HomeMy WebLinkAbout02919 ORD - 10/31/1950AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS, RECEIVING INTO AND ANNEXING TO THE CITY OF CORPUS CHRISTI, TEXAS, CERTAIN ADDITIONAL TERRITORY GENERALLY DESCRIBED AS BEING THAT TERRITORY LYING BETWEEN THE PRESENT CITY LIMITS LINE, WHICH IS 180 FEET SOUTHWEST OF THE CENTERLINE OF GOLLIHAR ROAD AND HOLLEY STREET AND HOLLEY STREETSS SOUTHEASTER- LY EXTENSION, AND BETWEEN CHAPMAN RANCH ROAD AND WEBER ROAD, EXTENDING 180 FEET SOUTHWEST OF THE CENTERLINE OF CHAPMAN RANCH MAD AND 180 FEET SOUTH- EAST OF THE CENTERLINE OF WEBER ROAD, AND ALSO INCLUDING AN 80 ACRE TRACT CONSISTING OF SOUTHLAND ESTATES AND MORAVIAN VILLAGE, LYING ADJACENT TO AND NORTHWEST OF KOSTORYZ ROAD AND ADJACENT TO AND SOUTHWEST OF HOLLEY STREET AND AN AREA IN CORPUS CHRISTI AND NUECES BAYS; FULLY DESCRIBING SAID TERRITORY AS AN INTEGRAL PART OF THE CITY OF CORPUS CHRISTI, TEXAS, AND DEFINING ITS LIMITS; AND DE- CLARING SAMg AS ANNEXED TO AD MADE A PART OF THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EIH;RGENCY. WHEREAS, on the 19th day of September, 1950, there was pre- sented to the City Council of the City of Corpus Christi, Texas# a recom- mendation from the Zoning and Planning Commission of said City, which recommendation advised the City Council that certain additional tsrri- troy should be annexed to the City of Corpus Christi, that such recom- mendation contained the full and accurate description of two separate tracts of land; and WHEREAS, the City Council, after due investigation and con- sideration of said recommendation of the Zoning and Planning Commis- sion, and in compliance with Section 2 of Article 1 of the Charter of the City of Corpus Christi, as amended, did on the 19th day of September, 1950, by ordinance, order that an election be held on the 21st day of October, 1950, within the City limits of the City of Corpus Christi for the purpose of submitting to the qualified voters of said City the question of whether or not said territory, and each of the said areas as described in sax * - ordinance, being Ordinance Mo. 28130 be annexed to the City of Corpus Christi, and the territories to be voted upon were fully and completely described in said ordinance; and WHEREAS, an election was held on the 21st day of October, 1950, in accordance with the provisions of said ordinance and in ac- cordance with the ordinances and Charter of the City of Corpus Christi I and in accordance with the statutes of the State of Texas regard- ing such elections, and the question of annexation of said addi- tional territory was submitted to the qualified voters of the City by one proposition-,, as follows: PROPOSITION NO. 1 "SHALL THE CITY OF CORPUS CHRISTI, BY ORDINANCE, ANNEX TO SAID CITY CERTAIN ADDITIONAL TERRITORY GENERALLY DESCRIBED AS BEING THAT TERRITORY LYING BETWEEN THE PRESENT CITY LIMITS LINE, WHICH IS 180 FEET SOUTHWEST OF THE CENTERLINE OF GOLLIHAR ROAD AND HOLLEY STREET AND HOLLEY STREET'S SOUTH- EASTERLY EXTENSION, AND BETWEEN CHAPMAN RANCH ROAD AND WEBER ROAD, EXTENDING 180 FEET SOUTHWEST CF THE CENTERLINE OF CHAPMAN RANCH ROAD AND 180 FEET SOUTH- EAST OF THE CENTERLINE OF WEBER MAD, AND-ALSO IN- CLUDING AN 80 ACRE TRACT CONSISTING OF SOUTHLAND ESTATES AND MORAYIAN VILLAGE, LYING ADJACENT TO AND NORTHWEST OF SOSTORYZ ROAD AND ADJACENT TO AND SOUTHWEST OF HOLLEY STREET AND AN AREA IN CORPUS CHRISTI AND NUECES BAYS, AND DESCRIBED MORE PARTICU- LARLY AS FOLLOWS:° which said areas to be annexed were fully described following said presentation,of such proposition in the ordinance submitting the question of annexation of said additional territory to the voters; and the returns of said election were duly made to this council; and WHEREAS, on the of October, 1950, at a regular meeting of the City Council of the City of Corpus Christi came on said matter of caavasaing said returns of said election, and at said meeting it was found and determined that there were cast at said election 1102 votes on said proposition -.as follows: For Annexation of Such Additional Territory 768 votes Against Annexation of Such Additional Territory 3314 votes and the City Council thereupon declared the results of said elec- tion to be that a majority of the legally qualified voters of the City of Corpus Christi voted in favor of annexation to the City of Corpus Christi the territory and each of said areas,Aaa hereabove described and as will be hereinafter fully described by motes and bounds; and WHEREAS, in order to comply with Section 2- of Article 1 of the Charter of the City of Corpus Christi, Texas, as amended, it is necessary after the election has been completed and the vote is favorable for annexation that the City Council shall, by ordinance, -2- annex the area voted upon; and WHEM& S, the City Council deems it to be to the best interest of the City of Corpus Chriati, Texas, that said