AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS TO EXECUTE
A CONTRACT WITH HELDENFELS BROTHERS FOR THE PURPOSE OF
CON STRUCTING AND INSTALLING CERTAIN IMPROVEMENTS ON
THE LAWRENCE STREET T -HEAD ON A PORTION OF 'M BAYFRONT-
THE SEAWALL AND BREAKWATER CONSTRUCTION PROJECT- AS MORE
PARTICULARLY DESCRIBED HEREIN, BY THE CONSTRUCTICH OF
CURBS, WALKS, WATER LINES, FILL -SOIL, GUTTER PAVINGAND
CALICHE AND DOUBLE ASPHALT SURFACE TREATMENT OF A PORT
TION OF SAID T -.HEAD AS SET OUT IN PLANS AND SPECIFICA-
TIONS, AND CONTRACT DOCUMENTS, WHICH ARE MADE A PART HEREOF
BY REFERENCE, APPROPRIATING OUT OF FUND N0. 258 SEAWALL
AND BREAKWATER CONSTRUCTION FUND THE SUM OF $24,635.70,
WHICH SUM INCLUDES $22,396.10 TO BE PAID AS CONTRACT COSTS
OF ITEMS 192,3, AND 5 LISTED ON THE TABULATION OF BIDS
WHICH IS MADE A PART HEREOF AND ATTACHED HERETO, AND THE
FURTHER SUM OF $2,239.60 FOR ENGINEERING AND CONTINGENT
COSTS; AND APPROPRIATING THE SUM OF $6,790.72 OUT OF NO.
296 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (PARK IM-
PROVEMENTS), WHICH SUM INCLUDES $6,173.38 TO BE PAID FOR
CONTRACT COSTS OF ITEM 3 (SELECT FILL SOIL) AND ITEM 6
(INSTALLATION OF WATER LINES) AS PER SAID TABULATION OF
BIDS, AND THE FURTHER SUM OF $617.34 FOR ENGINEERING AND
CONTINGENT IFDSTS; AND DECLARING AN EMERGENCY.
WHEREAS, The filling on the Lawrence;Streht' -T -Head of the City
of Corpus Christi, Texas is rapidly deteriorating through the effect
of the elements thereon, especially the rains and winds; and
WHEREAS, It is imperative that protective measures be taken
immediately to protect the filling of said T -Head from further erosion
and deterioration; said T -Head being a part of the seawall and Atom
Protection improvements of the City of Corpus Christi; and
WHEREAS, It is determined necessary that certain improvements
be made thereon to improve the same as a part of permanent park
improvements of the City of Corpus Christi, Texas; and
WHEREAS, It is necessary to appropriate the amount to be
paid in consideration for the construction of such improvements; and
WHEREAS, Bids have been received, considered and an award made
for the most advantageous bid to the City of Corpus Christi, and it
is now necessary to enter into a contract for construction of cer-
tain improvements on the aforementioned area;
NOW, THEREFORE, BE IT ORDAINED By THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS;

SECTION 1. That the City Manages is hereby authorized
and directed to execute for and on behalf of the City of Corpus
Christi a contract for the construction of said improvements on
the Lawrence Street T —Head, as described in contract documents
hereinafter mentioned, with Heldenfels Brothers of Nueces County,
Texas, which contract has been awarded in accordance with the plans,
specifications and contract documents on file in the office of the
City Secretaxq, all of which are made a part hereof by reference,
and according to the bid of said Heldenfels Brother opened on the
day of August, the said bid of Heldenfels Brothers being the
lowest and most advantageous to the City of Corpus Christi, Texas.
SECTION 2. There is hereby appropriated out of No.
258 SEAWALL AND BREAK61fATER CONSTRUCTION FUND, the sum of $24,635.70,
out of which sum there is to be paid, according to the terms of the
contract described in Section 1 hereof, the sum of $22,396.10 to
cover the costs of Items 1,20, and 5 listed on the tabulation of
bids which is attached hereto and made a part hereof, and the bal-
ance of the said appropriation is an amount equivalent to ten per
cent (10%) of said contract price of said items, which amount is
appropriated for the engineering and contingent costs of said items.
SECTION 3. There is hereby appropriated, in addition
to the appropriation provided in section 1 hereof, out of No. 296
Improvement Bonds 1950 Construction Fund (Park Improvements), the
sun of $6,790.72, out of which sum there is to be paid, according
to the terms of the contract described in Section 1 hereof, the stmt
Of $6,173.38 for the payment of items 3 (Select fill —soil) and item
6 (Installation of water lines) listed on said tabulation of bids,
and the balance of said appropriation is an amount equivalentto ten
Per cent (10%) of said contract price of said items, which amount
is appropriated for the engineering and contingent costs of said
items.
SECTION 4. The necessity of maintaining adequate storm
Protection improvements and the imperative need to take measures to
Protect the filling of said T —Head as a part of such stoom protec-
tion improvements from further erosion, as well as the necessity
for providing certain improvements to the area heretofore designated
as park area to be improved as hereindescribed as a part of the per-
manent park improvements o£the City of Corpus Christi, creates a
public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date it is introduced and that such ordin-
ance or resolution shall be read at three several meetings of the
City Council, and the Mayor, having declared that such emergency and
necessity exist, requesting that such Charter rule be suspended and
that this ordinance be passed finally on the day it is introduced
and take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at .three meetings of the
City Council; I, therefore, hereby 'request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
