HomeMy WebLinkAbout02882 ORD - 09/26/1949,LRandersonJr;gp 91120150 (S) AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE A QUITCLAIM DEED ON LOT 7, BLOCK 4, MUELY ADDITION TO THE CITY OF CORI -US CHRISTI, TEXAS, UNTO THE PRESENT OFRTERS THEREOF, JOSE AND ROBERT SOLIS, QUIT- CLAIMING AND REISOI14G ALL ITS RIGHT, TITLE, AND INTEREST IN AND TO SAID LOT HELD BY IT BY VIRTUE OF THAT CERTAIN EASEMENT OR RIGHT -CF- WAY GRANTED THE ITY BY CHAS. A. MEULY, INDI- VIDUALLY AND AS INDIVIDUAL EXECUTOR OF ESTATE OF NARY F. MEULY, DECEASED, ON APRIL 14, 1926, FILED FOR RECORD ON JULY 6, 1926, IN VOLUME 162 P. 382 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS, SAID EASEMENT HAVING NEVER BEEN USED FOR SWfiER PURPOSES FOR WHICH IT WAS GRANTED; AND DECLARING AN EMERGENCY. WHEREAS, It has been requested that the City of Corpus Christi release and quitclaim all its right, title and interest in and to that certain Lot 7, Block 4, Meuly Addition to the City of Corpus Christi, held by it by virtue of an easement granted the City by Chas. A, Meuly, Individually and as Individual Executor of Estate of Mary F. Meuly, Deceased, on April 14, 1926, as evidenced by an easement filed for record on July 6, 1926, in Volume 162, P. 382 of the Deed Records of Nueces County, Texas; and WTEREAS, An investigation reveals that this easement was never used for the purpose for which it was obtained and it is not contemplated that it will be used for such purpose in the future, and it is now a cloud on the title to the said lot; and 10MREAS, Said lot is now served by public utilities and such easement should be released in order to clear the title to the same and permit the sale thereof; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1, That the City Manager of the City of Corpus Christi be, and he is hereby, authorized and directed for and on behalf of the City of Corpus Christi, to execute a quitclaim deed quitelaiming and releasing unto Jose Solis and Robert Solis ail its right, title,aud interest in and to Lot 7, Block 4, Meuly Addition Oro O to the City of Corpus Christi, Texas, held by it by virtue of that certain easement from Chas. A. N[euly, Individually and as Individual Executor of Estate of Mary F. The necessity for clearing the title to the aforesaid land creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the day it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, declaring such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordin- ance be passed finally on the day it is introduced and take effect and be in full force and effect -from and after iis..passage, IT IS ACCORDINGLY SO ORDAINED.