territory and both of said areas as herebefore listed and described which the voters of the Ctiy of Corpus Christi, have by a majority voted declared should be annexed to the City, be annexed to and received into and included within the tern+ torial limits of said City to become an integral part thereof, and sub- ject to the rules, regulations, ordinances and the Charter of said City as well as becoming charged with the burden of said City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL CF THE CITY CF COBFUS CHRISTI, TE%ASs SECTION 4 That the territory hereinafter definedand described by metes and bounds as follows: BEGINNING At a point in the present City Limits line said point being.on the south edge of the south abut- ment of the draw span of the Nueces Bay Causewsy on State Highway Now 16; THENCE due east with the present City Limits line parallel to the original northern City Limits line as surveyed by C.F.H. v. Blucher in August, 1883, to its intersection with the original east City Limits line ez. tendeda THENCE South with the present City Limits line to the southeast corner of the original City Limits line as surveyed by C.F.H. v, Blucher in August, 1883; THENCE in a. southeasterly direction to a point that is due north one mile from the most easterly point of the west shoreline of Oso Creek at mean low tide; THENCE south with the present City Limits line one mile to the most easterly point of the west shoreline of Oso Creek at mean low tide, same being the intersection of the west shoreline of Oso Creek and the westerly shore- line of Corpus Christi Bay; THENCE in a southeasterly direction with the shoreline of Corpus Christi Bay to its intersection with the southeast line of State Lease No. 78; THENCE northeasterly with the southeast line of State Leases Nos, 78, 672 662 51s 50, 33, 475, 450, 447s 420, and 417 to the northeast corner of State Lease No. 417; THENCE northwest along the northeast line of State Lease No. 417 to its intersection with the shoreline of Corpus Christi Bay; THENCE northwesterly, along and with the shoreline of Corpus Christi Bay to the most northerly corner of State Lease No. 12; THENCE southeast with the northeast line of State Lease No. 12 to its most easterly corner; THENCE southwest on a direct line to the most easterly corner of State Lease No. 41; THENCE northwest along the northeast line of State Lease No. 41 to its intersection with the shoreline of Corpus Christi Bay; THENCE southwesterly, weaterly, northwesterly, along and with the shoreline of Corpus Christi and Nueces Bays to its intersection with the southeast corner of State Survey No. 753 THENCE north with the east lines of State Surveys Nos. 753 and 751 to the shoreline of Nueces Bay; THENCE in a westerly direction with the shore- line of Nueces Bay to the northeast corner of State Survey No. 686; THENCE south with the eastiline of State Survey No. 686 to the southeast corner of said survey, THENCE west along with the south line of State Survey No. 686 to a point being a northward extension of the east line of State Survey No. 939; THENCE south, crossing State Survey No. 688, with the northward extension of State Survey No. 939, and continuing on with the east line of State Survey No. 939 to its intersection with the north line of the Nueces County Navigation District lands; THENCE east with the north boundary line of the Navigation District lands to the southeast corner of State Survey No. 708• THENCE south with the extension of the east line of State Survey No. 708 to its intersection with a northeasterly projection of $ e east boundary line of, the Tex-Max Cement Company 44.494 acre tract; THENCE in a southerly direction with the east boundary line and its northeasterly project of the said 44.494 acre tract, continuing on said course to inter- section with the present City Limits line of the City of Corpus Christi, same being the original northern City Limits line as surveyed by C.F.H. v. Blucher in August, 1883; THENCE east with the original and present nor them City Limits line as surveyed by C.F.H. v. Blucher in August, 1883, to its intersection with the centerline of Avenue F, extended, of Brooklyn Subdivision; THENCE in a northeasterly direction with the present City Limits line, same being the centerline. of Avenue F crossing the southern shoreline of Nueces Bay and continuing along said centerline extended to a point which bears north 32 deg. East 700 feet from the centerline of 34th Street, Brooklyn Subdivision;, THENCE in a southeasterly direction with the present City Limits line to a point on the south edge of the south abutment of the draw span of the Nueoes Bay Causeway on State Highway No. 16 and the place of beginning. BEGINNING at a point 180 feet northwest of the inter- section of the centerline of Ayers Street and the present City Limits line, same being 180 feet south of the