AN ORDINANCE
ACCEPTING THE DEDICATION OF TEE STREETS M TCI[ GRAHAM
GARDENS BY THE OWNER THEEZOF, CORPUS CHRISTI, INCORPORATED,
A TEXAS CORPORATION, JOINED THEREIN BY NEW YOR% LIFE IN-
SURANCE CCMPANY, A NEW YORK CORPORATION, MORTGAME, AS
PUBLIC STREETS IN THE CITY OF CORPUS CHRISTI, TEXAS; AND
DECLARING AN EMERIGENCY.
WHEREAS, Corpus Christi, Incorporated, A Texas corporation,
is the owner of the following described tract and parcel of land, ly-
ing and being situated in Nueces County, Texas, to -wit:
and;
All that certain 22.848 acre tract or parcel
of land located in Corpus Christi, Nueces County,
Texas, and being a portion of the 43.052 acre tract
of land conveyed by Frank Braslau, et-al, to Corpus
Christi, Incorporated, April 11, 1949, and recorded
in Vol. 426, pages 493 to 497 of the Deed Records of
Nueces County, Texas, and more particularly describ-
ed as follows:
BEGINNING at a point in the Northwest line of
the 43.052 acre tract, conveyed by Frank Braslau,
et al, to Corpus Christi, Incorporated, April I1,
1949, said point being 40 ft. from and at right angles
to the center line of South Staples Street, formerly
Dump Road:
THENCE North 45 deg. 001 East, 1627.26 feet to
a point for corner, said corner being the Northeast
corner of said 43.052 acre tract;
THENCE South 31 deg. 06, East, 821.25 feet to a
point for corner;
THENCE South 50 deg. 081 West 336.06 feet to a
point for corner;
THENCE South 31 deg. 061 East 85.0 feet to a
point for corner;
THENCE South 58 deg. 541 West 480.00 feet to a
point for corner;
THENCE North 31 deg. 061 West 318.69 feet to a
point for corner;
THENCE South 45 deg. 001 West 790.77 feet to a
Point for corner in the Easterly line of South Staples
Street, formerly Dump Road, said point being 40 feet
from and at right angles to the center line of South
Staples Street;
THENCE North 31 deg. 041 45" West with the Easterly
line of South Staples Street, being 40 feet from and paral-
lel to the center line of said'street, a distance of 437.87
feet to the PLACE OF BEGINNING, and containing 224848 acres
Of land;
WHEREAS, the above described tract and parcel of land has
been platted in such a manner that certain streets have been designated
thereon, and said land is being developed for a low -cost rental housing
project known as Tom Graham Gardens, a copy of the plat thereof being
attached hereto, marked Exhibit "A" and made g part hereof; and
WHEREAS, Corpus Christi, Incorporated, owner, ;joined by
New York Life Insurance Company, mortgagee, has dedicated said
streets as shown by dedication instrument, a copy of which is
attached hereto and made a part hereof, dated August 189 1950,
duly executed and acknowledged, with the necessary, and proper plat
attached hereto showing the location of said new streets,all in
the manner and form as provided by lam to be filed of record upon
acceptance thereof by the City; and
WHEREAS, The streets that are proposed and are now under
construction meet the requirements of the City of Corpus Christi for
street improvements, including paving, curbs, gutters, and sidewalks,
if,as,and when completed; and
WHEREAS, The streets as laid out will fit into the street
pattern of the City and the streets will be used by the public, it
is deemed necessary, proper and requisite that the City of Corpus
Christi accept the dedication of said streets for public uses
NOU, THEREFORE, KNOW ALL NET] BY THESE PRESENTS:
SECTION 1. That the dedication of said streets in Tom
Graham Gardens as shown by said map or plat is hereby accepted by
the City of Corpus Christi, and the streets as shown in said map
or plat is hereby declared to be public streets of the City of
Corpus Christi, and such dedication and acceptance is hereby declared
to be valid and binding.
SECTION 2. That the fact that it is necessary to accept
the dedication of said streets for public use and that the City of
Corpus Christi may exercise jurisdiction over said new streets create
a public emergency and an imperative public necessity, requiring the
suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date it is introduced and that such ordinance
or resolution shall be read at three several meetings of the City
Council, and the Mayor, having declared such emergency and necessity
to exist, requesting that said Charter rule be suspended and that
this ordinance be passed finally on the date it is introduced and
that this ordinance take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SG ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, avid
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

