of J. M. Dellinger, Inc., or its assigns, either by the sale of the property therein described in the manner provided for the collection of advalorem taxes as above recited, or by suit in any oourt having jurisdiction. That said certificates shall further recite in effect that all the proceedings with reference to making said improve- ments have been regularly had in compliance with the law and charter in force in said city and the proceedings of the City Council of said City, and that all prerequisites to the fixing of the assessment lien against the property and the special tax against the railway, street railway or interurban therein des- cribed, or attempted to be described, and the personal liability of the real and true owner or owners thereof, evidenced by such certificates, have been regularly done and performed, which re- citals shall be evidence of all the matters and facts so recited and no further proof thereof shall be required in any court. That the said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, which may be signed with the facsimile signatures of the Mayor and City Secretary. That said certificates shall further provide in effect that the City of Corpus Christi, Texas, shall exercise all of its lawful powers, when requested so to do by the holder of said cer- tificates, to aid in the enforcement and collection thereof, and said certificates may contain other and further recitals pertinent —16» and appropriate thereto. It shall not be necessary that said certificates shall be in the exact form as above set forth, but the substance and effect thereof shall suffice. SECTION 8. That all such assessments levied are a per- sonal liability and charge against the real and true owner or owners of the property, or railways, street railways, or inter - urbane, described, nothwithstanding such owner or owners may not be'.named or correctly named and any irregularity in the name of the property owner, or the description of any property or the amount of any assessment, or in any other matter or thing, shall not in anywise invalidate or impair any assessment levied hereby or any certificate issued, and such mistake, or error, invalidity or irre- gularity whether in such assessment or in the certificate issued in evidence thereof, may be, but is not required to be, corrected at any time by the City Council of the City of Corpus Christi, Texas. Further, that the omission of said improvements in front of any particular parcel of property abutting upon said streets, which is exempt from the lien of said assessment shall in nowise affect or impair the validity of assessments against the other parcels of property abutting upon said streets. That the total amounts assessed against the respective parcels of property abutting upon said streets, within the limits herein defined, and against the railways, street railways, and inter - urbans and the real and true owner or owners thereof, are the same as, or less than, the estimates of said assessments prepared by the Director of Public Works and approved and adopted by said City Council and are in accordance with the proceedings of the said City Council relating to said improvements and assessments therefor and 17 ., with the terms, powers and provisions of said Chapter 106 of the Act of the First Called Session of the 40th Legislature of the State of Texas, known as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas and the Charter of the City of Corpus Christi, Texas under which terms, powers and provisions said pro- ceedings, improvements and assessments were had and made by said City Council. SECTION 9. The fact that portions of certain streets within the City of Corpus Christi, as above described, do not have sidewalks, and the further fact that sidewalks along said streets are necessary to &e health and public welfare of the inhabitants of said City because of the increased traffic along said streets, creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