centerline of Gollihar Road; THENCE southwest parallel to and 180 feet north- west of the centerline of Ayers Street to a point in the northeast line of lot 3, Section 4, Bohemian Colony Lands; THENCE southeast, crossing Ayers Street at right angles, continuing on with the northeast line of Lot 6, Section 3, Bohemian Colony Lands to the most northern corner of Southland Estates Subdivision; THENCE southwest to the most westerly corner of Southland Estates Subdivision; THENCE southeast along the southwest line of Southland Estates Subdivision and t he Moravian Pillage Subdivision and its southeasterly extension to a point 180 feet southeast of the centerline of Kostorys Road; " THENCE northeast with a line 180 feet southeast of and parallel to the centerline of Kostoryz Road to a point in the northeast line of lot 6, Section 2, Bohemian Colony Lands, said point being 180 feet southeast of the centerline of Kostoryz Road; THENCE southeast along with the northeast lines of lots 6 and 3, Section 2, Bohemian Colony Lands crossing Weber Road at right angles and cony timing on to a point 180 feet southeast of the centerline of Weber Road; THENCE northeast parallel to and 180 feet southeast of the centerline of Weber Road to its intersection with the present City Limits line of the City of Corpus Christi; THENCE in a northwesterly direction with the present City Limits line to a point in the present City Limits line that is 15 feet north- west of the centerline of Kostoryz Road; THENCE South 28 deg. 321 15" West a distance of 2,455.61 feet with a line that is 15 feet north- west of and parallel to the centerline of Kostoryz Road to a point; - THENCE North 61 deg. 271 15" West 1306.5 feet to a point, same being.the southwest boundary line of Southside No. 4 Subdivision of the City of Corpus Christi; THENCE North 28 deg. 411 East 1317.18 feet to a point, being the northwest boundary line of South_ side No. 4 Subdivision; THENCE North 28 deg. 211 East 324.13 feet, be- ing the northwest boundary line of Southside No. 4 Subdivision; -- THENCE South 61 deg. 23T 300 East a distance Of 1300 feet along the northeast boundary line of Southside No. 4 Subdivision to a point in Kostorys Road; THENCE North 28 deg. 321 15" East 815.7 feet with a line that is 20 feet northwest of and parallel to the centerline of Kostorys Road to a point in the present City Limits line; THENCE in a northwesterly direction with the Present City Lime a line to its intersection with the southeast boundary line of lot 28, Block 3, Rosemary Place Subdivision; THENCE South 28 deg. 10t West with the south- east boundary line of lot 28, and 27, Block 3, Rosemary Blace Subdivision, to a common corner of lots 23,24,26 and 27, Block 3, Rosemary Place Subdivision; THENCE South 61 deg. 401 East 330 feet to the extreme east corner of lot 19, Block 3, Rosemary Place Subdivision; THENCE South 28 deg. 10* West 1,080.5 feet along the southeast boundary line of Rosemary Place Subdivision to the extreme south corner of said sub- division; THENCE north 61 deg. 401 West 667 feet with the southwest boundary line of _Rosemary Place Subdi- vision to the extreme southwest corner of said Sub- division; THENCE North 28 deg. 10t East with the north- west boundary, line of Rosemary.Plaoe Subdivision to -5- the extreme north corner of lot 17, Block 1, Rosemary Place Subdivision; THENCE southeast with the northeast boundary line of lot 17, Block 1, Rosemary Place Subdivision to he extreme west corner of lot 18, Block 1, Rosemary Place Subdivision; THENCE N 28 deg. 3A1 East along the north- west boundary line of lots 18, 19, 20, and 22, Block 1, to its intersection with the present City Limits line; THENCE in a northwesterly direction with the present City Limits line crossing Ayers Street to the place of beginning. be and the same is annexed to the City of Corpus Christi, Texas, and is received into said City, and is included within the terri- torial limits of said City as an integral part thereof, and that said territory shall hereinafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter of said City and the ordinances, resolutions and laws of the City of Corpus Christi, Texas, to all intents and purposes as the present City of Corpus Christi, and subject to all the same rights,privileges and burdens thereof. SECTION II. The fact that such election has been held and the votes counted and canvassed and the results of the elec- tion declared in favor of annexation of such territory to said City, and it is important.to the residents of such territory that annexation of such territory be immediately completed, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested that such Charter rule Is suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and ef- fect from and after its passage, IT IS ACCORDINGLY SO OaraeMD* PASSED AND APPROVED, this the !day of October, 1950.
