RECEIVING AND ACCEPTING ON BEHALF OF THE CITY
OF CORPUS CHRISTI THE WORK OF CONSTRUCTION OF
CERTAIN PERMANENT PARK IMPROVEMENTS (ERECTION
OF A MASONRY AND WOOD COMMUNITY BUILDING IN
T. C. AYERS PARK) BY BRASELTON CONSTRUCTION 00.
UNDER 6ANTRACT DATED MAY 11, 1950 AS AUTHORIZED
BY ORDINANCE NO. 2772; AUTHORIZING FINAL PAYMENT
ON BEHALF OF THE CITY AS ITS PORTION OF THE CON-
SIDERATION IN ACCORDANCE WITH THE FINAL ESTIMATE
A COPY OF WHICH IS ATTACHED HERETO AND MADE A
PART HERECF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
WHEREAS, On December 21, 1949, Nueces County Commissioner's Court
issued an Order Correcting R.esolution,whieh was passed by due procedure
at a regular term of Court on January 9th, A.D. 1950, providing that the
Motion on file on page 138 of Volume S of the Commissioners Court Minutes,
passed on June 13, 1949, be corrected to provide that the Cuty of Corpus
Christi through its Public Works Department should supervise the construes
tion of the recreational center at T. C. Ayers Park, and that the pay-
ment of the appropriated money voted at the June 13, 1949 meeting be made
on estimates furnished by the Public Works Department of the City of Corpus
Christi, Texas, and approved by the County Engineer and County Auditor;
and
WHEREAS, Thereafter,on May 9, 1950, by Ordinance No. 2772, the
City of Corpus Christi,by and through its City Council, did appropriate
certain moneys to be paid as its pro rata portion of the consideration
for the construction of such improvements and authorised the execution
of a contract for said improvements with Braselton Construction Company;
and
WHEREAS, The work of erection of such improvements having been
completed and final, estimate submitted for acceptance, it is now neces-
sary to accept sueh work and approve said final estimate in behalf of the
City so that said project may be completed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the work of erection and construction of a
Masonry and Wood Community Building in T. C. Ayers Park as permanent park
improvements in the City of Corpus Christi, Texas performed by Braselton
Construction Company under its contract dated May ll, 1950 as authorized
by Ordinance No. 2626, having been performed and completed in accordance
with the terms and provisions of the contract, plans and specifications,
and the Director of Public Works having inspected the same and certified
to the completion of said work in accordance with said plans and specifi
cations, the work aforesaid is hereby found to have been completed in
accordance with the plans and specifications and is here and now accepted
and received by the City Council of the City of Corpus Christi, Texas.
SECTION 29 That final payment due under the contract above
mentioned and as set out in the final estimate attached hereto and made
a part hereof, prepared by the Director of Public Works dated October 2,
1950, in the sum of $5ol46.43 be made in accordance with the terms of
such contract and paid from Fund No. 296 Imlrovement Bonds 1950 Construc-
tion Fund (Park Improvements) as previously appropriated.
SECTION 3. The necessity for completion of this project by
the acceptance of the work of same and the approval of final payment
therefor in order that the same may be accepted and final paygtent made
by the County creates a public emergency and imperative public neces-
sity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction
and that said Ordinance or resolution shall be read at three several
meetings of the City Council and the Mayor, declaring such emergency
and necessity to exist, having requested the suspension of said Charter
rule and that this ordinance be passed finally on the date it is intro-
duced and take effect and be in full force and effect from and after
its PASSAGE, 'it is aceordingly So ORDAINED,
PASSED AND APPROVED This the 1 day of October, A.D. 1950.

Gentlemens
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
