HomeMy WebLinkAbout02909 ORD - 10/17/1950AN ORDINANC# CLOSING THAT PORTION OF WEST BROADWAY EXTENDING WESTWARD FROM KENNEDY AVENUE 145.46 FEET ON THE NORTH BOUNDARY LINE OF WEST BROADWAY AND A DIS- TANCE OF 219.22 FEET ON THE SOUTH LINE OF WEST BROADWAY SO AS TO RELOCATE WEST BROADWAY THROUGH Ta DAVID PEEL AND KNIGHTS OF PYTHIAS TRACTS IN THE CITY OF CORPUS CHRISTI, TEXAS; AJ THORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY TO EXECUTE DEEDS CONVEYING TO DAVID PEEL AND KNIGHTS OF PYTHIAS CERTAIN PORTIONS OF THE ABOVE DESCRIBED PRESENT WEST BROADWAY IN EX- CHANGE OF CONVEYANCE BY DEED OF EVEN DATE THERE- WITH OF CERTAIN HEREINAFTER DESCRIBED PORTIONS OF THE DAVID PEEL AND KNIGHTS OF PYTHIAS TRACTS, COPIES OF 'WHICH DEEDS ARE ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, It is necessary to close the hereinafter describ- ed portion of West Broadway so as to reroute West Broadway through the David Peel and Knights of Pythias Tracts to make West Broadway one continuous street to benefit the City in the movement of Traffic along West Broadway; and WHEREAS, Notice of the proposed closing of said portion of said street has been given by publication and by mail to the last known address of all owners abutting said street and within 450 feet therefrom, in accordance with the Charter of the City of Corpus Christi, as provided for under Art. II. Sec. 6 thereof; and, WHEREAS, In accordance with the Notice given a public hear- ing was held by the City Council of the City of Corpus Christi in the City Council Chamber of the City Hall in the City of Corpus Christi, Texas, on the 7th day of March, A.D. 1950, at 4:00 o'clock P.M.; and WHEREAS, the public welfare, safety, convenience and necessity will be better served by the closing of that certain por- tion of said street and to relocate the same through the said tracts: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That the following described portion of West Broadway, to—wit: That portion of West Broadway extending westward from Kennedy Avenue 14546 feet on the North boundary line of West Broadway a and a distance of 219.22 feet in the South line of West Broadway, in the City of Corpus Christi, Texas, be and the same is hereby closed to the public and the dedication z9o9 thereof vacated for all intents and purposes. SECTION 2. That the City Manager be and he is hereby authorized and directed for and on behalf of the City to execute • deed to the Knights of Pythias, Miramar Lodge 135, conveying • certain portion of West Broadway as described in said deed, in exchange of the conveyance by the Knights of Pythias of a certain portion of the Knights of Pythias Tract for the purpose of the relocation of West Broadway by deed of even date there- with, all as described in said deeds, a copy of which are attached hereto and made a part hereof. SECTION 3, That the City Manager be and he is hereby authorized and directed for and on behalf of the City to execute a deed to David Peel, conveying a certain portion of West Broadway as described in said deed, in exchange of the conveyance by David Peel of a certain portion of the David Peel Tract for the purpose of the relocation of West Broadway by deed of even date therewith, all as described in said deeds, a copy of which are attached here- to and made a part hereof. SECTION 4* The fact that public convenience and neces- sity will be better served by the closing of said street and the relocation thereof so as to make Oest Broadway a connected street at that point and to benefit the City in the movement of traffic along West Broadway creates a public emergency and a public neces- sity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several Meetings of the City Council; and the Mayor, having declared such emergency and necessity to exist, and having requested that such Charter rule be suspended and that this ordinance be passed finally on the date it is introduced, and take effect and be in full force and effect from and after its passage, IT 13 ACCORDINGLY SO ORDAINED.