WHEREAS, CORPUS CHRISTI, INCORPORATED, a Texas cor-
poration, is the owner of the following described tract and
parcel of land lying and being situate in Nueces County,
Texas, to wit:
All that certain 22.848 acre tract or par-
cel of land located in Corpus Christi, Nueces
County, Texas, and being a portion of the 43.052
acre tract of land conveyed by Frank Braslau et
al, to Corpus Christi, Incorporated, April H,

at right angles to the center line of South Staples

point for corner, said corner being the Northeast
corner of said 43.052 acre tract;
THENCE South 31006+ East, 821.25 feet to a
point for corner;
THENCE South 500081 West 336.06 feet to a
point for corner;
THENCE South 310061 East 85.0 feet to a
point for corner;
THENCE South 58054' West 480.00 feet to a
point for corner;
THENCE North 31006' West 318.69 feet to a
point for corner;
THENCE South 45000' West 790.77 feet to a
point for corner in the Easterly line of South
Staples Streets formerly Dump Road, said point
being 40 feet krom and at right angles to the cen-
ter line of South Staples Street;
THENCE North 31004'45" West with the Easterly
line of South Staples Street being 40 feet from
and parallel to the center line of said street a
distance of 437.87 feet to the place of BEGINNING
and containing 22.848 acres of land.
AND, WHEREAS, the above described tract and parcel
of land has been platted in such a manner that certain streets
have been designated thereon, and said land is being developed
for a low -cost rental housing project known as "Tom Graham
Gardens," a copy of the plat thereof being attached hereto,
marked Exhibit "A" and made a part hereof; and,
WHEREAS, since the streets shown on the plat here-
to attached constitute continuous streets of the City of
Corpus Christi over which public traffic will flow, it is
deemed necessary, proper and requisite that said streets be
dedicated to the City of Corpus Christi and to the public:
NOW, THEREFORE, K4OW ALL MEN BY THESE PRESENTS:
That for and in consideration of the premises and
Ten Dollars ($10.00) and other good and valuable considera-
tion to it in hand paid, CORPUS CHRISTI, INCORPORATED, a
Texas corporation, acting herein by and through its Presi-
dent, G. R. Swantner, hereunto duly authorized, does hereby
dedicate to the City of Corpus Christi and to the public for-
ever the streets in what is known as "Tom Graham Gardens,"
as shown upon a copy of the plat thereof hereto attached and
marked Exhibit "A" to which reference is made hereinabove,
SUBJECT to the easements heretofore granted, sold and con-
veyed to the City of Corpus Christi, Central Power and Light
Company, a Texas corporation, Southwestern Bell Telephone
Company, and any and all other utility companies entering
into and upon said property aforesaid, all as evidenced by
an instrument dated the 1st day of February,.1950, of record
in Volume 457, on pages 421 -428, Deed Records of Nueces
County, Texas, all of which said easements over and along
the streets hereby dedicated to the public use being fully
shown on the plat hereto attached and made a part hereof.
The undersigned, NEW YORK LIFE INSURANCE COMPANY,
a New York corporation, being the owner and holder of a valid
and subsisting lien on the property described herein, joins
herein in this dedication of the streets hereinabove described
to the City of Corpus Christi and to the public, subordinat-
ing its lien to accomplish the dedication of said streets,
said lien nevertheless to remain in full force and effect

otherwise as heretofore written.
